I?m aware that the alcohol license is still under appeal, but the increase in DUI-related arrests and collisions, in addition to the signi?cantly above average pace of other accidents near the casino, should leave ABC with no other choice but to terminate the interim operating permit. As stated in my previous letters to the ABC, I am also requesting that no liquor license be considered for the IV casino until all of the traf?c mitigation in the Caltrans ?nal environmental impact report (FEIR), and the intergovernmental agreement with the County of San Diego is completed. As of this letter, there is still a substantial amount of traf?c mitigation outlined in the Caltrans FEIR that is not complete or hasn?t even been started. Considering the alcohol related incidents and the tribe?s substantial failure to follow through on traf?c mitigation, ABC should end the appeal process by withdrawing the license. During the casino?s ?rst months of operation, from October 2016 to May 31, 2017, the California Highway Patrol reported 99 collisions, 13 DUI-related collisions, and 10 DUI arrests on the stretch of impacted by the casino. The decision by ABC to grant the IV an interim operating permit continues to put the public at great risk. State Route 94 is a two?lane rural highway that is currently performing at level of service (LOS) F. Adding alcohol to this already dangerous situation is proving to be disastrous for public safety. Due to the dire public safety hazard on this section of SR94, I strongly urge you to immediately rescind the issuance of lV?s interim liquor license and withdraw any 1600 PACIFEC HIGHWAY, ROOM 335 .
