?if; 1 CITY OF MAINE Incident 15-077973 BANGOR POLICE DEPARTMENT Narrative On October 6, 2015 at approximately 1528 hours I responded to 268 Stillwater Avenue; Acadia for the report of a patient vs. staff assault. Dispatch advised that Efrem Kann 03/10/1962 was assaulted by patient James Staples 12/29/1950. Upon arrival, I spoke to House Administrator Efrem Kann 03/10/1962. He brought me through the observation unit and to the family room on the backside of the building. As we passed through the observation unit, he asked RN Justine Crosby 08/10/1960 and Tech Tori Doucette 03/16/1995 to accompany us. Efrem told me the following in part and in substance. He explained that around 1250 hours, James was becoming agitated and a doctor requested medication be given to him to help calm him down. Justine got the medication and asked Efrem to accompany her into his room due to his violent tendencies. She told me that they went into the room she gave James the medication which she believed that he swallowed. After the medication was administered, James sat up and lunged at her attempting to assault her. Efrem stepped forward and James began swinging at him. Efrem was punched a few times in the upper body and told me that he grabbed James, wrapped up his arms, and placed him on the floor in a restraint until he could calm down. Efrem told me that he was not injured but told me that his ear hurt for about an hour after the ordeal. At 1505 hours, Tech Tori Doucette 03/16/1995 told me that she was standing at the counter of the nursing station. James came up behind her and punched her along her back and backs of her arms. She told me that he didn?t hit her with a lot of force but it was unwanted. She told me that she was not injured in the ordeal but does want to press assault charges against James. I then asked Efrem what James had for diagnoses. He told me because of HIPPA he would not be able to provide that information to me. I asked if James was his own guardian. He told me that he was. I asked for a medical release form for James to Sign. James later signed the form in my presence. I interviewed James in his room. He I left the door to his room open and told him that he didn?t have to talk to me if he did not want to. He welcomed me into his room. I asked him if he knew why Iwas there. He told me it was because he had hit somebody. I agreed with him and asked him to tell me why he did it. He told me that he did it because he feels like he is always running from fear itself and mentioned something about running from all of the bad things in his life and something about the bible. I asked him to tell me what happened today. He reiterated what Efrem had told me but told me that he actually intended to hit Justine but Efrem is condescending and stepped in front of her so he hit him instead. He told me that the bad things are what makes him want to hit people. I asked if he knew that assaulting people was wrong. He told me that he did and apologized for his actions. He told me that he just can?t control them. I explained that he needed to control them because the staff does not need to come to work and be assaulted. He told me that he would do his best not to assault staff again. On 10/07/2015, I received documentation from Acadia with his diagnoses of schizoaffective disorder, bipolar type unspecified personality disorder with narcissistic and borderline personality traits. I have included this document with this report. At this time both Efrem and Tori would like to press charges against James for the assaults because they believe that James knows what he did was wrong and they believe that he can control his viblent outbursts. They told me that he just chooses not to. . .. . I have sent this case to the district attomey?s office for review. WV ustin Dow Patrolman 754 Bangor Police Department Incident #15 -078375 BANGOR POLICE DEPARTMENT On 10-7?15 at approximately 2259 I responded to 268 Stillwater Ave; Acadia Hospital for a non active assault report. Dispatch advised that the suspect was James Staples and he was currently restrained by staff. Upon arrival, I met with officer Lund who said that James was sedated and restrained at that point. I stood by while Officer Lund was getting statements from the victims of the assault. Officer Lund advised that he needed to speak with James. I followed Officer Lund into the ward that James was currently in. Once inside I observed that James was physically restrained on the floor. Hospital staff asked James if he was released if he would be decent and cooperate. James said yes and was released. James stepped into his room and sat down on his bed. Officer Lund began to ask James what happened earlier tonight and James said ?you need to take me to jail, I am a bad person.? James then quickly stood up from his bed and began to swing closed fists toward Officer Lund. I observed Officer Lund