STATUS REPORT AND REQUEST FOR HEARING Plaintiff American Oversight submits this status report to inform the Court of an issue that has arisen during Defendants’ rolling production of records responsive to Plaintiff’s Freedom of Information Act (FOIA) requests, and to ask this Court for an urgent status hearing to determine how best to address that issue. On May 25, 2017, this Court ordered Defendants the U.S. Department of Health and Human Services (HHS) and the Office of Management and Budget (OMB) to review and process records responsive to Plaintiff’s FOIA requests on a rolling basis. On July 31, 2017, Defendants made their second production of responsive records. Both Defendants’ recent productions contained extensive redactions under FOIA Exemption 5, which protects “inter-agency or intraagency” communications. See 5 U.S.C. § 552(b)(5). Surprisingly, in those productions, Defendants repeatedly relied on Exemption 5 to redact the substance of communications between agency officials and members of Congress or congressional staff. These redactions are without legal support and are directly at odds with the plain text of Exemption 5, which by its terms applies only to communications within and between executive branch agencies. American Oversight has 1 Case 1:17-cv-00827-EGS Document 15 Filed 08/02/17 Page 2 of 6 compiled several examples of these improper redactions, described below, which are attached hereto as Exhibit A: • An email chain between OMB Director Mick Mulvaney and Austin Smythe (Policy Director for Speaker of the House Paul Ryan), with part of the subject line and all substantive content redacted. OMB-American Oversight-000297–98. • An email chain including Paul Ryan, Mick Mulvaney, and Gary Cohn (White House Advisor), with all substantive content redacted. OMB-American Oversight-000452–54. • Emails between Paul Ryan and Mick Mulvaney, with all substantive content redacted. OMB-American Oversight-000636. • An email chain including OMB staff members, Jonathan Burks (Paul Ryan’s Chief of Staff), and Marc Short (White House Director of Legislative Affairs) regarding the announcement that a Republican Congressman had come out in opposition to the health care bill, with all substantive content redacted. OMBAmerican Oversight-000678–79. • An email chain including OMB staff members, Jonathan Burks, and Marc Short with subject line “Recap,” with all substantive content and attachments redacted. OMB-American Oversight-000736–38.1 • Emails between Kristin Skrzycki (Tom Price’s Deputy Chief of Staff) and Barrett Karr (House Majority Leader Kevin McCarthy’s Chief of Staff), partially redacted. HHS-July 2017-000201–02. • Emails between Heidi Stirrup (HHS Office of White House Liaison) and Stuart Burns (Chief of Staff to Rep. Brian Babin), with all substantive content and attachment redacted. HHS-July 2017-002023–25. • Emails between Sarah Arbes (HHS Principal Deputy Assistant Secretary for Legislation) and members of Senator Mitch McConnell’s staff, with all substantive content redacted. HHS-July 2017-002168. See Ex. The plain language of Exemption 5 makes clear that it applies only to “inter-agency” or “intra-agency” communications. It is well-established that Congress is not an agency for purposes of FOIA. See 5 U.S.C. § 551(1)(A) (defining “agency” to explicitly exclude “the Congress”); Dow Jones & Co. v. Dep’t of Justice, 917 F.2d 571, 574 (D.C. Cir. 1990) (noting that “Congress is simply not an agency”). In light of this self-evident fact, in a directly on-point and controlling opinion, the D.C. Circuit concluded that the “inter-agency or intra-agency” requirement of Exemption 5 precluded its application to a letter sent from DOJ to Congress. Dow Jones, 917 F.2d at 574. Under ordinary circumstances, it would be standard to address the propriety of redactions through summary judgment briefing.2 However, Plaintiff respectfully submits that the scope and facial infirmities of the redactions on these documents, coupled with the obvious political salience of the information they obscure, warrant the Court’s immediate attention. American Oversight respectfully asks this Court to hold a status conference about this issue as soon as possible for two primary reasons. First, allowing this issue to endure likely will lead to more litigation in the future, whereas swift resolution could prevent similar issues from arising in Defendants’ third and final production next month. Second, and more importantly, if this issue is not addressed until the conclusion of summary judgment briefing, the government will already have succeeded in preventing the disclosure of these communications until the latest possible date, and likely to a time when their disclosure would be less politically salient. The Court’s order for a rolling production of documents means little if the agencies can apply redactions arbitrarily to forestall disclosure until summary judgment. Such an outcome would encourage the government to apply broad and ultimately indefensible redactions to sensitive material in future cases, knowing 2 The Court set a summary judgment briefing schedule for this case, with briefing to begin on September 19, 2017, and conclude on October 23, 2017. Such an outcome would also frustrate Congress’s animating purpose in enacting FOIA— “ensur[ing] an informed citizenry, vital to the functioning of a democratic society, needed to check against corruption and to hold the governors accountable to the governed,” see NLRB v. Robbins Tire & Rubber Co., 437 U.S. 214, 242 (1978)—for, as the D.C. Circuit has recognized, it is axiomatic that “stale information is of little value.” Payne Enters., Inc. v. United States, 837 F.2d 486, 494 (D.C. Cir. 1988). A status hearing would allow the parties and the Court to discuss the most efficient manner to address and resolve this issue. * * * * * * * In light of the foregoing, Plaintiff American Oversight respectfully makes the following requests: 1.
