The defendants, on or about March 5, 2017, in Clackamas County, Oregon, did
unlawfully and recklessly, under circumstances manifesting extreme indifference to the value of
human life, cause the death of Ginnifer Mitchell, a human being who was a child under 14 years
of age by neglect.

COUNT 2 (ORS 163.205)
Class Felony
The defendants, on or about March 5, 2017, in Clackamas County, Oregon, in violation
of a legal duty to provide care for Ginnifer Mitchel], did unlawfully and knowingly withhold
necessary and adequate medical attention for Ginnifer Mitchell.

CRIMINAL MISTREATMENT IN THE FIRST DEGREE
COUNT 3 (ORS 163.205)
Class Felony
The defendants, on or about March 5, 2017, in Clackamas County, Oregon, in violation
of a legal duty to provide care for Evelyn Mitchell, did unlawfully and knowingly withhold
necessary and adequate medical attention for Evelyn Mitchell.
