To: Sgt. Dan Boland From: Det. Justus Reid, Jr. Date: 6/22/17 Case: 16PI000030A99 RE: Supervisor of Election-Absentee Ballot Voter Fraud 16PI000030A99 On 7/11/16, Det. Amero, Sgt. Boland, and I met with Palm Beach County Supervisor of Elections, Susan Bucher. Bucher alleged that there was a group of subjects that were working for certain political campaigns that were involved in voter fraud. The allegations were that these solicitors approached voters at their homes. Bucher suspected that these solicitors manipulated the voters, obtaining their absentee ballot request forms or absentee ballots by offering money or gift cards or by outright forging the voter’s signature on the form without the voter’s knowledge. At the meeting, Bucher estimated that there were approximately 2,000 suspected fraudulent absentee ballots and/or possible fraudulent absentee ballot request forms. Due to the number of potential victims Bucher alleged in this case, The State Attorney’s Office contacted Palm Beach County Sheriff’s Office and requested their assistance in making contact with each voter (potential victim). PBSO provided this office with 13 additional detectives. Following this, the canvassing boards reviewed the potentially fraudulent ballot requests/absentee ballots and found that the actual number of suspect forms was just over 200. After further review, Bucher’s office provided copies of 108 possible fraudulent absentee ballot request forms that were rejected. The 108 absentee ballot request forms. Of the original 108 absentee ballot request forms, based on detective field contacts, it was determined that 25 absentee ballot request forms were possibly altered, forged, or obtained in a fraudulent way. The Palm Beach County Supervisor of Elections Office provided an estimated 100 certified copies of absentee ballots rejected by the Palm Beach County Supervisor of Elections 2016 Primary Election Canvassing Board for further review. Of the estimated 100 rejected absentee ballots, based on detective field contacts, it was determined that 6 absentee ballots were possibly altered, forged, or obtained in a fraudulent way. Several citizens complained that they were receiving absentee ballots every year without having requested them; however I was unable to verify the veracity of this complaint. It is possible they were actually receiving a sample ballot and not an absentee ballot. Typically, the voters who are solicited are located in “low income” areas of Palm Beach County. Bucher’s office staff noticed that one subject (later identified as Delano Rodies Allen, B/M 2/6/86) turned in multiple bundles of absentee ballot request forms. The 07/13/2017 1 Public Records Request No.: 17-267 “vote by mail ballot request form” or absentee ballot request form requires the citizen to check a box indicating which election they are voting absentee ballot. In addition, it requires the citizen’s voter registration number, full name, date of birth, home address, and mailing address. Per Florida Law, only certain people may request an absentee ballot for family members. On the form’s “relationship to the requester” section, only a spouse, parent, child, grandparent, or siblings are permitted by law to fill out and sign the form. This activity alerted the office to the potential voter fraud. On 7/27/16, I spoke with Bucher over the phone. She advised that she could not find a Florida Law that defines punishment for merely turning in suspected fraudulent absentee ballots request forms to the Supervisor of Elections. On 8/4/16, we responded to the Palm Beach County Supervisor of Elections Office to collect documentation for this case. Bucher had a list of registered Palm Beach County voters that she and her office staff had spoken to regarding absentee ballot request forms. These voters had advised that they did not fill out or sign an absentee ballot request form. The list of voters provided; Verdina Coleman,1200 West 26th Street, Riviera Beach, FL 33404 Antonio Jaques, 711 North 7th Street, Lantana, FL 33462 Laumeme Guillaune, 258 North East 20th Street, Delray Beach, FL 33444 Sheba Williams, 320 West 21st Street, Riviera Beach, FL 33404 Annie & Leon Grimes, 1143 West 24th Street, Riviera Beach FL 33404 Cynthia, Anthony, Ursula, Gertrude, & Antoinette Morrow, Delores McCullon, 612 47th Street, West Palm Beach, FL 33407 Earl Sanders, 404 Monte Trail, West Palm Beach, FL 33415 Per Bucher, the majority of these voters complained that their signature was forged on an absentee ballot request form. On 8/10/16, we responded to the Palm Beach County Supervisor of Elections Office for a meeting. The Palm Beach County Supervisor of Elections Office provided information on a person of interest that was responsible for submitting large quantities of absentee ballot request forms to their office. That person was identified as Delano Rodies Allen, B/M 2/6/86. The Supervisor of Elections Office provided security video footage of Allen dropping off absentee ballot request forms at their office. Allen might possibly be working for a company, “Sky Administrations, LLC”, located at 161 SE 28th Court, 07/13/2017 2 Public Records Request No.: 17-267 Boynton Beach, FL 33435. The registered agent’s name for “Sky Administrations, LLC.” was Darren Romelus. It is not illegal to turn in completed absentee ballot request forms. It is a crime to be in possession of completed absentee ballots with a few exceptions, such as official election poll workers, family members, or legal guardians. It is against the law to forge a signature on the form. At the time that the information listed above was discovered, there was no probable cause for Allen’s arrest. 