The Interviews were conducted to document officers actions and observations prior to and after the officer Involved shooting of Robert Lyons (MIW During the course of the following Interviews all officers provided the same Information with regards to the barraclded subject Incident SSERT was handling. Officers were provided with Information that onons had threatened a fireman 'with a handgun. Officers were also notified that Lyons was an sW?il?. 'El'elieved'to'have iunknown military training and an unknown amount of weaponaanil alippllee. If SSEHT was looking to play cowboys and Indians SSEHT chose the wrong residence. SSERT I command officers made attempts to convince Lyons to exit the residence without Incident, Lyons refused. SSERT used "less than lethal" means to force Lyons out of his residence. SSERT fired several and cartridges into the residence that had no effect. learned Lyons previously obtained military type "gas masks" in anticipation of a confrontation with law enforcement. SSEFIT officers observed and then communicated, via radio, that Lyons was observed in possession of a handgun and a shotgun. On multiple ocasslons, Lyons stood in the front and rear doorways armed with a handgun or shotgun but did not point any weapon in the direction of the SSERT officers. In the momenta prior to the officer was preparing equipment to flood the Lyons' residence with water to tore-o Lyons end his wffe from the residence. The officer interviews took place in a first ?oor Interview room at the Homewood Police Department (HPD), present for the interviews were respective SSEHT lnv. Campbell and I. The following is a non-verbatim summary of each goflicere oral statement. approximately 2:15 AM, lnv. Campbell and Interviewed Officer ill-en Kovac Orland Park Police Department (OPPD). Officer Kovac has been a police officer for seventeen years and has been a member of SSERT for approximately 1.5 years. Officer Kovac was assigned to the "react" team and was stationed in the "Bear" (SSEFIT itti'm?tud personal carrier). Officer Kovac was sitting in the front-passenger's seat. The Bear was parked directly In front of the front door to the residence and used It's public address system (PA) to give commands to Lyons and his wife. The "reactll team. was in the process til '?i'altl?n?g?f?E'ffo'ht'E?fry way Iritd'the fesldence larger. Officers were using 'the 'ram on the Bear to tear away The Willi surrounding the front door to the widened: At one point the ram to the Bear was inside the residence when Officer Kovac observed a muzzle fash and heard a "pinging" noise. Officer Kovac loaned to I the side as he realized the Beer was taking fire tromJnside the-residence. The Bear retreated away from the residence and learned that one of the snipers in front of the residence had fired one round and possibly struck Lyons. Shortly after the shooting, Lyons' wife left the residence and was taken into custody by members of the assault team and was brought to the command area. The "react" team was directed to clear debris from the front of the residence. While clearing the debris officers lobserved'Lyens' lower body on the floor at the top of the front stairs. Officers were directed to fire "baton" less -than lethal rounds at Lyons. Officers fired three rounds and stuck Lyons twice, Lyons did not react to the Impact of therounds. Ultimately, an assault team entered the residence, secured Lyons and removed him from the residence. IOfficer Kovac did not fire his weapon during the Incident. lnv. Campbell and I interviewed Burbank Officer Thielen #35. Officer Thielen has been a police officer for eleven years and a member of SSEFI for approximately three years. Officer Thielen was assigned to the "react" team and alternated with another of?cer providing cover from the turret of the Bear. Officer Thielen provided the same account lot the Incident as Officer Kovac. Officer Thielen added he heard 3-5 shtos coming from the residence at the time of Lyons firing his weapon. Campbell and i Interviewed Lamont Officer Brian Kondrat #34. Officer Kondrat has been a police officer for approximately 5.5 years and has been a SSERT member for the past one year. Officer Kondrat was assigned to the "reset" team Inside the Bear. Officer Kondrat was sitting on the bench seat on the passenger's side rear of the Bear. Officer Kondrat stated he observed Lyons' lower body at the time he was firing the shots. Officer Kondrat observed the I Bear front passenger's window spider after the shots. The remainer of Officer Kondrat's statement was the same as ?the remainder of the "react" team. Officer Kondrat did not fire his weapon during the incident. linv. Cortland and i Interviewed Willow Springs Officer James Campbell #32. Officer Campbell has been a police officer for five years and has been a SSERT member for approximately four years. Officer Campbell was assigned to the "react" team and was seated two places behind the driver of the Bear. Officer Campbell provided the same accountof events as the remainder of the "react" team. Officer Campbell did not ?re his weapon during the incident. Inv. Cortland and interviewed New Lenox Officer Ed Marks #1 09. Officer Marks has been a police officer for twenty years and has been a member of SSEFIT for approximately the