Please do not support or co-sponsor LRB 0600/1. lf enacted, this law would violate the U.S. and Wiscons¡n constitutions by impairing our exist¡ng contacts and taking our existing contract rights. We Energies relied on the Public Service Commission's (PSC) decisions under the law to invest billions of dollars in much needed new power plants for our customers. The proposal is also bad policy. More than 15 years ago, the legislature gave the PSC the authority to consider new financing arrangements to ensure the construction of new plants at a 1 time when the Governor, the Legislature, and the public were all very concerned about electric reliability in Wisconsin. Every significant customer group in the state -- Citizens' Utility Board (CUB), Customers First! Coalition (CF!C), Wisconsin lndustrial Energy Group (WIEG), and Wisconsin lnitiative Seeking Energy Reform (WISER) -- participated in that legislative process. That process produced bipartisan legislation that created the "leased generation" approach to financing new electric generation and improving electric reliability in the state. See 2001 Act 16, S 3008mc, codified at Wis. Stat. S 196.52(9). A critical aspect of the law was that if We Energies agreed to invest the billions of dollars required to construct the needed generation, and if the PSC approved the generation leases as "reasonable and consistent with the public interest," no future PSC could modify or terminate the leases during their terms except as specifically provided in the PSC's order or the leases themselves. The same parties that worked on the leased generation law also negotiated the Power the Future (PTF) leases, including the rate of return We Energies would be authorized to earn on its investments. All were aware that as part of the financial package the contracts could not be abrogated over the 3O-year term of the leases. This protection was a condition of We Energies' participation in PTF and We Energies relied on it in good faith. Following a four-year regulatory process, and with strong customer group support, the PSC unanimously approved our request to build 21st century natural gas fired plants at Port Washington and coal-fired units at Oak Creek. Fast forwarding to today, the plants have provided a great value for customers. They have performed very well and are in the top ten most efficient power plants in the country. The fuel diversity provided by the (coal and natural gas) PTF plants has also benefitted customers. lts sponsors say the bill is motivated by high utility rates. ln fact, our utilities work very hard to keep our costs down. lf we look over the last ten years, our customer's electric and gas bills have stayed constant, or even improved. ln 2016, We Energies customers paid approximately $20 less per month than they did five years ago and paid less in energy costs than any year in the past decade. o a From May 2015 through April 2016, the average residential customer paid an average of $1+g per month for their combined We Energies natural gas and electric bill. The average residential customer bill has not been that low during that same time frame since 2004-05. ln 2017, We Energies' and electric rates are lower than 2016 We also have developed innovative prices to help our customers succeed and create new jobs in Wisconsin. Our innovative Real Time Market Pricing Program (RTMP) has directly benefitted many of the largest businesses in Wisconsin. The RTMP program has played a role in creating more than 2,000 jobs by allowing industrial customers to benefit from some of the lowest electricity prices in the country. 2 Finally, the bill's sponsors fail to mention the other side of the story: RELIABILITY. The electric rates prevailing in Wisconsin reflect its recent investments, investments other states have fallen behind on. The Power the Future project (PTF) that first utilized the /eosed generation contract law had near-universal support when it passed in the early 2000's. Supporters and the PSC recognized the need to avoid the harm to Wisconsin's economy and electric customers that would have been caused by an inadequate power supply. Yet, under LRB 0600, the Public Service Commission could retroactively re-open these existing contracts and change their terms to make them more favorable to one party over another. This is impairment of a contract and is clearly unconstitutional. ln addition, the bill undermines investors' confidence by greatly increasing their risk to earn the returns they were promised. lt materially harms the people who, in good faith, purchased shares, lowering the value of those shares by putting the returns-on-equity atrisk. While the supporters maintain that this bill will improve the business climate, in fact, the opposite is true. Changing the law in order to alter agreements made in good faith in the middle of the term of that contract sends the worst message possible to prospective employers considering locating to Wisconsin. Prospective shareowners must be able to trust the state to live up to the terms of the contracts it approved in the public interest when this law was passed and not try to change an agreement years after it is in place.
