INTERVIEWED (CONT.): SALAMEH stated that she was in her apartment when she heard 6cnr7 shots from in front of the building . She heard tires squeal, and she hid until it was quiet again. INVESTIGATION: were assigned to the man shot at Kedzie and Fullerton.by Sgt.Mingey'of this command. responded to the scene and learned that the victim had been transported to Illinois Masonic Hospital by Fire Ambulance #52. learned from officers on the scene that the victim had actually been shot in the area of 2600 N. Kedzie and the driver of the vehicle that the victim was shot in drove the car south down Kedzie until he spotted a marked Chicago Police vehicle. This subject stopped his vehicle at Fullerton and Kedzie told the Police what had happened. The officers called for an Ambulance, which came to the scene, transported the victim, and the vehicle was left at 2358 N. Kedzie. FELE PERMANEN The vehicle the victim was shot in is observed on the street at 2358 N. Kedzie. The vehicle is in the southbound lanes facing south, against the curb. An examination of the vehicle reveals that the rear window has been shot out, and there is remnants of glass around the frame. The front driver?s window, as well as the front passenger window are also shot out with remnants of glass around the frame.The right rear opera window had two large bullet holes in it, but most of the glass remains in the frame. The outside of the vehicle reveals numerous bullet holes. On the left side of the vehicle there is a hole in the drivers door by the door handle, and another on the left rear roof column. There is another bullet hole in the left rear wheel well. There are two additional holes in the rear of the vehicle, one in the left rear turn signal and one in the trunk by the license plate bracket. Many of the holes pass through the vehicle and into the passenger compartment. Inside the vehicle there is a hole in the rear seat on the right side, and also a hole inside of the left rear column corresponding to the hole on the outside left rear roof column. There is a hole in the right front window frame, and holes in the inside roof lining. A quantity of blood is noted in the left rear seat, and a small quantity of blood is noted by the hole in the rear seat on the right side of the seat. A large quantity of window glass throughout the vehicle is observed, as well as additional glass outside the vehicle where it came to rest. learned that the victim had been seated in the rear seat on the left hand side. On the floor behind the drivers seat there a small plastic bag containing a crushed green plant. This is recovered by and inventoried at Officers from the Crime Lab Unit arrived on the scene and processed the scene at 2358 N. Kedzie, taking photos of the outside as well as inside the vehicle. Bullet fragments are recovered from the trunk as well as from the interior of the vehicle . INVESTIGATION (CONT.): and the Crime Lab Unit then proceeded to the scene at 2600 N. Kedzie. This is the intersection of Logan Blvd, Kedzie Ave, and.Milwaukee Ave. observed this intersection to be a circular drive around a monument, with adjoining and intersecting streets feeding into this circular drive. Traffic is stopped at various points by traffic lights and stop signs. On the street in front of 2600 N. Kedzie, observe a quantity of glass which trails around the corner westbound on Wrightwood. Supervisors from the 014th Dist had picked up five 9mm and two .22 cal shell casings that were in the street as there was no way to prevent traffic from running over these items. These casings were turned over to Det Wojcik. note that there is a hole in the southern most window on the first floor lobby of the building at 2600 N. Kedzie which appears to be a bullet hole. Further investigation revealed a spent slug inside the lobby at this location. Photos are again taken and the bullet is recovered. After the Crime Lab Personnel left the scene, discovered and recovered two 9mm casings and one .22 cal casing. These items were photographed recovered, and transported to and inventoried. then went to Illinois Masonic Hospital, and spoke to the attending Dr Nikolich, and learned that the victim had sustained a single gunshot wound to the right side of the head above the right ear, and the bullet was lodged. The vt?gim was listed in very critical comm? resumes then proceeded to and interviewed the two subjects, Jose MELENDEZ and Alberto RODRIGUEZ, who Were in the vehicle at