past 4.5 years. During this incident Officer Marks was assigned to the containment team. Officer Marks was poviding cover from across the street and southeast of 50 N. lCedar. Officer Marks did not fire his weapon. Officer Marks heard approxlamtely four shots coming from the target building. inv. Cortland and-l interviewed Lansing Officer Mike Lazowski #89. Officer Lazowski has been a police officer for 16 years and has been a member of SSEFIT for approximately 2 years. Officer Lazowski was assigned as the containment team leader. Officer Lazowski was also tasked with coordinating lethal cover for gas teams as they deloyed less than lethal rounds into the target residence. Officer Lazowski did not fire his weapon. Officer Lazowski heard spproxiamtely three shots from the and then heard a single round fired by what he believed to be a sniper rifle. inv. Cortland and i Interviewed Oak LaWn Fire Department (OLFD) Fire Figther (FF) Chris ward. FF Ward has been a fire fighter for the past fifteen years and a member of SSEHT for approximately 6 months. At the time of the shooting FF Ward was walking in the strreet with FF Kovac near the driveway of the target residence. FF Ward observd what he believed to be muzzle flashes coming from Inside the target residence. FF Ward did not fire a weapon. After Lyoine was secured by the entry team. FF Ward check Lyons for a pulse and found a weapon in Lyons' back pocket, a pistol magazine on Lyons' belt. a knife in his left pants pocket, a shotgun shell In his right front pants pocket and a "through land through" gun shot wound in his side. inv Cortland and I interviewed East Hazelcrest Of?cer Roder Novak #49. Officer Kovac did at firs his weapon. Officer Kovac was assigned to the assault team positioned to the south of the target location. Officer Kovac heard what he believed to be shotgun shots and he also observed muzzle flashes from Inside the residence. lnv. cortland and i interviewed Bridgeview Officer Louis Dominguez #10. Officer Dominguez has been a police officer for approximately 21 years and has been a member of SSERT for approximately 1.5 years. Officer Dominguez was assigned to the assault team. Officer Dominguez did not fire his weapon and provided the same information as Officer Kovac. inv. campbell and I interviewed Flossmore Sgt. Brian Tencza. Sgt. Tencza has been a police officer for 18 years and has been a member of SSERT for approximately 9 years. Sgt. Tencza was assigned as the team leader of the assault team. The assault team was positioned to the south of the target residence. Sgt. Tencza heard the shot from the sniper rifle. Sgt. Tencza directed the female from the residence after the shooting and walked her to the warming tent. Sgt. Tencza entered the residnece with members of the assault team and took Lyons into custody. Sgt. Tencza recovered a handgun from Lyons. A string was tied from the trigger of the recovered weapon to Lyons' belt. The firearm was ?xed to fire when the weapon was removed from Lyons' pocket. The assault team handcuffed Lyons and removed him from the residence onto the front lawn. Millon has been a police officer for 20 years and has been a member of SSERT approximately 9 years. Sgt. Millon was assigned as the assistant assault team learder. Sgt. Millon provided the same information as Sgt. Tenczs. Sgt. Millon did not fire his weapon. inv Campbell and I interviewed Midlothlan Officer Joe Croak #45. Officer Croak has been a police of?cer for 7 years and a member of SSERT for approximately 4 year . Officer Croak was inside the Bear located in front of the residence. Officer Croak heard multiple gun shots and observed muzzJe ?ashes from inside the residence. Of?cer Croak did not fire his weapon. lnv. Campbell and I interviewed OLFD FF Dan Rooney. FF Rooney was assigned in the Bear located directly In front of the target residence. FF Rooney proivded the same information as Officer Croak. FF Rooney did not ?re his weapon. Inv. Campbell and i interviewed Tlnley Park Police Officer Keith Sullivan #20. Officer Sullivan has been a police officer for 13 years and a member of SSERT for 3 years. Of?cer Sullivan was assigned as the sniper team leader. Officer Sullivan was oposltioned across the street and to the south of the target residence. Officer Sullivan observed Lyons with a hand gun in his right hand. but did not see Lyons point the gun at anyone. Officer Padron explained that he has been a Police Officer in Blue Island Illinois for approximately '3770 Watts ands member of the South Suburban Emergency Response Team (SSERT) for 'approxlmately five (5) years. Officer Padron explained that his assignment on SSEFIT is an operator during routine calls such as search warrants and a sniper during Level 1caIIs. Officer Padron advised on February 24, 2011, SSERT was activated by the Glenwood Police Department (CPD) for a Barricaded subject In Glenwood, llIInoIs.? Officer Padron advised that a Barricaded situation Ia considered a Level 1 response and he was assigned as a snlper for the call. Officer Padron explained SSERT had a briefing about the call and at that time, he was Informed Ithat the Barricaded subject, Robert P. Lyons may have been prior military, however Officer Padron did not know Lyonsff assignment in the military. Officer