Basically, we want to understand how we should make sure that the 1332 waiver request does not negatively affect the 1331 waiver request?s federal funding. That would naturally occur, due to the reduction in premiums that would occur if a reinsurance pool were created (Minnesota?s waiver would look much like the Alaska 1332 request that was filed). I think it needs to be super clear that either the program or the appropriation is contingent on federal approval. Otherwise you risk not getting a pass?through. I think the contingency here is a little fuzzy. 2. To be clear, the BHP funding *will* go down. However, the pass?through will go up an extra amount to account for that. So you?ll get a pass?through equal to the amount the BHP funding went down plus the amount any APTC went down. Presumably, you could just transfer the appropriate amount of funds over to BHP (but would presumably need to include that in your legislation). 3. I?d suggest including the board having some flexibility in the payment parameters in order to deal with any last?minute issues in the waiver application process. I?ve suggested some language. I?m ccing my colleague for her thoughts too. Please tell me what language we should include in our waiver requests to ensure our rate reduction (due to reinsurance) will not impact our funding for our basic health plan. We are closing the bill at '10 am Wednesday 29 MAR 17 and would appreciate clarity. I have included the language we are considering. The waiver section is Article 1 Sec 8. Page 9. The especially concerning aspect is line 14-23. Please let me know as soon as possible. Minnesota is the second state to move on reinsurance and we want to do this well.