the time the victim was shot. The note that both witnesses had been separated from one another from the time of having flagged down the preliminary investigating officers. These witnesses were interviewed separately' and independentlyu Their statements are in summary, and. not verbatim. Jose MELENDEZ stated.that he, "Nuni" (Noel ANDUJAR), and "Titi" (Alberto RODRIGUEZ), left the Lathrop Homes development on their way to the area of North Avenue and Spaulding. The three left the Lathrop Homes in described vehicle and headed westbound on Logan Boulevard. MELENDEZ was driving the auto with RODRIGUEZ in the passenger front seat, and the victim in the drivers side rear seat. MELENDEZ stated that as he approached the Logan Square Monument he observed the above detailed offender's vehicle, a Park Avenue with the described occupants, which was also headed westbound, stop in front of him at the stop sign just east of the monument?s circle drive. After the Park Avenue proceeded from the stop sign it slowed down in the lane to the left of MELENDEZ and waited caught up. As the vehicles continued west towards the stop light at Logan and Milwaukee, MELENDEZ observed.the occupants to be ?throwing down the crown" (representing opposition to the Latin King street gang) with their hands. MELENDEZ stated that he and the others in his vehicle did not represent their gang a} affiliation but continued on. INVESTIGATION (CONT.): While stopped at the light at Logan and Milwaukee, MELENDEZ stated that the occupants of the Park Avenue, who were now stopped directly to his left and even with his vehicle, continue throwing down the crown and now began representing "Cobra" (representing affiliation with the Spanish Cobra or YLO Cobra street gang). During this time MELENDEZ observed the driver reach to the drivers side door panel, remove an object, and hand it to the passenger. When the passenger flung his hood up, MELENDEZ stated he knew ?something was up" and he pulled away from. the light onto the circle drive towards southbound Kedzie Avenue. MELENDEZ stated that the Park .Avenue, which remained in the lane to his left, followed. While proceeding around the circle drive just west of the monument and north of Wrightwood, MELENDEZ stated that he observed the described front passenger in the Park Avenue open the door, reach around the door with a handgun in his right hand, and began firing in direction. MELENDEZ stated that he accelerated his vehicle and turned west on Wrightwood from the circle, with the Park Avenue in pursuit. As MELENDEZ fled westbound he heard additional shots being fired. MELENDEZ recalled driving through the stop signs on Wrightwood and heading to Kimball Avenue where km: turned north. The R/Dets. had previously been assigned to the homicide investigation of Ruben GONZALEZ. Ruben GONZALEZ had been shot while seated in a car at 3224 W. Fullerton on 20 May 95, at 0425 hrs. Ruben GONZALEZ was not a gang member but associated with members of the Imperial Gangsters Street Gang. On 20 May 95, at 1700 hrs. the R/Dets. interviewed the mother of Ruben GONZALEZ, Esther REYES at her home at 3501 W. Belden. As the R/Dets. conducted this interview, a black colored 86?88, Buick Park Ave. 4dr. with wire wheel covers, parked next to the home of Esther REYES. The driver of this car a got out and walked up to Esther REYES. This driver expressed his condolences over the death of Ruben GONZALEZ. The R/Dets. observed that there was another seated in the front seat. The driver returned to the car and this car pulled off. The R/Dets. asked Esther REYES who those guys were. She stated that they were friends of her son?s, and She stated that they were both members of the Imperial Gangsters. FEE On 24 May 95, The R/Dets. read the police reports already prepared in the murder investigation of Neel ANDOUJAR. Two witnesses in this investigation, Jose MELENDEZ and Alberto RODRIGUEZ had supplied detectives with a description of the offenders car in that murder. The offenders car was described as being a 1980?s dark colored Buick Park Ave. short body with four doors, tinted windows and Spoke wheels. The R/Dets. realized that this description closely matched the Buick Park Ave. seen at the home of Esther REYES. Noel ANDOUJAR was a member of the Latin Kings Street Gang, who are aligned with the People Nation. The location were Noel ANDOUJAR was shot at 2600 N. Kedzie, is not a neighborhood frequented by the Latin Kings. This is a