Padron explained that SSERT responded to the scene sometime during the 2:00 pm. hour. Officer Padron stated he and another officer, Orland Park Police Officer D. were the first two snipers to respond and they decided between themselves where they planned to set up. I IOfficer Padron stated that he remained In position as negotiators and the command post relayed information to the teams. Officer Padron explained at one point, the command post informed officers that a female subject, Rose M. Lyons hereinafter referred to as Rose, was inside the house with Lyons. Officer Padron explained that the command post advised Officer Padron explained that the #Hearcatii, armored yohiole} was deployed and used to Ibreach the front door of the residence in an attempt to see inside the home. Officer Padron stated that #00# and #Tear Gas# was deployed inside the home, however Lyons and Rose did not exit the house. Officer Padron explained he heard through radio communication that Lyons and Rose were gas masks and that they were unaffected by the #Tear East and Officer Padron I :adyised that after the #Tear Geoff and did not work a plan was being formulated to use water ,in an attempt to get Lyons and Rose to exit the house. Officer'P'adron advised after the secbnd shot, he felt debris fall on him that he thought may have been shot gun rounds rlcochetlng off of the #Bearcat#. Officer Padron explained he put his Into the scope of his sniper rifle and focused on the top right opening of where the front door had been breached. Officer Padron stated he heard radio traffic explaining that shots had been fired and saw the #Bearcat# backing up. Officer Padron advised that as the #Bearcat# backed up, the headlights of the #Bearcat# Illuminated the Inside of the home. Officer Padron stated he heard a third and fourth shot that he knew to be coming from inside the house because he saw the muzzle flash from the barrel of a long gun. Officer Padron stated he tracked the barrel of the long gun to where he believed the person shooting would be standing. Officer Padron stated that due to the shadows cast from [the headlights of the #Bearcat#, it was difficult to see the full figure of the person holding the long gun, but he easily saw the muzzle flashes from the end of the long gun when he heard the third and fourth shot. Officer Padron stated as he tracked back from the barrel to the partial view of a person, ?he squeezed the trigger of his sniper rifle and fired one (1) round. Howard conducted thirteen Interviews Of members of the South Suburban Emergency Response Team (SSERT) officers. The Interviews were conducted to document officers actlons and Observations prior to and after the officer Involved shooting Of Robert Lyons During the course of the following Interviews all officers provided the same Inforrnatlon with regards to the barricaded subject Incident SSERT was handling. Officers were provided with Information that Lyons had threatened a fireman with a handgun. Officers were also noti?ed that Lyons was an anti-government, anti-police survivallst. belleved to have unknown military and an unknown amount of weapons and supplies. Initially It was belleved that Lyons .was possibly holding his wife as a hostage. this was proven not to be true, as Lyona' wife was observed walking freely In the residence and had at one point taunted Of?cers providing containment to the rear of the residence. Lyons' wife refused to exit the residence and advised officers In summary. if SSEFIT was looking to play cowboys and Indians SSEFIT chose the wrong residence. SSEFIT commend officers made attempts to convince Lyons to exit the residence without Incident, Lyons refused. SSEFIT used "less than Iethai' means to force Lyons out of his residence. SSEFIT fired several and ?00" cartridges into the residence that had no effect. SSERT learned Lyons previously obtained military type "gas masks" In anticipation of a confrontation with law enforcement. SSEFIT officers observed and then communicated. via radio, that Lyons was In possession of a handgun and a shotgun. On multiple occasions Lyons stood in the front and rear doorways armed with a handgun or shotgun but did not point any weapon in the direction of the SSERT officers. In the moments prior to the officer involved shooting, SSEFIT was preparing equipment to ?ood the Lyons' residence with water to force Lyons and his wife from the residence. The interviews took place In the basement lunch room at the Homewood Police Department (HPD). the initial five (5) interviews I conducted were with Insp. Medrys and the following eight (8) interviews were conducted with COSAI J. Howard. The following are summaries of the Interviews, however they are not verbatim. At approximately 1:50 AM, Insp. Medrys and I Interviewed Sergeant Richard Shore #39 of the Burbank Police Department. Sergeant Shore has been a member of the SSEFIT for approximately two (2) years. Sergeant Shore was assigned to the "react" team and was stationed In the "Bearcat" (SSEFIT armored personnel carrier). Sergeant Shore was the driver of the "Bearcat". Thrpughout the incident the "Bearcat" was parked directly In front of the front door to the residence and Sergeant Shore used it's public address system (PA) to give commands to Lyons and his