REQUEST TO BE TRANSFERRED TO
NEWTON CORRECTIONAL FACILITY

Defendant Myers, through standby counsel, requests that the court order him
transferred and held at the Newton Correctional Facility while he awaits trial. In support
of this motion Mr. Myers states as follows:
1. Mr. Myers is currently being held at CCA Leavenworth and is being denied
access to legal supplies he needs to represent himself in this case. He has previously been
held at the Newton Correctional Facility and requests that he be returned to that facility to
await trial.
2. Mr. Myers says problems arose at Newton during his previous stay there
because the prison had no clear order from the court regarding what documents and legal
supplies he could have. Mr. Myers believes that he would get along well at Newton if the
court would direct officials there to let him have the same items the court has previously
ordered the Polk Count Jail to let him possess.
3. If a transfer to Newton is not possible, Mr. Myers requests that he be

transferred to the Fort Dodge Correctional Facility.
Defendant Myers respectfully requests that the court take this motion up at the
hearing scheduled for Tuesday, January 25, and upon that hearing, grant the motion.
