Given the fact that we have been leaving a series of telephone messages for one another, but have not actually spoken, I wanted to provide a follow up correspondence to address some concerns that have been raised by my client. I have been advised that the valve site at the Andover prOperty shows that the pipeline equipment is supported by wood skids as opposed to being mounted to the nearby concrete footing. In addition, the gate on one side of the valve site is secured only with a plastic zip tie and on the opposite side of the gate, the chain link fence and barbed wire has been removed completely. It is my understanding that the chain link fence and barbed wire area has been replaced with a piece of construction netting that is only a few feet in height. As a result, the Association has concerns that the valve site is accessible to children or adults, and may serve as an attractive nuisance. In addition, I have been advised that none of the various valves or controls appear to be secured with any kind of lock. As a result, my client is requesting that Sunoco take all necessary steps to reasonably ensure that the equipment is secure and that all proper efforts are made to ensure that unauthorized access and/or tampering with the valve site cannot be accomplished. In addition, I want to reiterate and con?rm that during our prior conversation you informed me that Sunoco would only be conducting work within the boundaries of their easement area. In addition, please be advised that the Association does not permit access to the Association?s property, except as permitted in accordance with the terms of the easement agreement.