1200 West 26th Street, Riviera Beach On 8/11/16, Det. Sgt. Dan Boland and I responded to Verdina Coleman’s home located at 1200 West 26th Street, Riviera Beach, FL 33404 for an interview. Coleman is registered to vote in Palm Beach County. Coleman received a letter from the Palm Beach County Supervisor of Elections Office advising her that her absentee ballot had been rejected by their office due to a negative signature match. Coleman advised that she has never voted by absentee ballot before in her life and that she always goes to the polls to vote in every election. Coleman recalled multiple political solicitors stopping by her home, but advised that she could not identify any of them by sight. For a more detailed account, please refer to Coleman’s recorded interview. 1328 West 10th Street, Riviera Beach. After meeting with Coleman, we responded to Delano Allen’s last known address located at 1328 West 10th Street, Riviera Beach, FL 33404 for an interview. Allen was not home; however, we made contact with an unidentified black male who only identified himself as Allen’s family friend. This subject telephoned Allen in my presence and advised Allen that the police were at his home. Allen agreed to speak with me over the phone. Allen advised that he would be willing to meet with me in the future to provide a sworn statement. I requested a criminal history report for Delano Allen from a crime analyst at the State Attorney’s Office. On 4/27/17, I telephoned Delano Allen a second time to arrange an interview. There was no answer and a voice mail message was left requesting contact. On 5/15/17, at 1150 hours I responded to Delano Allen’s last known address of 1328 West 10th Street, Riviera Beach, in attempt to make contact with him for an interview. There was no answer and a voice mail message was left requesting contact. Allen never responded to any of my attempts to make contact with him. On 8/12/16, I served the Palm Beach County Supervisor of Elections Office with a subpoena requesting any and all copies of suspected fraudulent absentee ballots and possible fraudulent absentee ballot request forms. 07/13/2017 3 Public Records Request No.: 17-267 On 8/15/16, ASA Marci Rex, ASA Al Johnson, Det. Sgt. Dan Boland, and I, all members of the Palm Beach County State Attorney’s Office Public Corruption Unit met with command staff members of the Palm Beach County Sheriff’s Office at their headquarters to discuss the distribution of Sheriff’s Office resources to assist with this investigation. The Sheriff’s Office agreed to allocate 13 detectives to assist in locating potential victims of voter fraud throughout Palm Beach County. On 8/16/16, I was provided with a portion of the items subpoenaed from the Palm Beach County Supervisor of Elections Office. The subpoenaed documentation was returned to the Palm Beach County State Attorney’s Office Public Corruption Unit. On 8/16/16, I developed and submitted a Palm Beach County Voter Questionnaire to Det. Sgt. Dan Boland for review. The questionnaire was printed in three different languages; English, Spanish, and Creole. The purpose of the questionnaire was to identify potential victims of voter fraud and to determine if those identified victims had any information that was of evidentiary value. The questionnaires were to be distributed to Palm Beach County voters whose absentee ballots were rejected by the Palm Beach County 2016 Primary Election Canvassing Board. On 8/22/16, Det. Sgt. Dan Boland, ASA Marci Rex, and I responded to the Palm Beach County Supervisor of Elections 2016 Primary Election Canvassing Board Meeting for the vote by mail ballot canvassing located at 7835 Central Industrial Drive, Riviera Beach, FL 33404. The Palm Beach County 2016 Primary Election Canvassing Board was made up of Palm Beach County Court Judge Leonard Hanser, Palm Beach County Court Judge August Bonavita, and Palm Beach County Commissioner Steven Abrams. On 8/23/16, we held a briefing at the Palm Beach County State Attorney’s Office reference this investigation. Several detectives from the Palm Beach County Sheriff’s Office (PBSO) were in attendance to assist in gathering information for this investigation. There were a total of 13 PBSO detectives. John Human 07/13/2017 4 Public Records Request No.: 17-267 Det. Matt Stone Det. Bill McKenna Det. Kevin Umphrey Det. Courtney Minton Det. Larry Wood Det. Felix Torres. During the briefing, the Palm Beach County