Mr. McGahey sta a as five Siblings (four sisters and one brother). Mr. McGahey slated that his parents separated when he was very young. MARITAL HISTORY: The defendant indicated that he has never been married. Mr. McGahey stated that he has two children it es 4 and 5 ears old. Mr. McGahey stated that both children are In the custody orthetr Oklahoma. Mr, McGahey indicaled lhal he is owes $500.00 a month for child support tc _nd he Is also currently behind on child support. PRE-SENTENCE INVESTIGATION McGahey, Bradley Washington CF-2008-135 Page 2 EDUCATION: Mr. McGahey indicated that he attended Kingston High School in Kingston, Oklahoma and graduated in high school in 2004. Transcripts from Kingston High School in Kingston, Oklahoma indicated, Mr. McGahey attended and entered classes at Kingston High School on August 9, 2000 and graduated on May 21, 2004 with a cumulative grade point average of 1.58. EMPLOYMENT HISTORY: The Defendant indicated he has no steady form of employment. Mr. McGahey stated that he works for area farmers doing odd jobs when needed and that he also works for his father on the McGahey Farms in Kingston, Oklahoma. MENTAL SUBSTANCE ABUSE HISTORY: The defendant stated that he has never sought any counseling for any mental or disorders. Mr. McGahey mentioned the ?rst time he used alcohol was in 2003. Mr. McGahey reported the last time he used alcohol was in 2008. Mr. McGahey stated that he has never used illegal drugs. FINANCIAL CONDITIONS: The defendant stated that he owns a 1991 Ford Ranger pickup, valued at $500.00 and owes $500.00 a month for child support. PLANS IF GRANTED PROBATION: The Defendant provided the following written statement regarding his future plans. TRANSITION PLAN: summary of score and ?ndings of LSI-R. The and the ASUS (Adult Substance Use Survey) are used to assess treatment needs. Another component of the LSI interview is the identi?cation of the client?s placement in the Stages of Change model. This model identi?es six possible sequential stages in the behavioral change process. The identi?able stages include Pre-Contemplation, Contemplation, Preparation, Action, Maintenance and Relapse. After conducting the above-mentioned assessment, it appears that the defendant is in the Maintenance stage of change, because Mr. McGahey doesn?t have a substance abuse problem and plans to not associate with people in the future, who have a criminal history or people who use drugs. INVESTIGATION McGahey, Bradley Washington CF-2008-135 Page 3 TRANSITION PLAN (cont): Information indicates that Mr. McGahey?s LSI-R assessment score is a 22, with a mandatory placement module with Employment. Criminal History: The defendant scored 10% in this area. Education/Employment: The defendant scored a 70% in this area. The defendant is currently employed working odd and seasonal jobs. Mr. McGahey needs job skill training. Financial: The defendant scored a 50% in this area. The defendant stated that he owns a 1991 Ford Ranger pickup, valued at $500.00 and owes $500.00 a month for child support. Family/Marital: The defendant scored 25% in this area. Accommodations: The defendant scored a 0% in this area. Leisure Activities: The defendant scored 100% in this area. The defendant reports he enjoys riding and working with horses and attending team roping events. Companions: The defendant scored a 40% in this area. The defendant reported spending time with associates who have been in trouble with the law. Alcohol/Drug Use: The defendant scored a 33% in this area. Mr. McGahey reported the last time he used alcohol was in 2008. Mr. McGahey stated that he has never used illegal drugs. Emotional/Personal: The defendant scored 20% in this area. Attitudes/Orientation: The defendant scored 100% in this area. Information received from the Marshall County District Attorney?s of?ce indicated, while Mr. McGahey was on supervision with their of?ce, he would not report to his supervision of?cer as required; he failed to pay ?nes to the county court clerk and he failed to pay supervision fees to the District Attomey?s of?ce. The Marshall County Of?ce stated, Mr. McGahey has always tested negative for drug screenings. On December 8, 2009 about 5pm, this of?cer and Julie Rodgers of the Marshall County District Attorney?s of?ce contacted Mr. McGahey and instructed him to report to the Marshall County District Attorney?s of?ce, in regards to this Pre-Sentence Investigation and told him that we would wait on him since Mr. McGahey had mentioned that he was driving into Madill and only a few miles outside of Madill. Mr. McGahey never reported to the District Attorney?s of?ce as instructed. PRE-SENTENCE INVESTIGATION McGahey, Bradley Washington CF-2008-135 Page 4 RECOMMENDATION: Based upon background information compiled during this investigation, this Of?cer respectfully recommends that the defendant, Bradley Washington McGahey be denied probation and be sentenced to a term of incarceration. It is requested that the Defendant be assessed a $250.00 fee payable to the Department of Corrections for conducting this investigation in accordance with 0.8. 22 982a.