neighborhood that is frequented by members of the "Orchestra Albany" Street Gang, who are aligned with the Folk Nation. Esther REYES had told the R/Dets. that the Imperial Gangsters were blaming the for the murder of her son. It appeared possible to the R/Dets. that members of the Imperial Gangsters drove into the neighborhood of the to seek revenge for the murder of Ruben GONZALEZ. A chance meeting instead took place with members of the Latin Kings who just happened to be driving through this neighborhood. {a CPD 1002 DETECTIVE DIVISION 4 30 MAY 1995 AREA FIVE DETECTIVES RDfi DEGREE MURDER VICTIM: ANDUJAR, Noel The R/Dets. contacted ocsp s. FIGUEROA and requested his assistance in identifying who and were. GCSP FIGUEROA identified as being Hector MONTANEZ 1-- and as being Thomas SIERRA -- GCSP G. FIGUEROA showed the R/Dets. photos of Hector MONTANEZ and Thomas SIERRA. The R/Dets. recognized these two individuals as being the persons they had seen in the Black Buick Park Ave. at the home of Esther REYES. On 25 May 95 at 1900 hrs. the R/Dets. went to the home of eye-witness Alberto RODRIGUEZ at 2717 N. Hoyne. Alberto RODRIGUEZ was interviewed and stated that he would only be able to identify the Shooter in this case. Alberto RODRIGUEZ was shown a photo array which consisted of (6) CPD Color Identification Photos. Upon viewing this photo array Alberto RODRIGUEZ identified the photo of Thomas SIERRA as the person who shot and killed Noel ANDUJAR. The R/Dets. attempted to locate the second eyetwitness Jose MELENDEZ and also have him view this photo array. The R/Dets. were not able to locate Jose MELENDEZ at this time. The R/Dets. were not at work for the next four days and ret on 30 May 95. PERMANENT RETE--Wfib'fi1530 hrs. Thomas SIERRA was observed on the street at 3510 w. -- He was placed in custody and transported to Area Five Detectives. On 30 May 95, at 1700 hrs. the R/Dets. were able to Contact JOSE MELENDEZ and Alberto RODRIGUEZ who arrived at Area Five at 1730 hrs. Jose MELENDEZ stated that he would only be able to identify the shooter. He was shown the same photo arra previously viewed by Alberto RODRIGUEZ. He also identified the photo of Thomas SIERRA as the person who shot and killed Noel ANDUJAR. This photo array was inventoried as evidence. On 30 May 95, at 1800 hrs. a lineup was conducted at Area Five Detectives, (SEE Jose MELENDEZ and Alberto RODRIGUEZ viewed this line up separately. Present for this interview were Det. R. GUEVARA and A.S.A. W. FARRELL. Thomas SIERRA acknowledged understanding each of his Miranda Rights as they were given to him by A.S.A. W. FARRELL. He agree to waive his rights and answer questions. SIERRA, Thomas In summary stated. the following. He denied being involved in the shooting of Noel ANDUJAR. He requested that the R/Dets. contact his girlfriend Lucy MONTALVO who would provide an alibi for him. GCSP J. RODRIGUEZ and E. WIORA observed the Black Buick Park Ave. of Hector MONTANEZ driving down the street. They stopped this car and determined that the driver' was a Jose IMELENDEZ. This is a different Jose MELENDEZ, not the eye-witness in this case. Jose MELENDEZ stated that he had just traded cars with Hector MONTANEZ that day. It was explained to Jose MELENDEZ that this car may be involved in a murder investigation. Jose MELENDEZ agreed to drive this car to Area Five. Jose MELENDEZ parked his car among a number of other cars in the front parking lot at Area Five. The R/Dets. asked eye?witness Jose MELENDEZ and Alberto RODRIGUEZ to walk through. this parkjju; lot and see if 'the car involved. in ?the shooting of Noel ANDUJAR was present. They both identified the Black Buick Park.Ave. lG4cw69B8Gl404621, as the car from which Thomas SIERRA fired his gun. FARRELL took a handwritten witnesses statement from Alberto RODRIGUEZ. On 30 May 95, at 2040 hrs. A.S.A. W. FARRELL took a handwritten witness statement from Jose MELENDEZ. Thomas SIERRA provided Det. R. GUEVARA with the telephone number of Lucy MONTALVO. She was contacted by Det. R. GUEVARA and driven into Area Five by GCSP J. RODRIGUEZ. The first intervieW' with Lucy MONTALVO was conducted on 30 May 95, 2215 hrs. in an interview room at Area Five Detectives. Present for that interview were Det. R. GUEVARA and A.S.A. W. She has been going out with Thomas SIERRA for about 4?5 months. She stated that from the time period of 22 May 95 to 28 May 95, she saw Thomas SIERRA every day. During that time period she would contact