As you probably know, collection actions brought by your client in the past (including the recent NCT v. Cowles and Rabchuk) have been dismissed, either voluntarily or involuntarily, due to your client?s failure to comply with the Corporation Business Activities Reporting Act (NJ.S.A. to 23) by failing to ?le a Notice of Business Activities Report. This bars it from bringing suit in our Superior Court under NJ.S.A. l4A:l3-20b. In addition, the loan described in the complaint, allegedly originated by Charter One Bank, was sold to National Collegiate Funding, LLC, and then to your client as part of the securitization of the loan. As such, it is doubtful that they have the documents (and witnesses with personal knowledge) necessary to prove its case at trial under our evidence rules. Please also note that .you do not have good service of the pleadings, as they were served on her mother at her former residence, not at her current one out of state. in light of all of this, we would demand the dismissal of this case to obviate the necessity of ?ling of an answer and a Motion to Dismiss.