wife. Sergeant Shore advised the "react" team In the "Bearca utilized a long "boom ram" attached to the front of the vehicle to breach the front entrance of the residence. At one point, the ram to the "Bearcat" was Inside the residence when Sergeant Shore observed a "flash" and heard a loud noise hit the windshield of the "Bearcat". Sergeant Shore advised that he saw a second "flash" from inside the home and another subsequent loud noise striking the windshield. Sergeant Shore stated he realized that they were being fired upon from Inside the house and Sergeant Shore began backing the ?Bearcat" up. Sergeant Shore advised that as he backed up. he saw a third shot and as the front headlight illuminated the Inside of the home' Sergeant Shore observed a shotgun lying on the ground and feet on the ground as If someone was lying down. Sergeant Shore explained he could not see the entire body because the body was behind oblects at the top of the stairs. Sergeant Shore explained he learned that another member of SSERT had fired their weapon and knew that Lyons must have been shot. Shortly after the shooting. Sergeant Shore advised that Lyons' wife exited the residence and was taken Into custody by members of the assault team and was brought to the command area. Sergeant Shore advised he did not fire his weapon during the incident. At approximately 2:20 AM, Insp. Medrys and I interviewed Park Forest Police Officer Dave Habecker. Officer Habecker is a member of the SSEFIT. Officer Habecker was assigned to the "react? team and was seated In the "Bearcat" during the incident. Officer Habecker provided the same account of the incident as Sergeant Shore. however Officer Habecker was seated In the rear of the "Bearcat" and only heard the shots and did not see the ?flashes". Officer Habecker stated after hearing the shots. he did see the "spldering" of the windshield and he knew that the vehicle had been hit. Officer Habecker did not fire his weapon during the incident. At approximately 2:34 AM. insp. Medrys and I Interviewed South Holland Detective Shawn Staples #139. Detective Staples has been a SSEFIT member for the past eight (.3) years. Detective Staples is a supervisor on SSEFIT and was assigned to the "react" team inside the "Bearcat". Detective Staples was seated behind the front seat passenger in the "Bearcat". Detective Staples advised his team was breaching the front entrance of the residence when he heard a shot come from inside the house. Detective Staples stated as the "Bearcat" began backing up. Detective Staples heard two more gun blasts and saw two muzzle ?ashes come from inside the house. Detective Staples stated he saw the windshield "spider". Detective Staples stated he did not hear the Officer's shot but later knew tan Officer fired because the ended and radio transmissions were being made advising what had happened. Detective Staples stated they remained In the "Bearcat" until a team was sent In to retrieve Lyons from in the house. Detective Staples did not fire his weapon during the incident. At approximately 2:47 AM. lnsp. Medrys and I interviewed Country Club Hills Officer Antonio Nieto #63. Officer Nieto has been a member of SSEFIT for approximately two (2) years. Officer Nieto was assigned as "containment" and was positioned next to the sniper. (shooting Of?cer T. Padron). Officer Nieto explained he watched the front of the residence from across the street. Officer Nieto explained the "Bearcat" was sent to breach the front entrance and upon breaching the entrance. Officer Nieto heard three shots followed by a pause and then a fourth shot come from in the house. Officer Nieto explained he then heard the very distinguishable sound of Officer Padron's sniper rifle go off. Officer Nieto sated he was unable to see fully Inside the residence during the shooting from his vantage point. Officer Nieto remained focused on the "Bearcat" during the incident. Officer Nieto explained he stayed on scene while an extrication team was sent in to remove Lyons from the residence. Officer Nieto did not fire his weapon during the incident. At approximately 3:00 AM. inap. Medrys and i interviewed Sauk Village Sergeant Ohris Mleszczak #53. Sergeant Mieszczak has been a member of SSERT for approximately eight (3) years and is a team leader assigned to the entry team. Sergeant Mleszczak was one of the members assigned to deploy "Tear Gas? and Into the residence during the incident. Sergeant Mieezczak was positioned behind an armored vehicle that was parked south of the residence. Sergeant Mieszczak remained outside the armored vehicle as another armored vehicle ("Bearcat") approached the residence to breach the front opening. Sergeant Mieszczak stated as the "Bearcat" approached. Sergeant Mleszczak heard four shots and saw smoke coming out of the front breached entrance.Sergeant Mleszczak stated he also saw debris fly from the windshield of the "Bearcat". Sergeant Mleszczalt then heard the sound of a loud rifle that he knew had to be one of the snipers. Sergeant Mieszczak stated after the shots. he was then assigned as a cover team for the team that eventually went Inside to extricate Lyons. Sergeant Mieszczak also stated that prior to Lyons extrication. the wife of Lyons exited the house wearing a gas mask. Sergeant