In anticipation of the trial that is scheduled to begin on October 3, 2017, this Notice of

Settlement is filed to notify the Court of a resolution of claims as between the above-named

plaintiffs and the defendants, the Marysville School District No. 25 and Rosemary Cooper.1

On Friday, July 28, 2017, the Plaintiffs and the related insurance companies agreed to resolve

all claims in exhaustion of the available insurance policy limits approximated at $18,000,000.2

The Plaintiffs elected not to pursue amounts that would erode the School District’s general
budget that is designated for educating and protecting children.

This settlement is subject to Court approval in relation to the claims of Nathaniel

Hatch, a minor, and the matters related thereto. See SPR 98.16W. The facts of this case are

8

tragic, and the errors that led to this lawsuit, substantial. At the same time, the Marysville

9

School District, Rosemary Cooper, and the assigned insurance representatives and attorneys

10

handled this matter with great dignity and respect for the aggrieved families.3 The Plaintiffs

11

have great hope that the lessons learned from this lawsuit help prevent other tragedies,

12

everywhere, in the future.
