ENROLLED 2017 Regular Session HOUSE BILL NO. 568 BY REPRESENTATIVE NANCY LANDRY 1 AN ACT 2 To amend and reenact R.S. 17:3914(C)(2)(b), relative to student information; to provide for 3 the authority of the Department of Education; to provide for the release of 4 information to entities located out-of-state; to provide for the use of information for 5 academic research; and to provide for related matters. 6 7 8 9 10 Be it enacted by the Legislature of Louisiana: Section 1. R.S. 17:3914(C)(2)(b) is hereby amended and reenacted to read as follows: ยง3914. Student information; privacy; legislative intent; definitions; prohibitions; parental access; penalties 11 12 13 * * * * * * C. 14 (2) Beginning August 1, 2015, no official or employee of a city, parish, or 15 other local public school system shall provide personally identifiable student 16 information to any member of the school board or to any other person or public or 17 private entity, except such an official or employee may, in accordance with 18 applicable state and federal law: 19 * * * 20 (b)(i) Provide to the state Department of Education, for the purpose of 21 satisfying state and federal assessment, auditing, funding, monitoring, program 22 administration, and state accountability requirements, information from which Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 568 ENROLLED 1 enough personally identifiable information has been removed such that the remaining 2 information does not identify a student and there is no basis to believe that the 3 information alone can be used to identify a student. No official or employee of the 4 state Department of Education shall share such information with any person or public 5 or private entity located outside of Louisiana, other than for purposes of academic 6 analysis of assessments or for purposes of research as authorized in Item (ii) of this 7 Subparagraph. 8 (ii) An official or employee of the state Department of Education may share 9 such information with a person who is an employee of, and conducting academic 10 research at, any postsecondary education institution accredited by a regional or 11 national accrediting organization recognized by the United States Department of 12 Education, provided the person and the department have entered into a memorandum 13 of understanding in which the person agrees to be civilly liable for any fine imposed 14 as provided in Subsection G of this Section for any violation of the provisions of this 15 Section. 16 * * * SPEAKER OF THE HOUSE OF REPRESENTATIVES PRESIDENT OF THE SENATE GOVERNOR OF THE STATE OF LOUISIANA APPROVED: Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
