I have Probable cause to believe and do believe that, James Staples DOB: 12/29/50 HEIGHT: 6'2" WEIGHT: 235 HAIR COLOR: Brown ,did commit the offense(s) of: ASSAULT, 174A M.R.S.A. The facts and circumstances which causes your affiant to believe this are as follows: On 02/ 1 6/ 17, [received ?a report of an assault that had happened the previous evening on the Lower Kennebec Special Care Unit at the Riverview Center AKA RPC According to the information that I had received, James Staples. 12-29?50 a patient at RFC, had assaulted another patient, Emily Fish 02-26-84. From information thatI had received, Staples had pushed Fish at approximately 20: 10 hours and then later in the evening at 21 :43 h-,ours he charged at her, shoved her into a kitchenette and punched her In the head. was able to obtain video from the assault at 21 43 and it clearly shows Staples walking down the hall and as Fish' 13 exiting a room, he charges her and shoves her down into a kitchenette/table and then apparently hits her in the head. Staples is then restrained by staff members and escorted to a seclusion room. On 02/16/17, I Spoke with Emily Fish on the LoWer Kennebec Emily is a very ill, very vulnerable young lady with obvious mental health issues. She described to roe-how her case worker, Richard and she pointed at? James Staples room.) had pushed her down into the table and hurt her head in two places; On 02/16/17, I-received a Progress Note horn PA-C Timothy Canham that was completed shortly after the assault. Canham states "His actions are believed globally to be volitional. and not related to his mental illness. He has been medication compliant throughout his hospitalization and is able to control his behavior when he chooses to. He is aware of hisrbehavior and has even. admitted that it is wrong. PA-C Canham states that Assessment: Volitional assaultive behavior". After reviewing the Criminal Record History for James Staples, he has multiple eonvictions( more than 3) for Misdemeanor Assault and this, along with his evaluation ?'om the mediCal staff at Riverview, shows a. continued course of conduct when it comes to perpetuating assaults on vulnerable victims.