State Attorney, Dave Aronberg, addressed the group and stressed the importance of this investigation in terms of protecting this county’s voting process. Next, the Palm Beach County State Attorney Executive Assistant, Michael Edmondson, assisted in explaining the campaign process. Det. Sgt. Boland and I explained the information gathering process. The Palm Beach County Supervisor of Elections, Susan Bucher, provided copies of the 108 possible fraudulent absentee ballot request forms that were rejected. The 108 absentee ballot request forms were broken down first by city, and then by PBSO districts. Each PBSO detective was assigned a district. In those districts were the names and addresses of voters whose absentee ballots were rejected by the canvassing board. The detective’s assignment was to make contact with each voter to determine if they were a victim of voter fraud. The detectives were provided with a standard questionnaire that asked six basic questions involving the possibility of voter fraud. They were also provided with a standard “no contact” form for uncooperative voters who refused contact with police or were not home. Once the information was gathered by detectives in the field, it was turned over to this office to determine if there was sufficient information to schedule a voluntary sworn statement with the voter. On 8/25/16, at 1400 hours, ASA Rex and I responded to the Palm Beach County Supervisor of Elections 2016 Primary Election Canvassing Board Meeting for the vote by mail ballot canvassing located at 7835 Central Industrial Drive, Riviera Beach, FL 33404. Supervisor of Elections, Susan Bucher, advised the date and time the canvassing board would meet for a second time to examine absentee ballots. Upon our arrival, the door was locked and it appeared that no one was inside the building. On 8/26/16, I spoke on the phone with Palm Beach County Supervisor of Elections, Susan Bucher. She advised that the canvassing board was meeting again on 8/26/16 at 1400 hours to examine absentee ballots. I advised her to notify me of any new information pertaining to this investigation. On 9/12/16, the Palm Beach County Supervisor of Elections Office provided me with approximately 100 certified copies of absentee ballots envelopes that were rejected by 07/13/2017 5 Public Records Request No.: 17-267 the 2016 Primary Election Canvassing Board. These certified copies were of the exterior envelopes only and did not expose any content information. Of the estimated 100 rejected absentee ballots, based on PBSO detective field contacts, it was determined that 6 absentee ballots were possibly altered, forged, or obtained in a fraudulent way. There, Sarah provided a sworn recorded statement reference this case. Sarah’s grandmother, Ismene, stood by during the interview. Ismene speaks very little English. I showed Sarah and Ismene a certified copy of the Palm Beach County vote by mail absentee ballot request forms with their voter information hand written on it. Sarah advised that the information written on the two forms was correct. However, Sarah added that neither she, nor Ismene, filled out or signed the forms. Sarah advised that both her and her grandmother voted by absentee ballot. Further, Sarah stated that an unidentified black male collected their ballots and turned the ballots in to the polls. Both, Sarah and Ismene advised that they were unable to identify the black male who collected their absentee ballots. No one answered the front door. My business card containing my office phone number and my cell phone number was left at the home. On 4/5/17, at 1205 hours I returned to the address in an attempt to contact Eric Sullivan. There, I made contact with the current resident, Maria Connect. Connect advised that she and her husband have lived at this address for about a month. Connect advised that she did not know Eric Sullivan. 07/13/2017 7 Public Records Request No.: 17-267 On 9/23/16, I went to several addresses listed below in an attempt to make contact with potential victims. I attempted to locate subjects at different addresses, some of which met with negative results. I left my business cards at each residence requesting contact. 717 Silver Beach Road, Riviera Beach On 9/23/16, I responded to 717 Silver Beach Road, Riviera Beach in an attempt to make contact with Bengy Deesren, Kevin Dominique, Price Deesren, & Magda Elinne reference this case. The address had recent and extensive fire damage. It was, by its appearance, clearly vacant. 