The facts stated in this affidavit are within my personal knowledge and are true and c0rrect. Earn an employee of Hidalgo County Drainage District No. 1. was employed in the capacity of Financial Officer of the District. was employed by the HCDD on November 1.5, 2003, and have been continuously employed. was the Financial Officer during all relevant times when the began working on projects being funded by monies borrowed as a result of the 2006 Bond Election and the 2012 80nd Election. lam generally familiar with the agreement entered into between the HCDD and DHS and the to make improvements on the levees and construct the border wall (levee wall). lam also familiar with the contract entered by the HCDD and Integ Corporation on February 6, 13.007. 1 am the individual referred to as the Financial Officer of the District in Exhibit A whom had the responsibility of calculating the fees to be paid to lnteg. have always had a concern over the 1.5 commission on expent?iitures related to the 2.006 Esond Projects and Master Drain System Phase ii in Godfrey?s contract but accepted and understood that the Board had approved lt. was also concerned upon learning that the l.S% commission also applied to costs related to the DHS levee wail segments because they were federal projects and involved federal dollars. it was my belief that the 2/6/07 contract between lnteg and applied only to the One Hundred Million and nip/.100 ($100,000,00000) Dollars and related to the District Bond projects that were presented as the Master Drainage System Phase It and not levee or levee wall projects. i did not believe that the 0H3 Levee Wall project cost would be included in with any part of his contract entitling him to a commission. i now realize that lnteg should not have been paid the l.5% commission on any work done on the levee and levee wail projects because these projects were not a part of the I-lidalgo County Master Drainage Plan Phase ll as required by the 2/6/07 contract. i also now believe that lnteg should not have been paid the 1.5% commission on any engineering fees paid on any of the projects because the 2/6/07 contract refers onty to aggro} interpretation of his own contract approved onlehruary, 2013. . - .. as ate- 1/ i went along with paying lnteg 2:33.75 Million because ihad an approved contract with lnteg/Godfrey Garza, my supervisor, i caicoiated the expenditures relying on Godfrey Garz?cza and Legai?s interpretation of the contract on what expenditures to include and What expenditure not to include based on Godfrey?s and Steve?s opinion that wail segments were part of the levee rehabilitation and consistently iotlowecl that method of caiculation on all further payments or? the contracts? commissions. The District Manager was alwaysr eager to get cornmissionls paid as soon as possible. Commissions were supposed to have been paid tx-yicre a year per contract, however, District Manager demanded his commissions be calculated and paid more often. During the period of construction of the projects i discussed this issue with Mr. Scott Recinios, the Department of Homeland Security Program Manager after he told me had found out that Godfrey Garza was getting a commission and that they could not believe it. He said that Tiffany i?lixson, the DHS Program Executive Director, was liyid and that she couid not beiieye he (Godfrey Garza) was getting money. iiurther she said that this is something that could come out in 60 minutes. 1 again became concerned in August, 2013, when Mr. Godfrey Garza told me to calculate the l.5% on the $5.4 Million transaction involving the purchase of some engineering pians between and Hidalgo County. I do not behave he is entitied to this money because they are not part of any ?actual construction costs? as he indicated in Court on the approval of his 2013 contract.