Mleszczak stated as he provided cover for the extrication team. he observed a shotgun lying on the ground in the house and when Lyons was brought out on the front lawn. Sergeant Mieszczak observed a small handgun tied to a ropelcord in Lyons' pocket. Sergeant Mieszczak did not fire his weapon during the Incident. At approximately 3:13 AM. OOSAI Howard and I interviewed Willow Springs Officer Pat Leone. Officer Leone has been a member of for approximately four years and was assigned as entry/assault team during this incident. Of?cer Leone was positioned behind a SSERT armored vehicle that was parked just south of the target residence. Officer Leone stated as the "Bearcat" drove toward the front of the residence and was widening the front entrance. he heard three simultaneous shots followed by a fourth come from inside the house. Officer Leone stated he saw muzzle flashes and debris come from in the house and also saw debris ricochet from the "Bearcat" window. Officer Leone sated he then heard what he knew to be 'a sniper rifle fire a round. Officer Leone remained in position throughout the incident. Officer Leone stated that Lyons' wife eventually exited the house wearing a gas mask on top of her head and when she walked toward his team. Officer Leone heard Lyons' wife state. "He was shooting pellets from a shotgun then he fell, not sure If he was bleeding because he smokes". Officer Griffin advised throughout the incident he observed the "Bearcat" conduct maneuvers and "Tear Gas" and deployed. Officer Griffin stated as the "Bearcat" was approaching the front area of the residence to widen an already breached front entrance. he sniper. OfficerGriffin stated the "Bearcat" began to back up after the shots started and Officer Griffin maintained his ?containment" assignment for the duration after the shooting. Officer Griffin did not fire his weapon during the incident. At approximately 3:34 AM. CCSAI Hoard and I interviewed Oak Forest Fire Fighter Don Knor. Fire Fighter Knor advised he has been a member of SSEFIT for approximately eight (3) years and was assigned as the teams Medic during this incident. Fire Fighter Knor advised he was at the scene throughout the incident and was preparing water lines to deploy water into the residence In an attempt to force Lyons and his wife out of the house. Fire Fighter Knor stated he was positioned approximately 50 yards north of 50 Cedar behind an armored vehicle. Fire Fighter Knor stated he heard radio traffic informing the "Bearcat" to widen th already breached front entrance of the residence. Fire Fighter Knor stated he observed the "Bearcat" drive toward the front entrance with the long boom attached when Fire Fighter Knor heard approximately five (5) shots. Fire Fighter Knor stated the last shot was that of a .303 round and knew it had to be a sniper round. Fire Fighter Knor stated he never actually saw the shots only heard them from where he was positioned. Fire Fighter Knor stated he was one of the Medics that assisted with rolling Lyons over after Lyons was removed from the home. Fire Fighter Knor stated he observed an entry wound to Lyons' chest/rib cage area. Fire Fighter Knor advised Lyons was already deceased when he rolled Lyons over. Fire Fighter Knor also advised he was the medic assigned to assess the snipers vital signs after the shooting. Fire Fighter Knor did not fire a weapon during the incident. At approximately 3:43 AM, CCSAI Howard and interviewed Hazel Crest Police Officer Adam Grant. Officer Grant has been a member of the SSERT for approximately three (3) years and was assigned as an "assauft" team member for this incident. Officer Grant was positioned behind the armored vehicle parked just south of the residence. Officer Grant stated he observed the "Bearcat" approach the front entrance in an attempt to widen the already breached front entrance when he heard a shot come from the front door area. Officer Grant advised he saw several more shot exit the front entrance and debris splash off the front windshield of the "Bearcat". Of?cer Grant believed he heard between three (3) to five (5) shots. Officer Grant stated he maintained position as the ?Bearcat? backed up when fired upon and his team staged south of the residence. Officer Grant advised after the shots some 'the incident. At approximately 3:51 AM. Howard and i interviewed Oak Lawn Firefighter Todd Stanford. Firefighter Stanford has been a member of SSERT for approximately six (6) months and was assigned to the "water team" during this incident. Fire?ghter Stanford was positioned on the south side of the residence with the Glenwood Fire Department. Firefighter Stanford stated he was on scene as the "Beareat" was approaching the residence to widen the already breached front entrance. Firefighter Stanford stated he heard approximately four (4) shots but did not see the shooting. Firefighter Stanford stated following the shooting, he was assigned to check vital signs of the "react" team and "assault" team. Harris- Short, #514. Campbell. #405 and Howard. #403. conducted a neighborhood canvass regarding an Officer Involved shooting Incident that occurred In the vicinity of 50 N. Cedar Lane. Glenwood, Illinois. The following is a summary of the results of the canvass: -- Uncooperatlve and refused to