ISP PITF responded to the scene at 1139 East 146'll Street, Dolton, Illinois. On 011011?09, at approximately 12:30 A.M., DPD Of?cer Coleman and DPD Reserve Of?cer Xenos #1 58 were dispatched to the area of 1 45"1 Street and University Avenue reference numerous calls reporting gunshots in the area. Of?cers Coleman and Xenos were driving on 1466' Street in the area East of University Avenue and West of Woodlawn Avenue when they saw a male black subject standing in the entrance to the alley between the above-mentioned two streets. The subject, later identi?ed BOOTH, was wearing all black clothing and had a hood over his head. Of?cer Coleman stopped his squad car in the middle of the street, and Of?cers Coleman and Xenos got out of the squad car and approached BOOTH in order to conduct a ?eld interview reference the reported gunshots in the area. BOOTH had his hands inside his jacket pockets and Of?cer Coleman told BOOTH the of?cers were there to investigate a call of shots ?red in the area. Of?cer Coleman ordered BOOTH to remove his hands from his pockets. BOOTH refused to obey Of?cer Coleman?s order and began walking away from Officers Coleman and Xenos. Of?cer Coleman continued to order BOOTH to remove his hands from his pockets, and Of?cer Coleman removed his service weapon from his holster. With his hands still inside his jacket pockets, BOOTH raised his right arm and pointed his right hand in the direction of Of?cers Coleman and Xenos. Of?cer Coleman discharged his service weapon striking BOOTH once. BOOTH fell to the ground and a clear, plastic bag containing twenty (20) small baggies containing a green, leafy substance fell out of hand. The green, leafy substance in the bags tested positive for Cannabis. O?icer Coleman placed BOOTH in handcuffs and searched BOOTH for weapons, but Of?cer Coleman found no weapon on person or in the immediate area around BOOTH. Officer Coleman called for supervisors and an ambulance to respond to the scene. Zy?, :gflidin?iar #4638 12/19f2011 BOOTH was never interviewed by personnel, but PITF personnel did interview treating physicians Doctor Green and Doctor Kupon, and DPD Sergeant Lacey who was assigned to guard and monitor BOOTH at St. Margaret Mercy Hospital. Doctors Green and Kupon and Sergeant Lacey all indicated BOOTH said he was shot by the police because he had marijuana in his possession and he ran from the police. Residences in the area of 139 East 146?? Street were canvassed, but did not produce anyone who witnessed the o?icer-involved shooting. One resident in the area was woken up by the scund of two gunshots, but that resident did not look out of his window. Illinois State Police Crime Scene Investigator (CSI) Grosvenor #5145 responded and processed the scene collecting all evidence. The victims encountered the suspect in an alley between University Street and Woodlawn Avenue, in Dolton. Victim #1 approached the suspect and ordered the suspect to remove his hands from his pocket. The suspect did not comply at which time victim #1 displayed his service weapon. The suspect turned to run and inferred a weapon under the suspect?s clothing, at which time victim #1 discharged his weapon. The suspect was struck once on the rear right buttock. The suspect was placed into custody, at which time a black cellular phone and bag of marijuana was discovered. The suspect was transported to St. Margaret?s HOSpital, in Gary, Indiana, where he was listed in stable condition. The scene was examined, photographed, and processed for physical evidence by CSI Grosvenor. During the examination and processing of the scene, the following observations were made: The scene was located in an alley that intersected 146th Street, between University and Woodlawn, in Bolton. One spent shell casing and a silver cross charm were located and collected from the grass at the south west corner of 14545 South 146thl Street. On 03f09/09 at 11:55 am, RID along with SIA Packert met with Police O?'icer Pete Xenos at 3480 S. Archer in Chicago. The following is a summary of that interview. Xenos related that he and Of?cer Coleman had responded to a call of shots ?red in the area of 146th near Woodlawn. The O?icers observed a suspicious subject walking at a fast pace on 146tll near Woodlawn. The Of?cers approached the subject (now known as Fennon Booth) and Of?cer Coleman asked Booth if he stays in the area and commanded him to remove his hands from his pockets. At this time both Of?cers exited their vehicle. Booth began to raise his hands, but did not remove them from his coat pockets. Coleman again commanded Booth to remove his hands from his pockets, but he did not comply. Booth then extended his right hand towards Of?cer Coleman. Both Of?cers commanded the subject to ?drop it? several times. Coleman then ?red his weapon two times. Booth fell to the ground and was secured by the Of?cers. Medical assistance was requested and a supervisor was called to the scene. Xenos further related that the entire incident happened very fast and that he could have seen the black object in Booth?s hand after he was shot, as his hands came out of his pockets, not before the shooting as he originally stated. On December 31, 2008, COLEMAN was scheduled to work 3 pm. to 11 pm. in uniform on a two-man patrol in a marked squad car. Due to the New Year? 3 Eve holiday, COLEMAN 3 shift was extended to 4 am. At approximately midnight, COLEMAN and his partner PIO Peter Xenos #108, were assigned numerous calls for ?shots ?red?. At approximately 12:30 am. on January 1, 2009, COLEMAN and XENOS responded to University and 145th Street. COLEMAN was driving a marked squad car with XENOS as his passenger. COLEMAN and XENOS were both in full DPD uniform. As COLEMAN approached the area, he observed a subject in all black clothing with a dark hood over his head. The subject, later identi?ed as BOOTH, was walking eastbound on the sidewalk of the 1100 block of East 146th Street. COLEMAN stated as BOOTH noticed the of?cers, he placed his hands in his coat pockets. COLEMAN stepped his squad car in the middle of the street to attempt to conduct a ?eld interview. COLEMAN stopped the squad car and advised BOOTH to stop. COLEMAN and XENOS exited their vehicle and approached BOOTH. COLEMAN told BOOTH that they were investigating a call of ?shots ?red? in the area and ordered BOOTH to put his hands where COLEMAN could see them. BOOTH became uncooperative and refused to comply. COLEMAN tin-bolstered his service weapon and again asked BOOTH to show him his hands. BOOTH kept his hands in his pocket as he began to walk away. BOOTH made a sudden move as he turned towards COLEMAN. COLEMAN stated hands were still in his jacket pocket and his jacket was unzipped. COLEMAN noticed a zip-lock bag containing several small bags containing cannabis fall out of hand as he was being handcuffed. COLEMAN discovered BOOTH sustained a gunshot wound and COLEMAN requested an ambulance and a supervisor via radio. DPD assisting of?cers arrived on scene within a short period of time and COLEMAN was separated from XENOS. COLEMAN surrendered his service weapon, a Glock model 21, .45 caliber pistol serial LEM610, and the cannabis recovered from BOOTH to DPD Sgt. Rempson Sgt. Rempson n-anSported COLEMAN to DPD where he was subsequently transported to Ingalls Hospital in Harvery, IL. asked COLEMAN if he observed BOOTH in possession of a ?rearm. COLEMAN stated that he did not, but was in fear of his life based on the poorly lit area, BOOTH not complying with police orders, and BOOTH concealng his hands. asked COLEMAN if BOOTH ever raised his hands when he encountered BOOTH.