Thomas SIERRA by paging him between 2300" 0000 hrs. She stated that her mother and step?father went to bed every night at 2230 hrs. She would wait 30?60 minutes after they went to bed before she would page Thomas SIERRA. After she paged Thomas SIERRA he would arrive at her home sometime between 2300~ 0000 hrs. She stated that Thomas SIERRA was never at her home during of hours of 1800-2300,r and between the dates of 22 May to 28 May 95. She stated that Thomas SIERRA was usually dropped off by her home by a named Hector. Following this interview A. S.A. W. FARRELL took a handwritten statement from lacy M. WW7 narration FILE The R/Dets. had previously interviewed Hector MONTANEZ regarding the murder of this friend Ruben GONZALEZ. Hector MONTANEZ agreed to help the R/Dets. locate witnesses in that case. On 30 May 95, at 2300 hrs. Hector MONTANEZ was located by Det. A. WOJCIK and Det. J. and asked if he would come into Area Five Detectives to continue his assistance. He agreed to do so. Hector MONTANEZ arrived at Area Five driving a different car than his Buick Park Ave. Hector MONTANEZ stated that he had traded his car that day with another guy whom he did not know. He wanted to change cars because other gangs knew his car and. would look for it. Hector' MONTANEZ continued to believe that he was assisting the R/Dets. in the investigation of the murder of Ruben GONZALEZ. To that end he stayed at Area Five Detectives and made telephone calls to locate witnesses in that case. MONTALVO . On 31 May 95, at 0030 hrs. The first interview was conducted with Hector MONTANEZ in an interview room at Area Five Detectives. Present for that interview were Det. R. GUEVARA and A.S.A. W. FARRELL. Hector MONTANEZ was now informed that he was a suspect in the murder of Noel ANDUJAR. He was informed that eye?witnesses had already identified Thomas SIERRA. He was informed that the R/Dets. had his Black Buick Park Ave. at Area Five, and that wi nesses had identified his car as the offenders vehicle. Hector MONTANEZ acknowledged understanding each of his Miranda Rights as they were given to him by A.S.A. W. FARRELL. He agreed to waive his Miranda Rights and answer questions. CPD 1005 DETECTIVE DIVISION 7 30 MAY 1995 AREA FIVE DETECTIVES 2-226760 DEGREE MURDER VICTIM: ANDUJAR, Noel MONTANEZ, Hector In summary he stated the following. Ikais a member of the Imperial Gangster Street Gang, and has the nickname of He is a friend of Thomas SIERRA, and has been for some time. He knows Thomas SIERRA by the nickname of or On 23 May 95 he, Thomas SIERRA and a male black were driving in his Buick Park Ave. The three of thenl decided. to leave 'their' neighborhood tx> have a "session", while driving around" A "session" means to drive around while smoking marijuana and drinking beer. They had finished their "session", and started to drive back to their neighborhood. They stopped at a red light at the intersection of Milwaukee Ave. and Logan Square. They noticed a car approaching from the rear. The light turned green and the approaching car pulled up next to them. Thomas SIERRA was seated in the front passenger seat of his car. Hector MONTANEZ stated that he briefly looked at two males in the car that pulled up next to them. He began to accelerate because he was afraid that the men in this other car might shoot at his car. Thomas SIERRA pulled out a gun from underneath the front seat. The gun was silver in color and medium size. Thomas SIERRA fired the gun in the direction of this other car that was next to the right side of their car. He knew that Thomas SIERRA had shot up this car. The shooting took place at Logan Square. -After the shooting he continued to drive straight down Wrightwood. They continued to drive back ?to their' neighborhood, and. each. person. went their separate way. Hector MONTANEZ checked his car for the gun fired by Thomas SIERRA but did not find this gun. Thomas SIERRA stated that he had nothing to say and wanted to call his attorney. No further questioning of Thomas SIERRA occurred after this. The R/Dets. had previously been assigned to the homicide investigation of Ruben GONZALEZ. Ruben GONZALEZ had been shot while seated in a car at 3224 W. Fullerton on 20 May 95, at 0425 hrs. Ruben GONZALEZ was not a gang member but associated with members of the Imperial Gangsters Street Gang. On 20 May 95, at 1700 hrs. the R/Dets. interviewed the mother of Ruben GONZALEZ, Esther REYES at her home at 3501 W. Belden. As the