provide Identifiers. (Conducted By Harris-Short Howard) - Was at work. Marilyn (spouse), was home all day and did not some outside or see anything. Stated his neighbor (40 Cedar Lane) was evacuated and asked to immediately leave. (Conducted By Harris-Short Howard) M- Saw offender shaking his ?st at the firemen but ccu not hear any conversation. (Conducted By Harris-Short Campbell) No Answer. Stated he was home with his wife, Beveny Grif?n and observed firemen delivering Illuminated address signs to the neighbors. Stated he was standing outside when the victim's son Robert Jr. came and told him that his mother had called and said his dad was drinking heavily and told her to get in the bathtub. Stated Robert Jr. appeared to be upset and attempted to call his mother back. but the phone went dead. Stated Robert told him his dad had several weapons Inside of the home. Stated he called 911 and requested Of?cer assistance. and then called Glenwood Police Chief Cook. Stated Robert spoke with Chief Cook and another Gienwood Detective and informed them that his father. who was antl-govemment and had military experience. would always answer the door of his home carrying a handgun. Stated he took Robert Jr. to the police command post and returned home around 9:45pm. Stated he heard SSERT continuously order subject to come out of his home with his hands up. but subject refused. Stated a short time later he heard loud noises and four loud pops and called his neighbor Joe who told him that the noises he heard was muzzle ?ashes. Observed swat arrlve In a bearcat and at some point shootout windows of the house with what he thought was tear gas. Observed the swat bearcat attempt to break down the front door of subject?s home with a ram. Heard some gun?re and saw the swat and bearcat back out of the house and ?ll It with water. A short time later observed a robot try to make entry but got stuck. Bearcat widened the door's and swat made entry. Saw police exit but did not see them with the offender. Illinois. neighborhood. The ?reman rang the doorbell of the aforementioned address and encountered the suspect who brandished a weapon. The ?reman abruptly retreated and contacted the Glenwood Police vehicle multiple times. A sniper assigned to S.S.E.R.T. was positioned across the street from the residence. The sniper ?red a single shot which struck suspect Suspect #1 subsequently succumbed to his injuries. Suspect #2 was taken into custody. The following information includes opinions of the crime scene investigator based on observations, training, and experience. The scene was examined, photographed, and processed for physical evidence by C81 Watson. During the examination and processing of the scene, the following observations were made: Snow was actively precipitating and covered the area '11 a thin layer. The residence was a two story, single family home. The front of the residence faced east. The residence had a backyard encircled by a fence. A large S.S.E.R.T. assault vehicle was positioned on the front lawn, with the ?oat of the vehicle facing the direction of the residence. The aforementioned vehicle had previously deployed its battering ram which created a large opening in the front of the residence. The glass panes of all of the windows had been shattered. S.S.E.R.T. reportedly ?red tear gas into the residence prior to the extrication of the suspects. The sniper ri?e was positioned on the ground behind a gated enclosure at the residence of 47 Cedar Lane which was directly across the street from the suspects' residence Watson photographed the position of the sniper ri?e. The ri?e was subsequently removed from its position to preserve its integrity. A single casing was observed on the ground in close proximity to the ri?e. An itnition holder was also in close proximity. Suspect #1 was positioned on the ground of the northem portion of the front lawn. He was deceased and covered with a white sheet. CSI Watson removed the sheet and observed the suspect lying in the supine position with his arms bound behind his back with ?ex cu?'s. The suspect was bare feet and-his shirt was _?me?i?m?gm m. The suspect?s clothing description was the following: black jeans with a black belt (both front pockets were also cut open), a red t-shirt, and dark blue collared shirt. A wound consistent with a single, gun shot was observed on the let! side of the suspect?s abdominal region. At approximately 5:16 Buds Ambulance Service arrived and positioned suspect #1 inside a post?mortem bag. CSI Watson signed and sealed the pcst-mcrtem bag with evidence tape. Bud?s Ambulance Service transported suspect #1 to the Cook County Medical Examiners of?ce. The living room was in the northeast portion of the residence. The living room was cluttered and unkempt. A recliner and boxes were blocking the pathway to the living room. 081 Watson removed a box and observed a shotgun shell holder with numerous live rounds. A loaded hand gun was lying on the seat of a recliner which was positioned against the west wall. The hand gun was unloaded and made safe. The south end of the aforementioned passageway led to the southern portion of the residence. The area of the ?oor leading to the associated bedrooms was littered with numerous hand gun magazines loaded with live