679 Silver Beach Road, Riviera Beach On 9/28/16, I met with Janice Murray, B/F 7/20/51, at her home address of 679 Silver Beach Road, Riviera Beach. There, Murray provided a sworn recorded statement in reference to this case. I showed Murray a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. Murray advised that the information written on the form was correct, but that she did not sign the form. Murray advised that she does not vote. Murray became uncooperative during the interview. Murray said that she was late for work. Murray got in her vehicle and drove away. There, both Shane and Rohon provided sworn recorded statements in reference to this case. I showed both Shane and Rohon a certified copy of the Palm Beach County vote by mail absentee ballot request form with their voter information hand written on it. Both Shane and Rohon advised that the voter information written on the form was correct, but that neither of them filled out the form nor signed it. Both Shane and Rohon were confused as to why the form was ever filled out because both of them vote at the voter polling stations. Rohon advised that he remembered an unidentified black female solicitor coming by his home to discuss absentee ballots. Rohon advised that he did not remember anything specific about the solicitor and could not identify her should he see her in the future. I showed Samuels a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. Samuels advised that the information written on the form was correct, but that she did not sign the form. Samuels advised that she votes at the voting poll and that she did not fill out the Palm Beach County vote by mail form. Samuels advised that every election season, her neighborhood is flooded with political solicitors. Samuels stated that she does not remember anything specific about any of the political solicitors that came to her home prior to the election. Young advised that she did not fill out the Palm Beach County absentee ballot request form. Young advised that someone else filled out her personal information on the form, but Young advised that she did sign the form. A short time later, Young received her absentee ballot in the mail. Young advised that she did not vote in the election (No crime). 635 Silver Beach Road, Riviera Beach On 9/23/16, I met with Jacqueline McKenzie, B/F 10/22/65, at her home address located at 635 Silver Beach Road, Riviera Beach. There, Mckenzie provided a sworn recorded statement in reference to this case. I showed McKenzie a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. McKenzie advised that the information written on the form was correct, but that she did not sign the form. Further, McKenzie advised that the signature on the form was a forgery. The signature on the form was dated 7/20/16. McKenzie stated that she remembered an unidentified black male and an unidentified white female in a tan Buick (unknown tag number) parked in front of her home before the 7/20/16 date. McKenzie identified the black male as having a thin build and wearing a bow tie. The white female was driving the vehicle. The subject inquired about absentee ballots and McKenzie’s political affiliation. This political conversation made McKenzie a little uncomfortable. McKenzie advised that she always votes at the polling stations and has never voted through absentee ballot. McKenzie stated that she could not identify the black male or white female and would not agree to view a photo lineup. For a more accurate account refer to McKenzie’s recorded statement (1 count, Forgery FSS 831.01). 655 Silver Beach Road #4, Lake Park On 9/23/16, I met with Lydia Stanford, B/F 8/12/52, and her husband James Stanford, B/M 12/14/59, at their home address, 655 Silver Beach Road #4, Lake Park. There, 07/13/2017 9 Public Records Request No.: 17-267 both Lydia and James provided a sworn recorded statement in reference to this case. I showed both Lydia and James a certified copy of the Palm Beach County vote by mail absentee ballot request form with Lydia’s voter information hand written on it. The form had James’ signature on it and it was dated 7/20/16. James confirmed that he signed the form for his wife, Lydia, because she has poor eyesight after recently suffering a stroke. James advised that he did not fill out the rest of his wife’s information on the form. That information was written by an unidentified black male who solicited the Stanfords at their home. James was shown a photo array of six similar photos of unidentified black males in a photo lineup. One of the photos was Delano Allen. James chose the first top left photo out of the six photos. The photo was circled. James initialed and dated under the photo that he chose out of the lineup. The photo James chose was not Allen’s photo. The photo lineup was logged in as evidence for documentation. For a more accurate account refer to the recorded statement (No crime). 