R/Dets. conducted this interview, a black colored 86?88, Buick Park Ave. 4dr. with wire wheel covers, parked next to the home of Esther REYES. The driver of this car a got out and walked up to Esther REYES. This driver expressed his condolences over the death of Ruben GONZALEZ. The R/Dets. observed that there was another seated in the front seat. The driver returned to the car and this car pulled off. The R/Dets. asked Esther REYES who those guys were. She stated that they were friends of her son's, and She stated that they were both members of the Imperial Gangsters. On 24 May 95, The R/Dets. read the police reports already prepared in the murder investigation of Neel ANDOUJAR. Two witnesses in this investigation, Jose MELENDEZ and Alberto RODRIGUEZ had supplied detectives with a description of the offenders car in that murder. The offenders car was described as being a 1980? 5 dark colored Buick Park Ave. short body with four doors, tinted windows and spoke wheels. The R/Dets. realized that this description closely matched the Buick Park Ave. seen at the home of Esther REYES. Noel ANDOUJAR was a member of the Latin Kings Street Gang, who are aligned with the People Nation. The location were Noel ANDOUJAR was shot at 2600 N. Kedzie, is not a neighborhood frequented by the Latin Kings. This is a neighborhood that is frequented by members of the "Orchestra Albany? Street Gang, who are aligned with the Folk Nation. Esther REYES had told the R/Dets. that the Imperial Gangsters were blaming the for the murder of her son. It appeared possible to the R/Dets. that members of the Imperial Gangsters drove into the neighborhood of the S, to seek revenge for the murder of Ruben GONZALEZ. A chance meeting instead took place with members of the Latin Kings who just happened to be driving through this neighborhood. CPD 1024 DETECTIVE DIVISION 4 30 MAY 1995 AREA FIVE DETECTIVES DEGREE MURDER VICTIM: ANDUJAR, Noel The R/Dets . contacted GCSP G. FIGUEROA and requested his assistance in identifying who and were. GCSP G. FIGUEROA identified as being Hector MONTANEZ 867602, and as being Thomas SIERRA 1057667. GCSP G. FIGUEROA showed the R/Dets. photos of Hector MONTANEZ and Thomas SIERRA. The R/Dets. recognized these two individuals as being the persons they had seen in the Black Buick Park Ave. at the home of Esther REYES. On 25 May 95 at 1900 hrs. the R/Dets. went to the home of eye-witness Alberto RODRIGUEZ at 2717 N. Hoyne. Alberto RODRIGUEZ was interviewed and stated that he would only be able to identify the shooter in this case. Alberto RODRIGUEZ was shown a photo array which consisted of (6) CPD Color Identification Photos. Upon viewing this photo array Alberto RODRIGUEZ identified the photo of Thomas SIERRA as the person who shot and killed Noel ANDUJAR. The R/Dets. attempted to locate the second eye-witness Jose MELENDEZ and also have him View this photo array. The R/Dets. were not able to locate Jose MELENDEZ at this time. The R/Dets. were not at work for the next four days and returned to work 1530 hrs. Thomas SIERRA was observed on the street at 3510 W. Dickens. He was placed in custody and transported to Area Five Detectives. On 30 May 95, at 1700 hrs. the R/Dets. were able to contact Jose MELENDEZ and Alberto RODRIGUEZ who arrived at Area Five at 1730 hrs. Jose MELENDEZ stated that he would only be able to identify 'the shooter. Ike was shown 'the same jphoto array previously viewed by Alberto RODRIGUEZ. He also identified the photo of Thomas SIERRA as the person who shot and killed Noel ANDUJAR. This photo array was inventoried as evidence. On 30 May 95, at 1800 hrs. a line~up was conducted at Area Five Detectives, (SEE Jose MELENDEZ and Alberto RODRIGUEZ viewed this line? up separately. They both identified Thomas SIERRA as the person who shot and killed Noel ANDUJAR. The R/Dets. contacted Felony Review. W. FARRELL arrived at Area Five on 30 May 95, 1930 hrs. A.S.A W. FARRELL read the available reports, and was briefed as to the investigation thus far conducted. CPD 1025 DETECTIVE DIVISION 5 30 MAY 1995 AREA FIVE DETECTIVES 2?226760 DEGREE MURDER VICTIM: ANDUJAR, Noel On, 30 May 95 at 1945 hrs. the first interview was conducted with Thomas SIERRA in an interview room at Area Five Detectives. Present for this interview were Det. R. GUEVARA and A.S.A. W. FARRELL. Thomas SIERRA acknowledged understanding each of his Miranda Rights as they were given to him by A.S.A. W. FARRELL. He agree to waive his