This is a citizen suit brought under the enforcement provisions of the Federal Water Pollution Control Act, 33 U.S.C. Section 1251 et. seq. (the "Clean Water Act" or "the Act"). This Court has subject matter jurisdiction over the parties and subject matter of this action pursuant to Section 505(a)(l)(A) of the Act, 33 U.S.C. l365(a)(l)(A), and 28 S.C. Section 1331 (an action for declaratory and injunctive relief arising under the Constitution and laws of the United States). 2. Venue is proper in the Southern District of California pursuant to Section 505(c)(1) of the Act, 33 U.S.C. ?l365(c)(l), because the source of the violations is located within this judicial district. II- 3. This lawsuit concerns defendant CITY OF SAN DIEGO (?defendant?)?s routine illegal discharges of tens of millions of gallons of raw sewage into the coastal waters of San Diego Bay, Point Loma, Ocean Beach, Mission Bay, Pacific Beach, La Jolla and Torrey Pines, causing thousands of closures of San Diego?s beaches and bays. A summary of defendant?s discharges of pollutants to navigable waters, for which plaintiffs are seeking civil penalties, is attached hereto as Exhibit 2 and is incorporated herein by reference as though set forth in full (the ?illegal discharges"). A copy of the citizen suit notice (without the 52?page summary of defendant?s illegal discharges which was attached to the notice, which alleged the violations described in paragraphs 10 and 11; those portions of the notice's summary, for which an award of civil penalties is sought in this case, are set forth verbatim on Exhibit 2 to this Complaint) is attached hereto as Exhibit 1 and is incorporated herein by reference as though set forth in full. 10. The United states of America has prosecuted a court action (United States of America v. City of San Diego, Southern District of California Case No. to redress defendant's illegal discharges through December 13, 1996, which are summarized in the notice. Plaintiffs are not seeking civil penalties in this case to redress these violations under the Clean Water Act, 33 U.S.C. However, these violations are clearly relevant in this case to the award of injunctive relief. 11. The Regional Board has issued a final order, not subject to judicial review, for defendant's illegal discharges of February 21, through March 2, 2000, which caused the closure of Ocean Beach, summarized in the citizen suit notice, to which the City paid an assessed penalty after service of the citizen suit notice. Plaintiffs are not seeking civil penalties in this case to redress those violations under the Clean Water Act, 33 U.S.C. As to defendant?s remaining illegal discharges set forth in the citizen suit notice, more than sixty days have passed since the notice was served on defendant, the State and the Federal agencies; the violations complained of therein have not ceased and are on?going; US EPA, the State Board and the Regional Board have not commenced and diligently prosecuted a court action to redress the remaining violations under the Clean Water Act, 33 U.S.C. l319(g)(6)(A)(i)(ii) and 1365(a); and US EPA, the State Board and the Regional Board have not.issued'a final order to redress the remaining violations, not subject to judicial review, to which defendant has paid the assessed penalty under the Clean Water Act, 33 U.S.C. and 1365(a). Therefore, this action is not barred by the diligent prosecution of any prior court proceeding or administrative penalty under Section 309(g) of the Act, 33 U.S.C. 1319(g). V. 13. Plaintiffs, as environmental organizations, and as representatives on behalf of their members, meet all standing requirements for prosecuting this complaint, have a geographical nexus with the affected environment, are beneficially interested in the subject matter of this complaint, and are adversely affected by the environmental impacts of the City's illegal discharges. l4. Baykeeper is an environmental organization dedicated to the protection of San Diego?s beaches, bays, rivers and coastal waters. Surfrider is an environmental organization dedicated, among other things, to the preservation and enjoyment of San Diego's ocean, waves and beaches. Surfrider has a chapter in San Diego_County. Surfrider has approximately one thousand five hundred (1,500) members that reside in San Diego County. 