689 Silver Beach Road, Riviera Beach On 9/23/16, I met with Taylor Ambrose, B/F 11/16/94, at her home address of 689 Silver Beach Road, Riviera Beach. There, Ambrose provided a sworn recorded statement in reference to this case. I showed Ambrose a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. Ambrose advised that she did not fill out the information portion of the form, but that the signature on the form was her signature. The signature date was 7/18/16. Further, Ambrose advised that solicitors came by her home address to inquire about absentee ballots and Ambrose’s political affiliation. Ambrose advised that she did not remember the description of any of the solicitors. Ambrose stated that she received her absentee ballot in the mail; however, she never voted. Ambrose’s family member, Tina Whitaker, who lives with her, was not home during my interview with Ambrose. Records indicate that Whitaker voted at a polling station during the election and not by absentee ballot. There, Fairclough provided a sworn recorded statement in reference to this case. I showed Fairclough a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. Fairclough advised that the information written on the form was correct, but that she did not sign the form. Fairclough advised that she typically votes at the polling stations. Fairclough stated that several political solicitors come to her home every election season and that she did not remember the description of any of the solicitors. There, Levy provided a sworn recorded statement reference this case. I showed Levy a certified copy of the Palm Beach County vote by mail absentee ballot request form with her voter information hand written on it. Levy advised that the information written on the form was correct, but that she did not fill out or sign the form. Levy stated that an unidentified black male came to her home address requesting her voter information and gave her “trouble”. Levy was shown a photo array of six similar photos of unidentified black males in a photo lineup. One of the photos was Delano Allen. Levy chose the first top left photo out of the six photos. The photo was circled. Levy initialed and I dated under the photo that she chose out of the lineup. The photo Levy had chosen was not Allen’s photo. The photo lineup was logged in as evidence for documentation. Burfield and I made contact with Ambrea Cabral, B/F 6/20/83, at her home address located at 311 Elaine Circle West, West Palm Beach. There, Cabral confirmed to me that she did fill out and sign the absentee ballot request form. Cabral advised that she received her Palm Beach County absentee ballot in the mail a short time later (No crime). On 11/1/2016 at 0911 hours, I telephoned the Palm Beach County Supervisor of Elections, Susan Bucher, and requested information reference this investigation. Shortly after, Bucher returned my phone call and advised that due to the 2016 federal election, there would be a delay on any requests. On 1/23/17, Det. Burfield and I reassessed this case. There were several additional potential victims of voter fraud that needed to be interviewed. I compiled a list of the subjects and their home addresses to continue the interview process. On 2/6/17, I responded to the Palm Beach County Supervisor of Elections Office. There, I was provided with additional information needed to continue this investigation. On 2/10/17, I responded to several voters’ home addresses throughout Palm Beach County to make initial contact with them. In the event that nobody was home, I left business cards with my contact information available to them to possibly schedule interviews in the future. 07/13/2017 11 Public Records Request No.: 17-267 320 W. 21st Street, Riviera Beach On 2/10/17 at 1118 hours, I responded to 320 W. 21st Street, Riviera Beach, to contact Sheba Williams. No one answered. My business card, containing my office phone number and my cell phone number, was left at the front door. On 4/5/17 at 1245 hours, I returned to 320 W. 21st Street, Riviera Beach, in an attempt to contact Sheba Williams. I made contact with one of Williams’ family members, Clarence Williams. I left my business card and my contact information with him. Williams advised that he would pass my information onto Sheba Williams. For the federal November 2016 election, Antoinette voted at the polls, but absentee ballots arrived in the mail. Antoinette advised that she never filled out an absentee ballot request form. Both Cynthia and Anthony Morrow voted at the polls for the local August 2016, but voted absentee ballot for the federal November 2016 election due to their age and physical condition. Cynthia and Anthony advised that they did not fill out an absentee ballot request form for the federal November 2016 election. All three subjects advised that they believe that “fraud” occurs during election season in their neighborhood. Gordon advised that her mother, Patricia, was in Jamaica due to several deaths in her family and that her daughter, Oriana, was at work at that time. Gordon advised that prior to the August 2016 election, an unidentified black-hispanic male with an unknown political affiliation came by her home. Gordon was not sure if she could identify that subject by sight. Gordon requested absentee ballots for her mother and daughter using an absentee ballot request form provided by that subject. Per Gordon, the absentee ballots arrived by mail. However, none of the absentee ballots were ever filled out and mailed. Gordon stated that the ballots were thrown in the trash. Gordon advised that everyone in her family voted at the polls during the election. The Palm Beach County Supervisor of Elections Office records show that Gordon, her mother, and her daughter did not vote in