rights and answer questions. SIERRA. Thomas In. summary stated. the following. He denied being involved in the shooting of Noel ANDUJAR. He requested that the R/Dets. contact his girlfriend Lucy MONTALVO who would provide an alibi for him. GCSP J. RODRIGUEZ and E. WIORA Observed the Black Buick Park Ave. of Hector MONTANEZ driving down the street. They stopped this car and determined that the driver 'was a .Jose IMELENDEZ. This is a different Jose MELENDEZ, not the eye?witness in this case. Jose MELENDEZ stated that he had just traded cars with Hector MONTANEZ that day. It was explained to Jose MELENDEZ that this car may be involved in a murder investigation. Jose MELENDEZ agreed to drive this car to Area Five. Jose MELENDEZ parked his car among a number of other cars in the front parking lot at Area Five. The R/Dets. asked eye?witness Jose MELENDEZ and Alberto RODRIGUEZ to walk through 'this parking' lot and see if ?the car involved in 'the shooting of Noel ANDUJAR was present. They both identified the Black Buick Park Ave. 1G4cw6988G1404621, as the car from which Thomas SIERRA fired his gun. Photos of this car were taken by an Evidence Technician. A.S.A. W. FARRELL next conducted interviews with Alberto RODRIGUEZ and Jose MELENDEZ. On 30 May 95, at 2030 hrs. A.S.A. W. FARRELL took a handwritten witnesses statement from Alberto RODRIGUEZ. On 30 May 95, at 2040 hrs. A.S.A. W. FARRELL took a handwritten witness statement from Jose MELENDEZ. Thomas SIERRA provided Det. R. GUEVARA with the telephone number of Lucy MONTALVO. She was contacted by Det. R. GUEVARA and driven into Area Five by GCSP J. RODRIGUEZ. The first interview with Lucy MONTALVO was conducted on 30 May 95, 2215 hrs. in an interview room at Area Five Detectives. Present for that interview were Det. R. GUEVARA and A.S.A. W. FARRELL. CPD 1026 DETECTIVE DIVISION 6 30 MAY 1995 AREA FIVE DETECTIVES DEGREE MURDER VICTIM: ANDUJAR, Noel MONTALVO, Lucv In.summary stated the following. She has been going out with Thomas SIERRA for about 4~5 months. She stated that from the time period of 22 May 95 to 28 May 95, she saw Thomas SIERRA every day. During that time period she would contact Thomas SIERRA by paging him between 2300- 0000 hrs. She stated that her mother and step-father went to bed every night at 2230 hrs. She would wait 30~60 minutes after they went to bed before she would page Thomas SIERRA. After she paged Thomas SIERRA he would arrive at her home sometime between 2300- 0000 hrs. She stated that Thomas SIERRA was never at her home during of hours of 1800~2300, and between the dates of 22 May to 28 May 95. She stated that Thomas SIERRA was usually dropped off by her home by a named Hector. Following this interview A. .A. W. FARRELL took a: handwritten statement from Lucy MONTALVO. The R/Dets. had previously interviewed Hector MONTANEZ regarding the murder of this friend Ruben GONZALEZ. Hector MONTANEZ agreed to help the R/Dets. locate witnesses in that case. On 30 May 95, at 2300 hrs. Hector MONTANEZ was located by Det. A. WOJCIK and Det. J. MCMURRAY and asked if he would come into Area Five Detectives to continue his assistance. He agreed to do so. Hector MONTANEZ arrived at Area Five driving a different car than his Buick Park Ave. Hector MONTANEZ stated that he had traded his car that day with another guy whom he did not know. He wanted to change cars because other gangs knew his car and. would look for it? Hector MONTANEZ continued txa believe that lua was assisting the R/Dets. in the investigation of the murder of Ruben GONZALEZ. To that end he stayed at Area Five Detectives and made telephone calls to locate witnesses in that case. On 31 May 95, at 0030 hrs. The first interview was conducted with Hector MONTANEZ in an interview room at Area Five Detectives. Present for that interview were Det. R. GUEVARA and A.S.A. W. FARRELL. Hector MONTANEZ was now informed that he was a suspect in the murder of Noel ANDUJAR. He was informed that eye-witnesses had already identified Thomas SIERRA. He was informed that the R/Dets. had his Black Buick Park Ave. at Area Five, and that witnesses had identified his car as the offenders vehicle. Hector MONTANEZ acknowledged understanding each of his Miranda Rights as they were given to him by A.S.A. W. FARRELL. He agreed to waive his Miranda Rights and answer questions. He knows Thomas SIERRA by the nickname of or On 23 May 95 he, Thomas SIERRA and a male black were driving in his Buick Park Ave. The