Dear Mr. Lanphear: I am writing on behalf of Lincoln Water District ("District") to supplement its July 21, 2017 response ("July 21st Letter") to the questions contained in the Procedural Order dated July 21, 2017 ("Procedural Order") in Docket 2017-00174, regarding the request of Nestle Waters North America Inc. (''NWNA") for approval for the transport of bulk water. Question I: Please discuss the impact of the proposed withdrawal of water from the Lincoln Water District Well#4 by NWNA. Please provide support for your response. Response: The proposed withdrawal of water from Well #4 by NWNA is not expected to negatively impact the District's public water system. As explained in my July 21st Letter, the water usage by Lincoln Paper & Tissue's ("LP&T") mill dropped significantly after a boiler explosion in 2013, and then ceased with the mill closure in 2015. My July 21st Letter included a spreadsheet showing LP&T's historical water usage from 2007-2015, with a peak annual volume of just under 175 million gallons in 2011. The District was more than able to meet LP&T's water demand without any negative impact on its system or adverse effect on its ability to serve other customers. The closure of LP&T's mill has left the District with substantial reserve capacity. NWNA is proposing to pump an annual maximum of 172 million gallons per year from the District, which is no more than the maximum annual volume consumed by LP&T when its mill was fully operational. Question 2: Please discuss whether the proposed withdrawal will adversely affect the ability of the District to fulfill its service obligations to its customers pursuant to Title 35-A. Please provide support for your response.