16,- Both plaintiffs engage in community activism, participate in governmental.hearings, and prosecute litigation, to ensure that San Diego's beaches, bays, coastal waters and tributary streams and rivers meet all substantive water quality standards guaranteed by Federal, State and local statutes and regulations, including the Clean Water Act, California?s Water Quality Act and Ocean Plan, and the Regional Board's Basin Plan. The interests that plaintiffs seek to protect in this complaint are therefore germane to their fundamental purpose. Plaintiffs bring this complaint on their own behalf. Plaintiffs? members and their families have a geographical nexus with the affected environment. Some of plaintiffs' members and their families reside, own property, work and recreate in San Diego, Point Loma, Ocean Beach, Mission Beach, Mission Bay, Pacific Beach, La Jolla and Torrey Pines. 18. Defendant?s illegal discharges interfere with the enjoyment of recreational activities by plaintiffs' members and their families. Other members and their families enjoy bicycle riding, skate?boarding, roller blading, viewing birds and other wildlife, walking, picnics, engaging in scientific study including monitoring activities, and other activities on and adjacent to San Diego?s beaches and bays. Other members and their families enjoy the aesthetics of San Diego?s beaches, bays and coastal waters. Defendant's illegal discharges interfere with the members and their families? enjoyment of these recreational activities. 19. Defendant?s illegal discharges interfere with the beneficial uses which plaintiffs' members and their families could make of San Diego Bay and Mission Bay. Both San Diego Bay and Mission Bay have been classified by US EPA and the State Board as impaired water bodies under the Clean Water Act, section 303(d). Both San Diego Bay and Mission Bay received this classification because their water quality has been impaired by precisely the same pollutants which defendant illegally discharges. As a result, plaintiffs? members and their families cannot use San Diego Bay and Mission Bay for all beneficial uses. 20. Defendant?s illegal discharges damage the health of plaintiffs' members and their families. An epidemiological study conducted by the University of Southern California (USC) concludes that contact with raw sewage discharged to receiving waters causes illnesses, including ear, nose, throat and stomach infections. 21. Defendant?s illegal discharges damage the food consumption interests of plaintiffS? members and their families. Fish and other seafood in the coastal waters off of San Diego County, and in San Diego Bay, have been harmed by precisely the same pollutants which defendant illegally discharges. Authorities have issued health advisories to not consume certain types of fish and other seafood. The presence of pollutants in these waters inhibits plaintiffs? members and their families from eating local fish and other seafood. 22. Defendant?s illegal discharges damage the financial interests of some of plaintiffs' members and their families. Some of plaintiffs? members and their families are employed in sports and recreational industries, manufacturing, selling and renting surfboards, paddleboards, bodyboards and other related products which are used in the coastal and bay waters of Point Loma, Ocean Beach, Mission Beach, Mission Bay, Pacific Beach, La Jolla and Torrey Pines. Defendant?s illegal discharges damage the financial interests of other members of plaintiffs and their families. Some of plaintiffs' members and their families are employed in tourism and related industries. Tourism is the City of San Diego?s third largest industry, generating at least $3.1 billion in revenue, and employing hundreds of thousands in jobs related to lodging, dining, shopping and recreation. One of .the primary attraction of tourists to San Diego is the natural environment of San Diego*s beaches and bays. ?However, defendant?s illegal discharges have caused San Diego to obtain a reputation as one of the world?s most polluted cities. For example, in its July 2000 edition, Forbes magazine rated the beaches of Mission Bay and La Jolla among America?s most polluted. The magazine wrote, ?If San Diego County has established itself as the California capital of sewage spills, then [Mission Bay] is its White House." The same article also gave La Jolla Shores the ?dubious distinction as one of California?s most polluted." Similar damaging articles have been published in the New Times and U.S. NEWS and world Reports. The damage to San Diego?s reputation from defendant?s illegal discharges has caused San Diego to lose tourist revenues and jobs. Plaintiffs? members and their families who are employed in tourism and related industries have suffered, and will continue to suffer, financial injuries as a direct result of defendant?s illegal discharges. 