Josh Mosier, and Officer Shawn Catterson, conducted an investigation at Happy Daze Smoke Shop, d/b/a same, which is located at 6450 W. 10th Street Suite 2, Indianapolis, Marion County, Indiana. The investigation resulted in a Notice of Violation (NOV) against the Tobacco Certificate for Public Nuisance, to wit: 1) Possession of Marijuana, 2) Possession of counterfeit controlled substance, 3) Prohibited Smoking, and 4) Hindering Law Enforcement. I, Officer Crider reports the following: On the above mentioned date and time, I, Officer Crider first entered the premise and identified myself as an Excise Officer both verbally and by diSplay of badge to a white male standing behind the sales counter. I then asked this male (later found to be Shelton Jr.) if they sold any items that contained The male then confirmed and pointed to areas beside the sales counter that were on diSplay. Ithen observed various products that were clearly labeled to contain Ithen explained to this male that any items containing or advertising to contain CBD are unlawful. This male disagreed with me and stated that he would not allow me to take any of these products. He also stated that he would be calling his "knowledgeable" friends to help him step me from taking these products. This male then asked me for a warrant for the items that I would be taking. I then fully explained my authority as an employee of the Alcohol and Tobacco Commission and as an Excise Officer. This male stated that, am aware of who you are". I then explained that he could be charged with Hindering Law Enforcement. This male then stated that he did not believe me to be an of?cer based on the business casual attire that I was wearing. At this time, the male informed me of his Law Enforcement friends and stated that he would like a uniform of?cer to come to the scene. I then contacted ISP dispatch and requested an available unit to assist me at the scene. This male then started smoking a cigarette by the front door, which was inside the threshold of the entrance into the premise. I then continued to examine the display counter's for further items that were labeled to contain CBD. A few moments later, two other males arrived at the scene. One of the males (later found to be Kinnee) stated that he was an owner of premise. The other male remained unidentified. These males were further argumentative and again stated that I could not take their products. One of the males (Kinnee) then showed me a book that he stated was written by his father. He Went on to state that his father was a retired Police Officer and his silent partner. He then had his "father" on speaker phone and became further visibly upset. I again attempted to explain my actions and authority to confiscate the items. I also attempted to explain our directive for the enforcement. The "father" was then heard on the phone to stating that I was violating their constitutional. rights and that I shouldn't be taking their products without a warrant. The phone conversation then ended and the tension started to escalate between myself and the three males. Fortunately, before the situation escalated much further, Sgt. Mosier and Officer Catterson arrived at the scene. I then briefly explained the incident to Sgt. Mosier. Sgt. Mosier then repeated my explanation reference our actions and authority. At this time an Indiana State Trooper arrived at the scene in full uniform and assisted us with his presence. Sgt. Mosier was able to help de-escalate the tension, which allowed Of?cer Catterson and myself to inventory the CBD items and prepare the receipt for the items taken. At this time, I also prepared a violation against the premise, which included Hindering Law Enforcement. The males continued to be argumentative about the legality of CBD products, but finally began to cooperate with the investigation. Shelton IL, age 38 with a DOB of 8/29/1978. (Mr. Shelton was the employee that I first made contact with and observed smoking a cigarette inside the premise) James R. Kinnee, age 39 with a DOB of 2/8/1978. We then again fully explained to Owner Kinnee that any items containing or advertising to contain CBD are unlawful. Owner Kinnee continued to disagree the legality of our actions, but complied with our seizure. Mr. Kinnee then signed both the NOV and receipt, which he received a copy of each. We then exited the business without further incident. The above mentioned items containing or advertising to contain CBD were seized and placed into evidence. Officers to testify: Crider, Sgt. Mosier, Officer Catterson Defendant: Kinnee, Shelton Jr. Cost of investigation: $0.00 Note to Prosecutor: The charge of Hindering Law Enforcement was initially remOVed due to eventual cooperation.