ammunition. A gas mask was observed on the ground against the east wall in close proximity to the aforementioned magazines. A doorway on the west wall gave access to the bathroom. A loaded revolver was observed on the tiled ?oor of the bathroom in the northeast comer. CSI Watson unloaded the gun and made it safe. The following Officers were interviewed: Sergeant Brian Bush #2 - Hazel Crest Police Department - 10 years Of service - a years of service with SSERT. Patrolman Greg Perovich #134 - Burbank Police Department - 7 years at BPD - 12 years Of service with SSEFIT. They all heard the subsequent radio traffic by members of the SSEHT notifying command of the shots. All command officers heard Officer Padron advise that he fired his weapon and that he (Officer Padron) was unsure if he had hit the subject who had been firing weapon. The Command officers conducted role call after the shooting to check the status of all officers out on scene and no one had been infured. The Command officers advised that Robert Lyons was eventually removed from the residence approXImately 45 minutes after the shots. The Command officers further explained that during the 45 minutes prior to removing Lyons from the house, Lyons' wife, nose Lyons exited the house wearing a gas mask. The purpose of the interview was to determine what information Holstein and Frias could provide reference the officer-Involved shooting which occurred as a result of 'a call of an armed, barricaded subject. Holstein and Frias provided the following Information. in summary: Holstein and Frias both received a text message for the South Suburban Emergency Response Team (SSERT) activation because it Involved a barricaded subject. That barricaded subject was identi?ed as ROBERT LYONS. MM, DOB: om 1I1 S43. Being hostage negotiators, Holstein and Frias are not called out to every SSERT activation. Hostage negotiators Quinn and lwaszlto were also activated. but Holstein and Frias handled the primary negotiations. Holstein and Frias conducted the negotiations from the back of the SSERT command vehicle. Holstein ended up handling almost all of the negotiations because Intelligence gathered during the incident Indicated LYONS responded better to young females. LYONS made several threatening statements against the police while speaking with Holstein. LYONS indicated he was prepared and that he would take several officers with him if he were to be killed. Holstein was still In the command vehicle after LYONS stopped talking to her, and she heard SSERT command officers say LYONS apparently fired several shots at the Bearcat PA, and that wife exited the house. Fries was outside of that command vehicle at' that time on a restroom break. Fries was walking back to the command vehicle when he heard a rapid succession of gunshots. Fries knew they were gunshots because they had a different sound from Capsicum (00) and Captor Spray (08) gas canisters being fired. Frlas said when cc and cs canisters are tired, they sound like roman candies going off. Fries also said the last shot in the succession of gunshots was louder than the rest, and looking back he believed that last louder shot was the SSERT officer's rifle being fired. Fries also had no line of sight of house when he heard the gunshots. The interview was terminated at that point. At approximately 11:15 A.M., Inspector Medrys #9717 and I, Special Agent (SM) Mlnniear #4638 interviewed hostage negotiators Quinn and Maszko at the Lynwood Police Department located at 21480 Lincoln Highway, Lynwood, Illinois.- The purpose of the Interview was to determine what Information Quinn and lwaszko could provide reference the officer-Involved shooting which occurred as a result of a call of an armed, barricaded subject. Quinn and Iwaszko provided the following information, in summary: Quinn and lwaszko both received a text message for the South Suburban Emergency Response Team (SSERT) activation because It involved a barricaded subject. That barricaded sublect was Identified as ROBERT LYONS, Willi, DOB: 0411 1/1943. Being hostage negotiators, Quinn and Iwaszko are not called out to every SSERT activation. Hostage negotiators Holstein and Frlas were also activated and handled the actual negotiations. Quinn and lwaszko were assigned to stay with family to help keep them calm and Informed, and also to gather intelligence information from family. family said he was very pissed off at the government, and was very anti-government at all levels. family said they knew drinking and anti-government attitude would get him killed one :day, and perhaps this was that day. Quinn, Iwaszko, and family could hear the Olsoresln Capsicum (00) and captor Spray (OS) gas rounds being shot, and a lot of the talk by SSERT officers discussing the Incident. At ?rst, Quinn, Iwaszko, and family were in a SSERT van parked behind the SSERT command vehicle. But when a Burbank Police Department command vehicle arrived at the scene, Quinn, Iwaszko, and family transferred from the SSERT van to the Burbank command vehicle. The Burbank command vehicle was then driven around the corner approximately one and a half blocks away. From that location, Quinn and Iwaszko did not hear any of the gunshots. A GPD Officer met with the CFO Fireman and learned that the Fire Department was going door to door delivering illuminated address signs to put on resident's homes. 