24. Plaintiffs and their members? health, recreational, aesthetic, scientific, educational, conservation, consumption, and economic interests have been, are being, and, unless the relief prayed herein is granted, will continue to be adversely affected and irreparably injured by defendant's failure to comply with the Clean Water Act. The injuries of plaintiffs, their members and their families, are actual, concrete injuries that would be redressed by the relief sought herein. Plaintiffs have no adequate remedy at law. Plaintiffs bring this complaint on behalf of themselves, their members and their families. 25. The claims asserted and the relief requested in this lawsuit do not require that plaintiffs? individual members directly participate as parties to this lawsuit. VI. FRAMEWORK 26. The Clean Water Act was intended "to restore and maintain the chemical, physical and biological integrity of the nation's waters." 33 U.S.C. 1251(a). To achieve this goal, Section 30l(a) of the Act prohibits the discharge of pollutants from a point source into navigable waters of the United States, except in compliance with various enumerated sections of the Act. 33 U.S.C. 1311(a). In particular, Section 301(a), 33 U.S.C. 5 1311(a), prohibits all discharges not authorized by or in violation of the terms of a National Pollutant Discharge 12 COMPLAINT FOR VIOLATIONS OF THE CLEAN WATER ACT LAW OFFICES OF RORY R- WICKS 625 BROADWAY. In California, pursuant to Section of the Clean Water Act, 33 U.S.C. US EPA has delegated to the State Board, and the State Board has in turn delegated to the Regional Boards, the authority to issue NPDES permits. 28. Section 308 of the Act, 33 U.S.C. 1318, requires all dischargers operating under NPDES permits to establish and maintain records, install, uSe and maintain mOnitoring equipment, sample effluents and submit reports on a regular basis to the permit?issuing agency regarding the actual discharge of pollutants.. 29. Section 505(a)(1) and Section 505(f) of the Act, 33 U.S.C. l365(a)(l) and provide for citizen enforcement actions against any "person" including corporations and municipalities, 33 U.S.C. 1362(5), for violations of NPDES permit requirements and for unpermitted discharges of pollutants. 30. Section 33 USC l365(b)(l)(B), provides that citizen suits may not be commenced if the Administrator of US EPA or the State has commenced and is diligently prosecuting a civil or criminal action to compel compliance with the requirements of the Act. Section 33 USC l3l9(g)(6)(B), further provides, however, that citizen enforcement is not preempted by agency enforcement where the notice required by the Act was provided prior to commencement of the agency enforcement. VII. STATEMENT FA T8 31. Defendant is responsible for providing a complete and comprehensive sewage disposal system for the City of San Diego. _Defendant is also responsible for providing for the management, control and diSCharge of storm and flood waters in the City of San Diego. As part of these responsibilities, the City owns and operates the Point Loma Wastewater Treatment Plant (?treatment plant?), the Point Loma Ocean Outfall (?outfall?), the Metropolitan Sewage Collection System (?sewage system?) which consists of approximately 2,800 miles of sewer lines, and the Metropolitan Stormwater Conveyance System (?stormwater system?). 32. The City?s treatment plant, outfall, sewage system and stormwater system are regulated by at least three permits issued by the Regional Board: (A) The Regional Board's November 9, 1995, Order No. 95?106 and NPDES Permit No. CA0107409 (collectively the Permit?) which establishes effluent standards and limitations for the City's discharge of treated effluent from the treatment plant to the waters of the United States. The NPDES Permit authorizes defendant to discharge fully treated effluent only at the outfall. CALIFORNIA 92101 Case (619) 238-4158 E-mail: rory?popanmnacmetnom Documentl Filed 03/29/01 Eageloie Page 16 of 106 defendant from discharging raw sewage from the sewage system into the waters of the state; (B) The Regional Board?s July 16, 1990, Order No. 90-42 (the Stormwater Permit") which also prohibits defendant from discharging raw sewage from the sewage system into the City?s stormwater systems and then into the waters of the State; and I (C) The Regional Board's May 9, 1996, Order No. 96~ 04 (the Sewage OverflOW Order?) which prohibits the City from discharging sewage from the sewage system at any point upstream of the treatment plant. 