three of them. decided. to leave their' neighborhood tX) have a "session?, while driving around. .A "session" means to drive around while smoking marijuana and drinking beer. They had finished their "session", and started to drive back to their neighborhood. They stopped at a red light at the intersection of Milwaukee Ave. and Logan Square. They noticed a car approaching from the rear. The light turned green and the approaching car pulled up next to them. Thomas SIERRA was seated in the front passenger seat of his car. Hector MONTANEZ stated that he briefly looked at two males in the car that pulled up next to them. He began to accelerate because he was afraid that the men in this other car might shoot at his car. Thomas SIERRA pulled out a gun from underneath the front seat. The gun was silver in color and medium size. Thomas SIERRA fired the gun in the direction of this other car that was next to the right side of their car. He knew that Thomas SIERRA had shot up this car. The shooting took place at Logan Square. After the shooting he continued to drive straight down Wrightwood. They continued to drive back to their neighborhood, and each person went their separate way. Hector MONTANEZ checked his car for the gun fired by Thomas SIERRA but did not find this gun. Hector MONTANEZ does not know what happened to this gun. Hector MONTANEZ was asked to identify the who was seated in the back of his car. Hector MONTANEZ declined to do so stating that this guy didn't do anything and he did not want to get him involved. (A1 31 May 95, at 0130 hrs. a second interview was conducted with Thomas SIERRA in an interview room at Area Five Detectives. He was informed of the statement of Hector MONTANEZ. Thomas SIERRA stated that he had nothing to say and wanted to call his attorney. No further questioning of Thomas SIERRA occurred after this. On 31 May 95, at 0240 hrs. a second interview was conducted with Hector MONTANEZ in an interview room at Area Five Detectives. INVESTIGATION: were assigned to the man shot at Kedzie and.Fullerton by Mingey of this command. responded to the scene and learned that the victim had been transported to Illinois Masonic Hospital by Fire Ambulance #52. learned from officers on the scene that the victim had actually been shot in the area of 2600 N. Kedzie and the driver of the vehicle that the victim was shot in drove the car south down Kedzie until he spotted a marked Chicago Police vehicle. This subject stopped his vehicle at Fullerton and Kedzie told the Police what had happened. The officers called for an Ambulance, which came to the scene, transported the victim, and the vehicle was left at 2358 N. Kedzie. The vehicle the victim was shot in is observed on the street at 2358 N. Kedzie. The vehicle is in the southbound lanes facing south, against the curb. An examination of the vehicle reveals that the rear window has been shot out, and there is remnants of glass around the frame. The front driver's window, as well as the front passenger window are also shot out with remnants of glass around the frame.The right rear opera window had two large bullet holes in it, but most of the glass remains in the frame. The outside of the vehicle reveals numerous bullet holes. On the left side of the vehicle there is a hole in the drivers door by the door handle, and another on the left rear roof column. There is another bullet hole in the left rear wheel well. There are two additional holes in the rear of the vehicle, one in the left rear turn signal and one in the trunk by the license plate bracket. Many of the holes pass through the vehicle and into the passenger compartment. Inside the vehicle there is a hole in the rear seat on the right side, and also a hole inside of the left rear column corresponding to the hole on the outside left rear roof column. There is a hole in the right front window frame, and holes in the inside roof lining. A quantity of blood is noted in the left rear seat, and a small quantity of blood is noted by the hole in the rear seat on the right side of the seat. A large quantity of window glass throughout the vehicle is observed, as well as additional glass outside the vehicle where it came to rest. learned that the victim had been seated in the rear seat on the left hand side. On the floor behind the drivers seat there a small plastic bag containing a crushed green plant. This is recovered by and.inventoried at Officers from the Crime Lab Unit arrived on the scene