MOTION AND ORDER FOR MATERIAL WITNESS BOND

 

NOW INTO COURT, through the undenigmd Assistant District Attorney for the
Parish of Orleans, comes the State of Louisiana, who respectfully requests that an Order he
issued placing under bond one-- as a matuial witness in
the above captioned case. This order is requested for the following reasons:

The testimony 0- is essential to the prosecution of the above entitled case.

She was the vidini of the crime committed by James Cunningham. Her testimony about what

outlined is emential for the State to meet its burden.

The State has reason to fear-will not appear in Court pursuant to a
subpoena. She Wu subpoenaed at the address prvvided to the District Attorney's offioe for the
previous court date. When the Orleans Parish Shu-ifi's Office attempted to serve the victim at
that address the notation from court notify shows "service to appear for
the previous trial 'on Jammy 25', 2017. Afier multiple attempts to call -by the District
Attar-aey;s office \'lictim/Wimers counselor she stopped answering her phone, Since the last date
the ViptirnIWituess ocunscior has attempted to call the victim but has been unable to reach her.
The Assistant District Attorney attempted to serve the victim with 'a subpoena through an
investigator. No one answered at the address provided to the District Attorney's ofiice.

The State reconimends um hail he sat in the amount of $50,000.00 to insure the

appearnnce of the crimes: on the scheduled date of trial of January 27, 2017.
