Prnnsyfwnhl I 7IOI January 17, 1992 Jerry s. McOevitt, Esquire Kirkpatrick & Lockhart 1500 Oliver Building Pittsburgh, PA 15222-5379 Dear Mr. McDavitt: In response to your letter of January 16, 1992, requesting that this office issue a press release dealing with the existence or non-existence of a pending criminal investigation, I regret to inform you that I must substantially stand by the office policy to neither pUblicly confirm nor deny the · exis.tence of an investigation. I do feel obliged to inform you of the following: ( I have been advised by you of a radio interview in which a former professional wrestler known as superstar Billy Graham stated . that one of my Assistant U.S. Attorneys, Theodore Smith, contacted him and asked him to engage in consensually monitored conversations with one Vince McMahon because the FBI believed there was a connection between Mr· McMahon and the Mafia. I have discussed this matter with AUSA smith and he has stated that he did not request Graham to engage in intercepted conversations with Vince McMahon in connection with any investigation involving the Mafia. AUSA Smith is unaware of any suspected connection between McMahon and the Mafia and is unaware of any . investigation into such a suspected connection. I am, likewise, unaware of any suspected connection between McMahon and the Mafia nor any investigation into such a suspected connection in the Middle District of Pennsylvania. · I certainly intend that you pass this on to your client. I have taken this unusual step because I that it is particularly onerous to allege that someone is connected with the Mafia and because my office is alleged to have made that connection in Mr. McMahon' s case. It would be my intention to make no further comment or elaboration on this particular issue. ::· I appreciate and understand you bringing this matter to my and sincerely hope that there is no further speculation - in the media concerning pending organized crime investigations . .such investigations should be discussed only if and when charges C:: ·' attention EXHIBIT 2 .. - c . ... .,!