'The GPD learned that a Fireman went to the home of Robert P. Lyonsl DOB: D4I11I1943) at 50 North Cedar, in Glenwood, Illinois and attempted to deliver an illuminated address sign to Lyons. The Fireman advised Lyons displayed .3 hand gun In the direction of the Fireman and the Fireman left the area and the Police were subsequently called. Upon the arrival of the CPD to 50 North Cedar. they were met at the front area of the residence by Lyons and the Officer retreated to his squad car and called to activate the South Suburban Emergency Response Team (SSERT) for a possible barricaded subject. SSERT members responded to 50 North Cedar and set up a perimeter around the residence. SSERT learned that Lyons' wife was also Inside the residence. SSERT negotiators began contacting Lyons and attempts were made to have Lyons an E?oeacefully exit the residence. After negotiations went unanswered. SSERT deployed less than lethal means. CS Gas and Oieoresln Capsicum (DC). in an attempt to force Lyons anc- from the home. Upon deploying the gas. SSERT saw through windows that Lyons and Rose Lyons had protected themselves from the gas by wearing gas masks. Throughout the stand off, SSERT members would periodically observe Lyons walk in the doorways and near windows holding a shotgun and a handgun. SSEHT Command Staff ordered the front door of the residence be breached using an armored vehicle. A fully armored vehicle, utilizing a long "boom" attached to the front and. drove up to the residence and pushed in the front door making the inside of the home visible to SSERT members surrounding the residence. An order was given for the armored - door area of the residence, Robert Lyons opened fire on the armored vehicle with a shotgun ?ring at least three rounds, causing damage to the front windshield of the. armored vehicle's bullet proof glass. As Lyons ?red rounds at the armored vehicle. which contained SSEFIT members. SSEFIT Sniper Officer Padron, who was positioned approximately 50 yards across the street at 47 North Cedarl fired one round from his sniper rifle into 50 North Cedar where Lyons was standing at the top of the stairs. After Officer Padron ?red his weapon, no further shots were heard or seen from Lyons at 50 North Cedar. Officer Padron Informed via hand held radio that he fired his weapon. Officer Padron was unsure at that time if Lyons had been hit by the round he (Padron) had fired. Lyons was placed in flex cuffs and removed from the home. SSEFIT members placed Lyons on the front lawn and the paramedics who were already on scene. were summoned to attend to Lyons. As paramedics responded, SSEHT members searched Lyons. and found what appeared to be a "booby trapped" firearm In the front pocket of Lyons. SSERT members explained that a Beretta Model 95038. .25 caliber semi-automatic pistol loaded with eight (3) live rounds was upside down In the front pocket and found to have a cord tied to the trigger and the other end of the cord was tied to Lyons belt. members explained that the ?rearm was "rigged" in a way that if the firearm had been removed from the pocket forcefully. the cord would pull on the trigger causing the ?rearm to discharge upward toward the Officer pulling the firearm from the pocket. A SSEFIT member observed the llbooby trap"l cut the cord and subsequently removed the firearm later transferring It to the Illinois State Police Public integrity Task Force (PITF). Upon the arrival of the ISP PITF. they met with SSERT Command Officers and were apprised of the Incident. PITF interviewed SSERT members and were informed of eyewitness accounts of the entire incident Including the Officer Involved Shooting (OIS). All members of SSERT provided similar accounts of the incident from their vantage point and no one gave con?icting stories that would have contradicted what Officer Padron had witnessed prior to the shooting. The above mentioned summary of events were compiled using the interviews PITF conducted of SSEHT members. The Crime Scene Services responded to 50 North Cedar and processed the entire crime scene. collecting evidence including Officer Padron's sniper rifle. The Crime Scene investigator (CSI) collected several firearms that were located where Lyons body had been discovered. in addition to various pieces of evidence. the CSI collected the following firearms In the residence: Remington Arms Wingmaster Model 870 Shotgun, with eight (3) live shotgun shells. Colt Model Combat Commander .45 caliber semi-automatic pistoll loaded with seven (7) live rounds. Dan Wesson, .357 six (6) live rounds. Armb- ?151'- All ?rearm evidence was later submitted to the ISP Jollet Crime Lab for testing. At the conclusion of lab testing. all evidence Was turned over to the GPO. The Interview was conducted to document his actions and observations prior to and after the of?cer involved shooting of Robert Lyons (MAN, DOB: 04/1 1143). Cmdr. Winfrey advised he has been a Police Officer for 18 years, 13 of which have been with the Park Forest PD. Cmdr. Winfrey advised he has been a member of the South Suburban Emergency Response Team (SSEFIT) for the past 7 years. Cmdr. Winfrey stated on February 24, 2011. he responded to Glenwood.
