At the time this a p p l i c a t i o n employees were not r e p r e s e n t e d or individual. The Board assigned W i l l i t s to investigate. FINDINGS The i n v e s t i g a t i o n d i s c l o s e d that a d i s p u t e existed among the craft or class of Pilots and by d i r e c tion of the Board the Board R e p r e s e n t a t i v e was ins t r u c t e d to conduct an e l e c t i o n by secret b a l l o t to d e t e r m i n e the employees' r e p r e s e n t a t i o n choice. The f o l l o w i n g is the result of the e l e c t i o n as reported by Board R e p r e s e n t a t i v e D a v i d J. Strom who was a s s i g n e d to count the ballots in this case. - 233 - 13 N M B No. 70 Number of Employees Voting: Against Representation Number of Employees Eligible For Representation Pilots 2 19 26 The National M e d i a t i o n Board further finds that the Carrier and e m p l o y e e s in this case are, respectively, a Carrier and employees within the meaning of the Railway Labor Act, as amended; that this Board has jurisdiction over the dispute involved herein; and that the interested parties, as well as the Carrier, were given due notice of the Board's investigation. On the basis of the investigation and report of election which e s t a b l i s h e s that less than a m a j o r i t y of employees who cast valid ballots in the election voted for r e p r e s e n t a t i o n , the National Mediation Board finds no basis for C e r t i f i c a t i o n and the a p p l i c a t i o n is therefore d i s m i s s e d subject to Part 1206.4 of the NMB Rules.