33. Since December 14, 1996, defendant has regularly discharged tens of millions of gallons of raw sewage from its sewage system directly into, and from its sewage system into the storm water system and from there into, the beaches, bays and coastal waters of San Diego Bay, Point Loma, Ocean Beach, Mission Bay, Pacific Beach, La Jolla and Torrey Pines. Defendant's failure to rebuild adequate systems has resulted from decades of neglect by defendant?s City Council. For example, defendant?s Metropolitan Wastewater Department recommends that in order to reduce the illegal discharges, defendant must repair, replace and rehabilitate 50 or more miles of sewer mains per year. This rate is double the approximate 25 miles of sewer mains which defendant currently funds for annual replacement under the Stipulated Final Order in United States of America V. City of San Diego, Southern District of California Case No. However, defendant has taken no action on this recommendation. 42. Defendant?s illegal discharges are also caused by defendant?s failure to maintain the systems. Defendant fails to maintain the systems from cracked mains and pipes, inadequate pumps, sewage overflows, line breaks, manhole failures, pump failures, power outages, blockages from debris, grease, roots and rocks, infiltration, contractors, vandalism and so forth. 43. Defendant's illegal discharges are also caused by defendant's failure to properly operate the systems. Defendant?s illegal discharges are also caused by systematic poor management. For example, defendant recently failed to respond to a telephone call reporting a sewage spill made to an emergency hotline, resulting in an illegal discharge of more than 1.5 million gallons of raw sewage. 45. Defendant?s illegal discharges are also caused by defendant?s failure to conduct studies, recommended for at least one and one?half (1 1/2) years by County DOEH, to determine the sources of the high bacteria levels at some of San Diego's beaches and bays. I. BACKGROUND A. Damage to San Diego San Diego is the sixth largest city in the United States. Tourism is San Diego's third largest industry, generating at least $3.1 billion in revenue, and employing hundreds of thousands in jobs related to lodging, dining, shopping and recreation. One of the primary attraction of tourists to San Diego is the natural environment of San Diego?s beaches and bays. This beautiful environment also provides a quality of life for San Diego?s residents which may be unsurpassed in the United States. It is because of this environment that the residents call San Diego ?America?s Finest City.? However, the government of the City of San Diego, through the intentional conduct and neglect of its City Council and Metropolitan Wastewater Department, has significantly damaged the environment of San Diego's beaches and bays, causing San Diego to obtain an international reputation as one of the world's most polluted cities. For example, in its July 2000 edition, Forbes magazine rated the beaches of Mission Bay and La Jolla among America's most polluted. The magazine wrote, ?If San Diego County has established itself as the California capital of sewage spills, then [Mission Bay] is its White House.? The same article also gave La Jolla Shores the ?dubious distinction as one of California?s most polluted.? This damage to San Diego?s environment, and the resulting damage to San Diego's reputation, has caused San Diego to lose hundreds of millions of dollars in tourist revenues and thousands of jobs. This damage has also significantly impacted the quality of life for San Diego's residents. B. History of Non?Compliance The City has a history of severe non-compliance with discharge limitations of the Clean Water Act and NPDES permits. In 1988, the United States sued the City in Federal Court for the City's violations of the Clean Water Act. There followed a long and contentious litigation and settlement process, involving significant resistance and obstruction from the City. In 1995, in part settlement, the United States enacted the Ocean Pollution 2 NOTICE OF INTENT TO FILE SUIT EXHIBIT 1, PAGE 2 27 Case 3:01-cv-00550-H-50R Documentl Filed 03/29/01 FagelDBO Page 30 of 106 Reduction Act granting the City's outfall a five (5) year waiver from the basic sewage treatment requirements of the Clean Water Act. In 1997, the parties filed a Stipulated Final Order for Injunctive Relief (?Final Order"), addressing the City's non-compliance and requiring certain steps, including the replacement of certain concrete sewer mains. Citizen Complainants understand the City has failed to comply with OPRA and the Final Order. In 2000, the City reactivated the litigation, suing the United States in Federal Court for relief for its outfall from OPRA and the basic sewage treatment requirements of the Clean water Act. In October 2000, the State of California, through the Regional Water Quality Control Board, San Diego Region (?Regional Board") fined the City $3.47 million for a 34 million gallon sewage spill which closed