The Attorney General of the State of Missouri and the Prosecuting Attorney of the County of Jackson, State of Missouri, upon information and belief, charges that the defendant, in violation of Sections 407.020, RSMo, committed the Class D Felony of Unlawful Merchandising Practices, punishable upon conviction under Sections 558.011 and 560.011 RSMo, in that on or about September 10, 2015, in the County of Jackson, State of Missouri, defendant, acting in concert with Xtreme Concrete and Outdoor Living, LLC, in connection with the sale of merchandise in trade and commerce, to-wit: home repair and renovation services to Gail Yaw, willfully, knowingly, and with the intent to defraud, made the false promise to Gail Yaw that in exchange for money paid in advance, he would complete agreed upon concrete remodel and repair services, a representation that was false or misleading as to defendant’s intention or ability to perform the promise, or likelihood the promise would be performed. The range punishment for a class C felony is imprisonment in the custody of the Missouri Department of Corrections for a term of years not less than two (2) years and not to exceed seven (7) years; or by imprisonment for a special term not to exceed one (1) year in the county jail or other authorized penal institution; or by a fine not to exceed five thousand dollars ($5,000); or by both imprisonment and a fine.
