I recalled a study that was conducted by Vanderbilt University a couple of years ago that attempted to estimate the time and money spent by universities complying with federal regulations. The report can be found here As you?ll see, universities are subject to regulations that span financial aid, athletics, employment, campus safety, etc. Research universities, like Georgia State, are subject to an additional level of compliance governing research activities (fiscal regulations, human subjects, animals subjects, etc.). Regarding agency guidance documents, these are generally issued in relation to existing federal regulations, although arguably go beyond the regulatory language. Since there is some link between the guidance documents and federal regulations, separating the cost of complying with the guidance document from the underlying regulation is very difficult. As mentioned above, the university is subject to countless regulations. if there were a specific area of compliance we could focus on, we might be better able to analyze the incremental cost that such guidance documents impose. An area of compliance that has seen significant discussion with regard to federal regulations and agency guidance is Title DC and sexual violence. Not only are we subject to Title lX, but the Dear Colleague letters that have been issued, the Violence Against Women Reauthorization Act and its Campus Sexual Violence Act provision and the Clery Act. We have a mix of regulations and guidance which impose compliance issues, so separating out the cost of complying with a particular regulation or guidance is a challenge, especially if we are looking broadly across all the areas with which the university is responsible for complying. i wish i could provide you a more straightforward answer, but hopefully this helps explain why the question is difficult.
