Department of Education, Office for Civil Rights (OCR), notified you of its investigation in the above~referenced case against the University of California, Los Angeles (University). The complaint alleged that the University failed to provide a prompt and equitable response to a student?s complaint of sexual harassment and that this failure subjected the student to a hostile environment that denies or limits the student?s ability to participate in or benefit from the University?s programs. On October 14, 2016, OCR received the student's request to withdraw the complaint. For the reasons expiained below, OCR is administratively closing this complaint. OCR enforces Title lX of the Education Amendments Act of 1972 and its implementing regulation. Title lX prohibits discrimination on the basis of sex in education programs and activities operated by recipients of Federal financial assistance. The University receives funds from the Department and is therefore subject to Title IX and its implementing regulation. Pursuant to Case Processing Manual Section 110(1), if a complainant withdraws the complaint after OCR has Opened it for investigation, OCR will determine whether the investigation raises systemic issues that warrant continuing the investigation, notwithstanding the complainant?s withdrawal. in addition, where OCR has obtained suf?cient evidence to support a finding with regard to any allegation(s), OCR will not close the allegation(s), but will proceed in accordance with the appropriate provisions set forth in CPM Section 303.2 In this case, OCR concludes that the systemic allegations are currently being investigated in OCR Case Processing Manual may be viewed at the US.