and processed the scene at 2358 N. Kedzie, taking photos of the outside as well as inside the vehicle. INVESTIGATION (CONT.): and the Crime Lab Unit then proceeded to the scene at 2600 N. Kedzie. This is the intersection of Logan Blvd, Kedzie Ave, and Milwaukee Ave. observed this intersection to be a circular drive around a monument, with adjoining and intersecting streets feeding into this circular drive. Traffic is stopped at various points by traffic lights and stop signs. On the street in front of 2600 N. Kedzie, observe a quantity of glass which trails around the corner westbound on Wrightwood. Supervisors from the 014th Dist had picked up five 9mm and two .22 cal shell casings that were in the street as there was no way to prevent traffic from running over these items. These casings were turned over to Bet Wojcik. note that there is a hole in the southern most window on the first floor lobby of the building at 2600 N. Kedzie which appears to be a bullet hole. Further investigation revealed a spent slug inside the lobby at this location. Photos are again taken and the bullet is recovered. After the Crime Lab Personnel left the scene, discovered and recovered two 9mm casings and one .22 cal casing. These items were photographed recovered, and transported to and inventoried. then went to Illinois Masonic Hospital, and spoke to the attending Dr Nikolich, and learned that the victim had sustained a single gunshot wound to the right side of the head above the right ear, and the bullet was lodged. The victim was listed in very critical condition. then proceeded to and interviewed the two subjects, Jose MELENDEZ and Alberto RODRIGUEZ, who were in the vehicle at the time the victim was shot. The note that both witnesses had been separated from one another from the time of having flagged down the preliminary investigating officers. These witnesses were interviewed separately? and independently; Their statements are le summary, enui not verbatim. Jose MELENDEZ stated that.he, "Nuni" (N081.ANDUJAR), and . "Titi" (Alberto RODRIGUEZ), left the Lathrop Homes development on their way to the area of North Avenue and Spaulding. The three left the Lathrop Homes in MELENDEZ's above described vehicle and headed westbound on Logan Boulevard. MELENDEZ was driving the auto with RODRIGUEZ in the passenger front seat, and the victim in the drivers side rear seat. MELENDEZ stated that as he approached the Logan Square Monument he observed the above detailed offender?s vehicle, a Park Avenue with the described occupants, which was also headed westbound, stop in front of him at the stop sign just east of the monument's circle drive. After the Park Avenue proceeded from the stop sign it slowed down in the lane to the left of MELENDEZ and waited until MELENDEZ caught up. As the vehicles continued west towards the stop light at Logan and Milwaukee, MELENDEZ observed the occupants to be "throwing down the crown" (representing opposition to the Latin King street gang) with their hands. INVESTIGATION (CONT.): While stopped at the light at Logan and Milwaukee, MELENDEZ stated that the occupants of the Park Avenue, who were now stopped directly to his left and even with his vehicle, continue throwing down the crown and now began representing "Cobra" (representing affiliation with the Spanish Cobra or YLO Cobra street gang). During this time MELENDEZ observed the driver reach to the drivers side door panel, remove an object, and hand it to the passenger. When the passenger flung his hood up, MELENDEZ stated he knew "something was up" and he pulled away from the light onto the circle drive towards southbound Kedzie Avenue. MELENDEZ stated that the Park .Avenue, which remained in the lane to his left, followed. While proceeding around the circle drive just west of the monument and north of Wrightwood, MELENDEZ stated that he observed the described front passenger in the Park Avenue open the door, reach around the door with a handgun in his right hand, and began firing in direction. MELENDEZ stated that he accelerated his vehicle and turned west on Wrightwood from the circle, with the Park Avenue in pursuit. As MELENDEZ fled westbound he heard additional shots being fired. MELENDEZ recalled driving through the stop signs on Wrightwood and heading to Kimball Avenue where In: turned north. MELENDEZ said that the offenders vehicle continued westbound on Wrightwood, at which time RODRIGUEZ informed him that the victim had been hit. .