the August 2016 election. Gordon was adamant that all three of them voted at the polls for the August 2016 election. During the interview, Gordon telephoned both her mother and daughter. In both phone conversations, they advised that they voted at the polls for the August 2016 election despite what the record reflected. In August 2016, the Palm Beach County Office of the State Attorney received information in reference to possible voter fraud from Edward Smith, the Chief Investigator at the private law firm, Steinger, Iscoe, and Greene, P.A. The information was gathered by the law firm’s team of private investigators from several different addresses around Palm Beach County. In this information, Smith provided a list of 34 addresses of citizens who received absentee ballots by mail prior to the August 2016 election, but never filled out or signed an absentee ballot request form. Green stated that she votes at the polls every election year. No suspect information (1 count, Forgery FSS 831.01). In conclusion, this investigation spanned the length of several months. This was due to the large amount of documentation that was needed to be reviewed and the time it took in locating & interviewing potential witnesses in Palm Beach County. Throughout this investigation, many of the citizens contacted, or that we attempted to contact, were uncooperative. Many citizens were out of the country or no longer lived in Palm Beach County. The investigation was conducted in two parts, reviewing two forms. Those forms were the absentee ballot request form and the absentee ballot. It is not illegal to possess blank or filled out absentee ballot request forms. It is not illegal to turn in completed absentee ballot request forms. It is a crime to be in possession of completed absentee ballots with few exceptions, such as official election poll workers, family members, or legal guardians. It is against the law to forge a signature on the form. Most of the information for the investigation was provided by the Palm Beach County Supervisor of Elections Office. The law firm, Steinger, Iscoe, and Greene, P.A. also provided information for review. Most of this information is available to the public through the Palm Beach County Supervisor of Elections Office. During the course of this investigation, it was determined that 25 out of 108 absentee ballot request forms were 07/13/2017 23 Public Records Request No.: 17-267 possibly altered, forged, or obtained in a fraudulent way. An additional 22 voter fraud complaints were provided by Edward Smith. Smith is the Chief Investigator at the private law firm, Steinger, Iscoe, and Greene, P.A. During this investigation, Smith provided 22 possible voter fraud cases. Smith presented names and addresses of citizens that were possibly willing to cooperate. Some voters filled out and signed a written affidavit provided by Smith’s investigative team. The written affidavits turned over to this office by Smith were not clear. The citizens interviewed by Smith’s investigative team did not provide enough information in their written statements to impact this investigation. Voters wrote in their statements that they were not sure if they received an absentee ballot request form or an absentee ballot in the mail. The written affidavits established that multiple forgeries occurred. However, the written affidavits yielded no suspect information. It could not be determined who was responsible for filling out and signing the absentee ballot request forms. In certain cases, voters stated that they received an absentee ballot in the mail without ever filling out or signing an absentee ballot request form. In cases where forgery occurred, unknown person(s) were filling out and forging the voter’s signature on the absentee ballot request form. This investigation revealed a total of 21 cases where the absentee ballot request forms were forged by an unknown suspect(s) throughout different areas of Palm Beach County (Forgery FSS 831.01). There was not enough information discovered during the course of this investigation to name a suspect. It is a crime for non-official election personnel to be in possession of any absentee ballots. There is an exception for certain family members possessing another family member’s ballot. The Palm Beach County Supervisor of Elections Office provided me with an estimated 100 certified copies of absentee ballots rejected by the Palm Beach County Supervisor of Elections 2016 Primary Election Canvassing Board. The ballots were rejected based on a signature comparison from previous signatures on record. It was determined that 6 absentee ballots were possibly altered, forged, or obtained in a fraudulent way. It was determined through the course of the investigation that there was no criminal activity associated with these absentee ballots. The criminal activity generally surrounded the absentee ballot request forms. There was not enough evidence to name a suspect and sustain a lawful arrest and criminal prosecution. 07/13/2017 24 Public Records Request No.: 17-267