push James away and he landed on his bed, at which time he was placed into handcuffs. Officer Lund began to ask James further questions and James was complying and seemed very calm. Officer Lund asked James if he was to be taken out of handcuffs would he remain calm. James stated ?yes.? Officer Lund then began to remove James from hand cuffs. After Officer Lund remove one hand cuff James quickly drew his elbow back and struck Officer Lund in the face with his right elbow. Officer Lund quickly pushed James to the bed and placed his right hand back into handcuffs. I took hold of ames?s upper body to prevent him from trying further to resist being placed back into hand cuffs. At this time Sgt. Maclaren arrived on scene. Hospital staff came over and stated that the doctor advised that James would be discharged as his treatment was complete and that James actions had nothing to do with his diagnosis. Hospital staff advised me that James actions were behavioral not I At this time Officer Lund informed James that he was under arrest and would be going to jail. I followed Officer Lund to the jail incase James caused any further issue. Once at the jail, James was being searched before he entered. I was in the room adjacent to were James was being searched when I heard a loud bang and what appeared to be a fight. I went to check what was going on and was advised by the jail staff that when they were removing James from handcuffs he attempted to strike one of the jail guards. James was restrained and then moved directly into a holding cell. Please see Officer Lund?s report for further. EMAINE BANGOR POLICE DEPARTM ENT Narrative On October 7, 2015 at approximately 2259 hours, I was dispatched to 268 Stillwater Avenue at Acadia Hospital for a non-active assault complaint. Dispatch advised that James Staples (DOB 12/29/1950) had assaulted staff, and was currently restrained and sedated. Upon my arrival I made contact with the complainant Margaret King (DOB 05/14/1982). She stated that at approximately 2215 hours, James came out of his room, went to the nurse?s station and punched another nurse in the shoulder, then punched that nurse in the face. Margaret stated that she then told James to go back to his room, and that he would not be assaultive with staff again. Margaret stated that James then entered the nurse?s station and punched her in the face. She stated that she pushed James, and other staff then restrained him. I then spoke with the other nurse who identified herself to me as Bethany Mazerolle (DOB 04/03/1984). She corroborated with Margaret?s story. She stated that while she was standing in front of the nurse?s station, James came out of his room, and punched her in the shoulder, and then punched her in the face. She stated that James then went after Margaret, and punched Margaret in the face. Neither Margaret nor Bethany had any visible marks from what could be seen. Officer Rusby and I spoke with Robert McLellan Jr. who is a House Administrator at Acadia HOSpital. He stated that James has been assaultive in the past, and the doctor at Acadia would be discharging him soon as his treatment was almost completed. I then spoke with James. When I entered the Observation Unit James was face down on the ?oor, being held down by staff. James was not actively resisting them. Staff had stated that he is refusing to allow them to let him out of restraints. James complied after several attempts to let him out of restraints. James was let off the floor and then went into his room. 1 Spoke with him there. He stated that he ?needed to go to jail?. I asked him why, and he stated that he was a bad person. I informed him that he was not. He then got up off the bed and swung his fists at me. I was able to push him back onto his bed, and Officer Rusby and I placed him in handcuffs. I told him that I did not want to take him to jail if he would behave himself and continue to receive treatment at Acadia. He stated that he needed to go to jail to be treated like he deserves to be treated. He stated that we treat him ?like a prince? and he does not deserve it. James stated that he is an ?awful person?. He was not aggressive during the conversation so Officer Rusby and I attempted to let him out of handcuffs. I took the handcuff off of his right hand, and he swung his elbow, striking my nose. I then grabbed his arm and put him in a wrist lock. I then pushed him face down on the bed and placed him into handcuffs again. Robert then entered and informed Sergeant MacLaren, Officer Rusby, and I that ames? discharge request went through, and he would be discharged immediately. I informed James that he was under arrest for assault, and transported him to Penobscot County Jail without incident. Once in the intake area of the jail, his handcuffs were taken off, and he again fought with Corrections Officers. James has been charged with two counts of Assault.