the beaches of Ocean Beach and Point Loma for one week the largest fine ever imposed in the State of California for a sewage spill. On October 17, 2000, the City, through a 6?1 vote of its City Council, voted to appeal the fine. Officials from the City?s Metro Wastewater Department claimed that the massive sewage spill ?was an unforeseen ?act of nature' that could not have been prevented." II. DISCHARGES OF RAW SEWAGE A. NPDES Permits As part of its sewage treatment system, the City owns and operates the Point Loma Wastewater Ocean Outfall (?outfall") and the Metropolitan Sewage Collection System (?collection system"). The outfall and collection system are subject to the following NPDES permits and orders: One, the California Regional Water Quality Control Board, San Diego Region (?Regional November 9, 1995, Order No. 95- 106 and NPDES Permit No. CA0107409 (collectively the Permit?) which establishes requirements for the City's discharge of treated effluent to the navigable waters of the United States only through the outfall; and prohibits the City from discharging raw sewage from the collection system into the waters of the state; Two, the Regional Board's July 16, 1990, Order No. 90-42 (the Stormwater Permit?) which prohibits the City from illegally discharging raw sewage from the collection system into stormwater conveyance systems and then into the waters of the state; and Three, the Regional Board's May 9, 1996, Order No. 96-04 (the Sewage Overflow Order") which prohibits the City from allowing overflows of raw sewage from the collection system into the waters of the state. Discharges of Pollutants Into Navigable Waters Information currently available to Citizen Complainants indicate that beginning on November 9, 1995, and continuing through the date of this notice, the City has operated the sewage collection system to discharge pollutants, consisting of raw sewage not treated to primary and secondary effluent limitations and standards, into the navigable waters of the United States, causing the closures and postings (higher bacterial levels than established by state standards) of numerous beaches and bays of San Diego (collectively the ?illegal discharges"), in violation of effluent standards, limitations and orders set forth in the NPDES Permit, NPDES Stormwater Permit and NPDES Sewage Overflow Order. A fifty?two (52) page summary of the City's illegal discharges is attached to this NOTICE OF INTENT TO SUE and is incorporated by reference as though set forth in full Based on the City's own reports, the City has discharged more than 37 million gallons of raw sewage, causing thousands of days of beach and bay closures in all of San Diego?s coastal communities, including San Diego Bay, Point Loma, Ocean Beach, Mission Bay, Pacific Beach, La Jolla and Torrey Pines. C. Causes of the City's Illegal Discharges The City's illegal discharges have been caused by the following intentional conduct and neglect of the City: One, the failure of the City, through its City Council, headed by Hon. Susan Golding, Mayor, to rebuild an antiquated inadequate collection system. Indeed, Hon. Byron Wear, City Councilman, admitted in The Peninsula Beacon that: ?We have neglected this problem in San Diego for the last 20 to 30 years;? Two, the failure of City, through its Metropolitan Wastewater Department (?Wastewater Department?), headed by F. David Schlesinger, Director, to maintain the existing collection system from sewage overflows; line breaks; manhole failures; pump failures; power outages; blockages from debris, grease, roots and rocks; infiltration; contractors; vandalism; and so forth; Three, the failure of the City, through its Wastewater Department, to monitor raw sewage flows through the collection system on a daily basis rather than a weekly basis; Four, the failure of the City, through its Wastewater Department, to use diversion and interceptor systems at various locations for dry weather controls. Although the City has concluded that low~flow diverters must be installed in forty?five (45) coastal storm drains in order to avoid beach closures it has retrofitted only seven (7) storm drains with the diversion devices; 4 NOTICE OF INTENT TO FILE SUIT 29 EXHIBIT 1, PAGE 4 Case Documentl Filed 03/29/01 PagelD.32 Page 32 of 106 Five, the failure of the City, through its Wastewater Department, to protect existing beneficial uses and qualities of receiving waters, and to improve beneficial uses and qualities of degraded receiving waters, by developing and implementing sufficient Best Management Practices to control and reduce pollutants in stormwater and urban runoff that is discharged to and from the municipal storm sewer system (?storm sewer system?) to the maximum extent practicable; Six, the failure of City, through its Wastewater Department, to develop performance criteria for measuring BMP effectiveness; Seven, the failure of the City, through its wastewater Department, of ensuring that entities discharging stormwater and urban runoff into the City's storm sewer system take steps to prevent, control and reduce discharges of pollutants into the City's storm sewer system and then into the navigable waters of the United States; Eight, the failure of the City, through its Wastewater Department, to develop and implement programs to detect and abate illicit connections and discharges to the City's storm sewer system; Nine, the failure of the City, through its Wastewater Department, to investigate the sources of raw sewage and other bacteria which consistently flow through the City's storm sewer system into beaches and bays; and Ten, the failure of the City, through its Wastewater Department, to monitor and report violations of the NPDES Permit, NPDES Stormwater Permit and NPDES Sewage Overflow Order. D. Pollutants Discharged The pollutants which the City discharges into the navigable waters of the United States include: raw sewage not treated to primary and secondary treatment requirements, pH, fecal coliform, fecal streptococcus, enterococcus, volatile organic carbon (VOC), surfactants (MBAS), grease, total suspended and settleable solids, total organic carbon, biochemical oxygen demand (BOD), chemical oxygen demand (COD), lead, copper, chromium, cadmium, silver, nickel, zinc, cyanides, phenols, nutrients nitrogen, nitrate, phosphate, etc.), biocides and other waste. E. a six (6) inch sewer main line at Curlew Street, Hillcrest, which transports raw sewage to a storm drain, and then to a storm drain outlet that discharges to San Diego Bay near Laurel Street and North Harbor Drive; an eighteen (18) inch sewer main line at Boston Avenue and 45th Street, which transports raw sewage to a concrete lined stormdrain at Division Street, and then to a storm drain outlet that discharges to San Diego Bay near 7th Street and Harbor Drive; a storm drain at 28th Street and Commercial Street, which transports raw sewage to a storm drain outlet that discharges to San Diego Bay near Switzer Street; a sewer main line at the 3300 block of Florida Drive, near Balboa Park, which transports raw sewage to a storm drain, then to a storm drain outlet near Switzer Street, and then to San Diego Bay near the 10th Avenue Marine Terminal; a sewer main line at Payne Street and Greely Avenue, which transports raw sewage into Chollas Creek, and then to San Diego Bay near 32nd Street; and an eight (8) inch sewer main line at Edgemont Street, South Park, which transports raw sewage to a storm drain channel that runs along that flows to Chollas Creek, and then to San Diego Bay near 32nd Street; Pgint Lomadchan Beach: the Alvarado Trunk sewer, a sewer main line at Alvarado Road and College Avenue, a storm drain at Murray Park Drive and Park Ridge Boulevard, and a storm drain at Canyon Crest Drive, all of which transport raw sewage to Alvarado Creek, then to the San Diego River, and then to the San Diego Rivermouth at the Dog Beach section of Ocean Beach; a sewer main line at Tea Party Lane and Voge Street, which transports raw sewage to a concrete storm channel along Murphy Canyon Road, then to the San Diego River, and then to the San Diego Rivermouth at the Dog Beach section of Ocean Beach; and the Point Loma Wastewater Treatment Plant, which transports raw sewage into the ocean waters impacting the receiving waters from the Tide Pool Viewing Area, Point Loma, to Point Loma Nazarene College, Sunset Cliffs; Mission Bay: A main sewer line at Genesee Avenue and Highway 52, which transports raw sewage through San Clemente Canyon into a tributory that flows two miles to Rose Creek, and then to northeastern Mission Bay; an eight (8) inch sewer main line at Bluffside Avenue, which transports raw sewage to a storm drain, then to Rose Creek, and then to northeastern Mission Bay; other main lines and storm drains tributory to Rose Creek which transport raw sewage to Mission Bay; main lines and storm drains tributory to Cudahy Creek which transport raw sewage to Mission Bay; main lines and storm drains tributory to Tecolote Creek which transport raw sewage to Mission Bay; and other storm drain outlets tributary to Mission Bay which transports raw sewage to Mission Bay; La Jolla: A sewer main line at Camino de la Costa and Avenida de la Costa, which transports raw sewage to a storm drain, and then to a storm drain outlet at Sun Gold Point; a sewer main line at Prospect Place and Ivanhoe Court, which