I will not issue such authorization at this time. Staff has reviewed the information contained in your May 16, 2017 letter regarding Rover Pipeline, LLC’s assessment that continued activities would best minimize the environmental impacts and potential extended risks of erosion into sensitive areas. However, field inspections conducted by the Commission’s Compliance Monitors reveal that the sites are currently stable, have appropriate erosion control measures installed, and have drill entry and exit sites adequately set back from the associated waterbody. While I am not granting authorization to resume drilling activities, I am granting authorization to remove the drill stem from the bore-hole at the Middle Island Creek HDD and to install a casing to prevent the hole from collapsing. As discussed in our May 10, 2017 letter to you, authorization to resume drilling activities in conjunction with the Rover Pipeline Project is contingent upon Commission staff’s consideration of: 1) the independent third party contractor’s analysis of all drilling activity at the Tuscarawas River HDD; and 2) the independent third party contractor’s recommended plan detailing the measures that Rover can put into place to ensure that the same level of impacts do not occur on the other HDDs during project construction. 20170525-3000 FERC PDF (Unofficial) 05/25/2017 2 If you have any questions, please contact Kevin Bowman, environmental project manager, at (202) 502-6287.
