The investigation resulted in a Notice of Violation (NOV) for Maintaining a public nuisance to wit: 1) Possession of marijuana and 2) Possession of counterfeit controlled substance. During the investigation, we came into contact with Manager Shannon Kahler, Manager Tammie Suliivan, and Employee Casey Williams. The details of the investigation are as follows: On the mentioned date and time, Of?cer Jackson and I entered the business to search for CBD products due to information that was received that this location is offering these types of products for sale. Officer Jackson and I found bottles that advertised to contain however, the bottles were empty and contained a sticker which indicated to contact an associate to obtain the product. Officer Jackson and I then came into contact with Manager Shannon Kahler. We informed Kahler that products containing and/or advertising to contain CBD are unlawful. Kahler stated that he was not familiar with the product. Officer Jackson and I presented Kahler with the empty bottles and asked where the actual products are stored. Kahler then brought Manager Tammie Sullivan into contact with Officer Jackson and me. Sullivan led us to a locked smail storage room where various items were stored. Sullivan believed it was possible that the products were stored in this room; however, we were unable to locate them. Sullivan then stated that she will have the employee that works that area come to the room to assist. Sullivan brought Empioyee Casey Wiliiams to the storage room. Williams was immediately defensive regarding the CBD product topic and informed Officer Jackson and me that we were wrong regarding the products illegality. Wiiliams explained that all of the CBD products were stored in the vitamin area of the store. In an effort to de? escalate the situation. i informed Manager Sullivan that Employee Williams needs to show us where these products are located and then we will no ionger need Williams assistance and that we wiil continue the investigation with only the managers of the business. Sullivan understood and after Wiliiams led us to the CBD products, Sullivan instructed him to go to the manager's office. Of?cer Jackson and began to inspect the products and found (38) thirty-eight ingestible or topical items containing and or advertising to contain CBD. These items included: 1. 1 BOTTLE 60 CAPSULES CBD OIL, 17 BOTTLES CBD OIL SPRAY 8 CBD BALM 3 BOTTLES CBD OIL DROPS 5. 9 SAGELY NATURALS HEMP CBD CREAM Of?cer Jackson prepared an evidence receipt for the above mentioned items along with 3 NOV. Officer Jackson and I explained to Managers Sullivan and Kahler that any items containing or advertising to contain CBD are unlawful. They stated that they understood. Once Officer Jackson completed the evidence receipt and the NOV, I explained the vioiation to the managers. Manager Sullivan signed the receipt for the seized items and Manager Kahler signed the NOV. They received copies of each. Of?cer Jackson and exited the business at this time without further incident.