transports raw sewage to a storm drain, and then to a storm drain outlet at Shell Beach; a sewer main line at Coast Boulevard, which transports raw sewage to a storm drain, and then to a storm drain outlet that discharges to La Jolla Cove; and a sewer main line at Coast Walk and Torrey Pines Road, which transports raw sewage to a storm drain, and then to a storm drain outlet at the La Jolla Caves; and Tgrrey Pines: A twenty?one (21) inch sewer main line at Carmel Valley Road and El Camino Real, Sorrento Valley, which transports raw sewage through the median on El Camino Real, to a storm drain near Soledad Creek, then to Penasquitos Lagoon and then to Torrey Pines State Beach; another sewer main line which transports raw sewage to Soledad Creek, then to Penasquitos Lagoon, and then to Torrey Pines State Beach; other storm drains which transports raw sewage to Soledad Creek, then to Penasquitos Lagoon, and then to Torrey Pines State Beach; another twenty-one (21) inch sewer main line which transports raw sewage to Penasquitos Lagoon and ultimately to Torrey Pines State Beach; a fifteen (15) inch sewer main line at Roselle Street, which transports raw sewage to a concrete storm channel that flows to Carroll Canyon Creek, then to Penasquitos Lagoon, and then to Torrey Pines State Beach; an eight (8) inch sewer main line at Black Mbuntain Road which transports raw sewage to a storm drain, then to Penasquitos Lagoon and then to Torrey Pines State Beach; and a pump station at the Torrey Pines Golf Course which transports raw sewage through a small bluff canyon to Blacks Beach. VIOLATIONS The City's illegal discharges of raw sewage, through point sources within the sewage collection system, into the navigable waters of the United States, violate the effluent standards, limitations and orders contained in the following NPDES permits and orders: One, the NPDES Permit, paragraphs A.5, A.6, A.8, A.12, A.13, A-l4. and Two, the NPDES Stormwater Permit, paragraphs through (10), VII, IX, and (C) and 7 NOTICE OF INTENT TO FILE SUIT EXHIBIT 1, PAGE 7 32 Case 3:01-cv-00550-H-l50R Documentl Filed 03/29/01 PagelD.35 Page 35 of 106 Three, the NPDES Sewage Overflow Order, paragraphs 8(5) and Four, effluent standards and limitations of the Clean Water Act, Sections 301(b)(1)(B) and 301(h)(9), 33 U.S.C. 1311(b) and 1311(h)(9); Five, regulations adopted under the Clean Water Act, including 40 CFR Part 122, section 122.2; 40 CFR Part 125, sections 125.60 through 125.68; 40 CFR Part 131, sections 131.6(d) and 131.12; and 40 CFR Part 133, sections and 133.100 to 133.105 Six, regulations adopted by the California State Water Resources Control Board (?State Board?) known as the Water Quality Control Plan for Ocean Waters of California (?California Ocean Plan?), Tables A, and Seven, antidegredation policies adopted by the State Board known as Statement of Policy with Respect to Maintaining High Quality of waters in California, Resolution No. 68?16 (?Antidegradation Policies"); and Eight, regulations adopted by the Regional Board known as the Comprehensive Water Quality Control Plan Report, San Diego Basin (9) (?Basin Plan?), including prohibitions against discharging of untreated sewage, prohibitions against discharging waste to waters of the state in a manner causing a condition of pollution, contamination or nuisance, identified beneficial uses of state ocean waters, additional water quality objectives for dissolved oxygen and pH, and Chapter 3, pp. 3?3 to 3-5. In addition to those violations, this notice covers all violations of the Clean Water Act evidenced by information which becomes available to Citizen Complainants after the date of this NOTICE OF INTENT TO SUE. The citations contained in the NOTICE OF INTENT TO SUE and Summary of Illegal Discharges more than satisfy the notice requirements of the Clean Water Act (33 U.S.C. 1365 and 40 CFR 135.3) as to the City's violations. REMEDIES Citizen Complainants' action will seek all remedies available under Sections 505(a)(d) of the Clean Water Act, 33 S.C. 1365(a)(d), including an injunction restraining the City's illegal discharges unless the City meets a compliance schedule to construct an adequate collection system and develop programs to ensure full compliance with all terms of the NPDES Permit, NPDES Stormwater Permit and NPDES Sewage Overflow Order; penalties of $25,000 for each day of illegal discharges at each closed and posted beach and bay; an order that all penalties be deposited into a Court blocked-account to be used only for the building of an adequate collection system; an order that the City restore and mitigate the affected environment; and such other relief as is permitted by law.
