We need to have this measure on the 2018 ballot to stop the harmful proposed laws in Sacramento that further jeopardize federal, state and local law enforcement, but most of all public safety. The proposed ballot initiative is "Davis-Oliver and Kate's Law, Protecting Americans," the text is attached. This initiative is also needed because whatever President Trump will do is temporary, a future Congress or administration can avoid his administration's enforcement. The initiative has two very important endorsements from the Sacramento County Deputy Sheriffs Association and the Association for Los Angeles Deputy Sheriffs, the nation's largest DSA, among other endorsements. The strong polling in support of cooperation with federal detainer requests can be found in this article describing the severity of the problem: "Sanctuary Cities: Restricting Law Enforcement Risks Public Safety." Jack Citrin, the poll's director, is a political science professor at UC Berkeley, and immigration scholar who stated, ?We found very broad-based opposition to the idea of sanctuary cities, Californians want their local of?cials to abide by the requests of federal authorities.? Mr. Citrin told me a new poll will be done next month. Our previously ?led measure received the following title and summary: The Attorney General of California has prepared the following title and summary of the chief purpose and points of the proposed measure: UNDOCUMENTED IMMIGRANTS. STATE AND LOCAL ENFORCEMENT OF FEDERAL IMMIGRATION LAW. INITIATIVE STATUTE. Requires state and local agencies to report those believed to be undocumented immigrants in their custody to federal immigration authorities Bars release of undocumented immigrant if federal immigration authorities request hold. Provides for designating state/local law enforcement of?cers to perform certain federal immigration of?cer duties. Prohibits state/local laws or policies that restrict state/local of?cials from assisting enforcement of federal immigration law. Authorizes civil penalties against agencies or of?cials that adopt or implement any state/local law or policy against assisting enforcement of federal immigration law. Summary of estimate by Legislative Analyst and Director of Finance of ?scal impact on state and local government: Increased state and local law enforcement and corrections costs that could potentially reach several millions of dollars annually, a portion of which could be offset by the potential receipt of additional federal funds for law enforcement training. For their ?nal drafting of the measure, I submitted to the state's Legislative Counsel similar laws passed in other states, proposed federal laws, a request from ICE, and text from immigration attorneys in DC. With Legislative Counsel concurrence we could add language to address two proposed bills, 886, provides free legal services for deportation defense, and 8829, prohibits law enforcement agencies from entering into contracts with a for pro?t incarceration facility for civil immigration proceedings. The initiative's current language will over-turn 8854, the most harmful of the bills which essentially ties law enforcement's hands, and that will be reviewed with Legislative Counsel. Subject to ?nal review, it was stated they would provide support for it once the CSSA has endorsed. I spoke in person to Rep. lssa who said he will make his lists available from previous initiative efforts. There are numerous state legislators interested in this effort. This is the best political climate to move fon/vard on this type of measure with advocacy from the Trump Administration. No one wants to see the progress that Pres. Trump will make on this issue all be undone some day, but that will eventually happen. We need these permanent state laws to improve public safety.
