Under the FOIA Improvement Act of 2016, agencies must adopt a presumption of disclosure, withholding information “only if . . . disclosure would harm an interest protected by an exemption” or “disclosure is prohibited by law.”[1] If it is your position that any portion of the requested records is exempt from disclosure, American Oversight requests that you provide an index of those documents as required under Vaughn v. Last summer, he convened us again.  He told us there would be no Lame Duck period and instructed us to "run through the tape." What is it about sports analogies? Well, I think we lived up to these instructions.  In the last week: -- We brought a major, groundbreaking WTO case against China for subsidizing overcapacity in aluminum; and -- We brought our 26th WTO case of this Administration -- this one against our friends to the north for discriminating against our wine exports. And today: -- We signed an exchange of letters bringing the U.S.-Mongolia Transparency Agreement into effect.  This agreement was the first international agreement I signed as USTR, in September 2013.  It is fitting that we brought the process of implementation to a close on my last day. -- We signed an agreement (finally) establishing an environmental secretariat under the U.S.-Colombia FTA. -- And, very importantly, we completed an agreement with the EU which will allow the FDA and its counterparts in Europe to accept each other's audits of "good manufacturing practices" by pharmaceutical companies, thereby allowing them to reallocate resources to higher risk jurisdictions (e.g., India, China), eliminating redundant inspections and lowering compliance costs for companies and creating benefits for consumers in terms of improved oversight of drug safety.  This would not have happened but for our T-TIP negotiations, and it is illustrative of the broader steps we can take with the EU on regulatory cooperation when the politics permit.  Kudos to Jim Sanford, Amy Karpel, Dan Mullaney, Ashley Miller, Bill Moeller and Matthew Jaffe for bringing this one home. I am also delighted that in the last week, Mexico passed a major constitutional reform of its labor system and Honduras passed a labor inspection law -- both of which were the results of our work with those countries. I expressed my farewell sentiments at the All Hands meeting earlier this week, so I won't repeat them here.  Let me just say, to continue the sports analogies, when I look back, I think it's fair to say that we left everything on the field.  Thank you for that.
