THE STATE OF TEXAS COURT COUNTY OF HJDALGO MCALLEN, HIDALGO COUNTY, TEXAS I, CARLOS GARCIA #5801 do solemnly swear that] have good reason to believe, and do believe and charge, that heretofore, on the day of NOVEMBER 2015 in the County of Hidalgo and State ofTexas, TODD ANGELO PHELPS, hereinafter called Defendant, did then and there intentionally and knowingly cause the death of an individual, gun?13mm by running her over while operating a motor vehicle to wit: a 2006 blue Hummer. PC 011 Sunday, November 22, 2105, at approximately 2:39am, hicAllen Police LT. Robert Eason #5184 was on duty and traveling north in a marked police unit at the 600 block. of South Bicentennial Blvd. During this time he sees a red vehicle stepped near the intersection of Bicentennial and Dallas Avenue. This red vehicle was later known'to be a 2014 Ford Focus. Lt. Bason then observes the Focus reverse and a blue Hummer exiting off of Dallas Avenue and Bicentennial Blvd. The blue Hummer then begins to travel north on Bicentennial followed by the Focus. Lt. Boson begins to follow both vehicles without his overhead lights activated and sees the Focus pass the Hummer. The Focus then pulls in front of the Hummer at the it'll] block of South Bicentennial and the Hammer ended up stopping behind the Focus. As Lt. Eason pulls up behind the Hummer, he sees a female wearing dark clothing banging on the driver's side window of the Hummer. Lt. Boson observed damages to the driver?s side panel of the Hummer. 'Ihe Htunmer then reverses and Lt. Eason starts reversing his patrol unit as well and activates the overhead lights. The Hummer then drivers forward into the inside lane and begins to accelerate. As Lt. Eason begins to follow the Hununer to conduct a traf?c stop but sees a female wearing bluejeans come rolling out from underneath the Hummer and realizes the female wasjust run over. Lt. Bason stops his marked unit and exits in an attempt to help the female victim. He calls for an ambulance. The Hummer is last seen traveling north on Bicentennial and last seen eastbound on Highway 83. i The victim identi?ed as Christina Quintela was transported to a local hospital where she died of her injuries sustained in this incident. Two female witnesses, who were occupants of the red Ford Focus, approached Lt. Eason and told him that minutes earlier the Hummer had struck their vehicle at Dallas Avenue and Bicentennial Blvd. The female witnesses tell Lt. Eason that the Hummer had left the scene of the crash from Dallas and Bicentennial and that they started to follow the Hummer. One the female witnesses was able to take photos of the Hummer and its front license plates using her cell phone. Those license plates are Texas LPs of The female witnesses stated they ended up stopping the Ford Focus in front of the Hummer which also stopped. The witnesses reported the driver and the front passenger of the Hummer were African American males and that the driver was Wearing a baseball cap. One of the female witnesses stated the Hummer attempted to leave arid the victim stood in front ofthe Hummer, inches away from the front bumper, facing the driver. This female witness stated the victim raised her right hand and yelled to the driver to stop. The female witnessos then stated the Hummer intentionally ran over the victim and left traveling north on Bicentennial Blvd. The Hummer's license plates came back registered to aTodd Angelo Phelps. Locals were run on Todd Angelo Phelps with a date of birth of? A mug photo ofTodd Angelo Phelps was obtained at which time it was discovered he'is African American. Through the investigation, Detectives were able to locate an address and apartment number for Todd Angelo Phelps in McAllen. Upon arrival at that address in McAllen, Detectives located the blue Hummer, displaying TX LPs of parked behind the '1400 block of West Pecan (apartment complex). Detectives detained Todd Angelo Phelps and his twin brother identified as Timothy Bernard Phelps date of birth of I, who is also African American. Both were brought to the police station for questioning. The Hummer was towed to the police station for processing. Once at the police station Todd Angelo Phelps was placed in an interview room which is audio and video recorded. After his Miranda Warnings were read he agreed to speak to Detectives after waiving his rights. He stated he is the registered owner of the Hummer and Was driving the Hummer earlier this morning in the downtown bar district. He also stated he odd) was wearing a dark colored baseball cap while driving his Hummer. He stated his brother (Timothy) was with him and that both had'been at a downtown bar consuming alcohol earlier this moming up until closing time. When con?'onted about the Hummer being involved in a crash in the downtown bar district and a female being run over, he stated he could not remember what happened after he and his brother left the bar district due to being intoxicated. After speaking with Todd Angelo Phelps, Timothy Bernard Phelps was placed in an interview room which is audio and video recorded. After his Miranda Warnings were read, he agreed to speak to Detectives alter waiving his rights. Timothy stated his brother Todd was driving the Hummer earlier this morning and that they had been at a local bar in the downtown bar district consuming alcohol. At ?rst Timothy stated he (Timothy) could not remember anything after leaving the bar distrid due to being intoxicated. This was after being confronted about the Hummer being involved in a crash in the downtown bar district and about a female being run over. Timothy then stated his brother Todd was driving the Hummer when the Hummer got struck by a vehicle in the downtown bar district. Timothy stated he told his brother to pull over which he did and that a female suddenly stood in hem of the Hummer, inches away, from the front bumper (This information corroborates with one of the female witnesses saying the victim stood inches away ?om the front bumper of the Hummer). Timothy then stated his brother then drove forward and struck the female. When Detectives asked why he (Timothy) did not call the police to report a felony, he stated he was scared. The Hummer had red transfer paint to the front left tow hook and to the left front rim. The undercarriage of the Hummer was examined and hair and ?esh suspected to be human were discovered. Photos and samples were collected as evidence. The victim sustained external and internal injuries which were revealed at the autopsy. The victim also displayed a large and wide redfbruise marking on her middle back which may have been caused by either a tire or the undercarriage of the Hummer. Video footage in color obtained from a surveillance camera situated at the intersection ofBicentennial and Highway 33 shows a vehicle traveling north at about the 100 block of South Bicentennial Blvd. This vehicle appears to be running over something due th the body of the vehicle and its headlights moving up and down simultaneously. ids this vehicle nears the intersection of Bicentennial and Highway 83, it can be seen that this vehicle is' the blue Hummer which then turns east on Highway 83 making no attempt to_stop or retum to the scene. This is the only Hummer that is seen in this video footage at around 2:39am on ll-l2-15 which is about the time this incident occurred. SUSPECT: Todd Angelo Phelps DOB m, 200 lbs, Brown Hair and Brown Eyes.
