Dear Ms. Chiavetta: On April 21, 2014, the State Association of Township Supervisors (PSATS) wrote to the Public Utility Commission (PUC) to ask the PUC to ?nd that Sunoco Pipeline, L.P. (SPLP) is not a public utility corporation, and to deny petition, ?led under the docket numbers listed above, for exemption from municipal land use and zoning processes within the Commonwealth of From the April 21 PSATS letter to the PUC: . .PSATS is opposed to SPLP's effort to turn itself into a public utility corporation and thereby circumvent normal municipal review of its plans.?1 In response to an amended petition from SPLP, PSATS, on June 4, 2014, reiterated its request to the PUC: ?However, PSATS is opposed to effort to classify its new pipeline venture as a public utility corporation and thereby circumvent normal municipal review of its plans. It is position that Amended Petition should be denied and that SPLP should be required to submit land development plans to the 31 municipalities where SPLP proposes to construct buildings to shelter pump stations and valve control stations.? On June 18, 2014, at a public meeting of the Board of Supervisors of Thombury Township, Delaware County, the Supervisors unanimously passed a motion expressing support for position as articulated in its April 21, 2014 letter (that is, opposing the petition of SPLP for exemption from municipal authority over its plans). This position of the Thornbury Township Delaware County Board of Supervisors was articulated in a July 7, 2014 letter signed by all Thombury Supervisors and addressed to each Public Utility Commissioner. Copies of the relevant motion as adopted and the July 7 letter to the Commissioners are enclosed. This common space immediately abuts a number of our Members? home sites and serves to provide a vegetative buffer from a busy roadway and space for enjoyment and recreation of our Members. We believe that any new use of this property by SPLP must be subject to full municipal control and review in the interest of the health, safety and welfare of our Members. We therefore fully support the positions of PSATS and the Supervisors of Thombury Township, Delaware County, as articulated in the letters discussed above. Along with PSATS and the Thombury Township Board of Supervisors, we respectfully request that the PUC deny the instant petitions of SPLP so that proper municipal authority over zoning, land use, and safety considerations can be exercised within our township. Dear Commission Members: The Board of Supervisors of Thornbury Township, Delaware County, unanimously voted on Wednesday June 18, 2014, at their regular meeting, to support the position expressed by the PSATS, as detailed in its April 21?t 2014 letter and as amended on June 9, 2014. Thornbury?s Supervisors believe that any determination by the PUC that would exempt Sunoco from generally complying with the Municipal Planning Code, and with our municipality's zoning and subdivision and land development ordinances, would usurp the responsibilities that our residents have entrusted the Board to uphold. Thornbury Township, along with other municipalities, is directly responsible to ensure the health, safety, and welfare of the municipality and its residents.
