This matter comes before the Court on the parties’ stipulation of April 24, 2017. Dkt. #76.
Upon consideration of the stipulation and the record, IT IS ORDERED THAT:

1. The Petitioner shall file and serve his proposed Second Amended Complaint.

2. Federal Defendants, named in their official capacity, shall have 60 days from the filing of the

Second Amended Complaint to answer or otherwise respond to that pleading.
3. Any further briefing or action in connection with Respondents’ Objections to the Report and

7

Recommendation is suspended. No later than 14 days after the Federal Defendants respond to the

8

Second Amended Complaint, the parties shall file a joint status report with the Court stating their

9

positions regarding whether the R&R is moot in light of the Second Amended Complaint.
