LANDRIEU, IN HIS OFFICIAL CAPACITY AS MAYOR OF THE CITY OF NEW ORLEANS, AND THE CITY OF NEW ORLEANS FILED DEPUTY CLERK PARTIAL CONSENT JUDGMENT NOW COMES Plaintiffs, The Lens, Charles Maldonado, and Abram Handler (hereinafter ?The Lens?) and Defendants, Mitchell J. Landrieu, in his official capacity as Mayor of the City of New Orleans and the City of New Orleans (hereinafter ?City?) (collectively referred to as the ?Parties?), the Parties agree to the following Partial Consent Judgment with respect to the Declaratory Relief The Lens has sought only?The Lens? mandamus remains before this Court as the Parties continue to attempt to resolve that issue via Protective Order. On August 23, 2016, this Honorable Court granted The Lens" Motion for Partial Summary Judgment for Declaratory Relief, declaring that ?with respect to the numerous Public Records Requests complained of in the above-captioned matter, Plaintiffs? rights were violated when the City did not properly and timely respond to the Public Records Requests under the con?nes of the Public Records Law,? and awarded The Lens $2,500.00 in attorneys? fees, plus court costs. The City appealed the Court?s August 23, 2016 Judgment to the Louisiana Fourth Circuit Court of Appeal, which is currently pending under Docket No. 2017-CA-0039, and The Lens answered the appeal. The Lens and The City have agreed to dismiss the pending appeal of the August 23, 2016 Judgment, and in exchange, The Lens has agreed to waive its claim to the $2,500 in attorneys? fees awarded as part of the August 23, 2016 Judgment. IT IS THEREFORE ORDERED, ADJ UDGED AND DECREED that this Partial Consent Judgment be entered into the record of this Court, and that the portion of the August 23', Meier been? 41th . 2016 Judgment ordering the City to pay $2,500.00 in attorney?s fees to The Lens is hereby VACATED as moot.
