1. On 10/16/2017 I, Trooper Sceviour #4035, was on uniformed patrol in fully marked State Police cruiser #1177. At approximately 1935 hours I was dispatched to Interstate 190 South, just south of Exit 2, for a crash in Worcester. Interstate 190 is a public way. Upon arrival I observed a single vehicle involved that had collided with the right shoulder concrete guard rail. This is a construction zone that the breakdown lane is now used as a travel lane. 2. I observed a 2000 Toyota Corolla, bearing MA PAN 5FS323, stationary blocking the ?rst travel lane. The vehicle had heavy front end damage from colliding with the right shoulder guard rail. I approached the vehicle and identi?ed the operator by her MA OLN #883i98174 as BIBAUD, Alli 6/1 987. BIBAUD had already exited the driver's seat prior to my arrival. BIBAUD stated that she was the driver of the vehicle and the sole passenger identi?ed BIBAUD as the operator. BIBAUD appeared lethargic and groggy as I spoke to her. Her eyes were nearly completely closed. I asked her to open her eyes and observed them to be both blood shot and glassy. An immensely strong odor of an alcoholic beverage emanated from her person. A'query of her criminal history revealed an open case for possession of class A heroin. I asked BIBAUD if she had used heroin today. She stated that she had done heroin at approximately nine am on this date. BIBAUD had fresh track marks on both of her inner elbows. BIBAUD swayed from side to side and spoke with a slur. BIBAUD initially claimed that she swerved to avoid something that had ran in front of her car. The crash occurred on a bridge. I returned to my marked cruiser and deactivated the forward facing emergency lights. The sole passenger ofthe vehicle, Mclean, John, was directed to stand by against the guardrail out of the way. 3. I led BIBAUD to a flat area ofpavement behind her vehicle and in front of my marked cruiser to perform ?eld sobriety tests. This area of pavement was free from any major cracks or debris. Court: Worcester DC 3, English is her 4. Horizontal Gaze Nystagmus: I gave BIBAUD the directions for this test and she stated that she understood them and did not have any questions. I again observed her eyes to be extremely bloodshot and glassy. I observed both pupils to be constricted; consistent with the use of narcotic analgesics I observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and nystagmus onset prior to 45 degrees in both eyes. I again noticed a strong odor of an alcoholic beverage being emitted from her person. 5. Walk and Turn: I gave BIBAUD the directions for this test and she stated that she understood them and did not have any questions. BIBAUD failed to count any of her steps even after being reminded to. BIBAUD failed to connect her heel to her toe on any ofthe steps and swayed dramatically. BIBAUD stepped off the line multiple times and sidestiped to maintain her balance. BIBAUD never stopped walking and took approximately twenty steps out without turning. I eventually told her to stop walking. I deemed this test to be a failure. UD the directions for this test and she stated that she understood them and UD counted to three on repeat. She wouldn?t count past three even after e. BIBAUD immediately raised her arms away from her sides and put her foot down after less than two seconds. She was given the opportunity to lift her foot up and try again. BIBAUD swayed, raised her arms, and put her foot down again. BIBAUD then began hysterically crying and screaming that she was, "sick" and, "a heroin addict". I deemed this test to be a failure. 6. One Leg Stand: I gave BIBA did not have any questions. BIBA being reminded to continue on twic she had consumed this evening. She stated that she had, "two nips". BIBAUD was taken into custody, hand cuffs double locked, without incident. Female Trooper and Drug Recognition Expert Rei then arrived on scene in Cruiser 951. Tpr. Rei performed the search incident to arrest of BIBAUD. BIBAUD was then placed into the rear of my cruiser. returned to the involved vehicle to perform an inventory ofthe vehicle prior to it being towed. I located a yellow handbag that was actually a, "heroin kit". Inside I located approximately one dozen hypodermic needles, a metal spoon, and corner cut plastic baggies. All of these are consistent with intravenous heroin usage. 7. I asked BIBAUD how much alcohol uiser to transport BIBAUD to the Holden State Police Barracks for booking. Upon an alcoholic beverage that was not present prior to her arrival. hile they removed the vehicle from the scene. During transport 8. I returned to my or entering my cruiser I observed an odor of Tpr. Rei stood by for Cranston's Towing BIBAUD hysterically screamed and cried and stated BIBAUD was brought into the booking area of SP Holden. BIBAUD Mi .- . - - Supervrsor 4 A . BIBAUD signed both of these and the ?fteen minute observation period began at 2025 hours. BIBAUD did not eat, drink, belch, or vomit during this period. BIBAUD agreed to take the breathalyzer and signed the form indicating so. BIBAUD provided two valid breath samples of 0.224 and 0.222 respectively; with a calibration check of st?erfomance of the breath test BIBAUD made multiple inappropriate comment I. 3 BIBAUD was advised of the failure and issued her notice of suspension d. I was unable to take BIBAUD's ?ngerprints as she was making lewd comments throughout booking. BIBAUD Court: Worcester DC in hand. BIBAUD's physical MAlicense was seize in and out of consciousness, trying not to vomit, an would eventually fall asleep on the bench during booking. 9. BIBAUD agreed to take part in testing for narcotics with Drug Recognition Expert Tpr. Rei. BIBAUD admitted to using hero'n on is date and stated that she had ac uired the heroin this morning for her and her boyfriend. She stated . BIBAUD was upset that Mclean had tried to use all of their heroin supply, while they were driving, instead of splitting it. Tpr. Rei will be completing a supplemental narrative at a later date. An immediate threat will be ?led with the RMV against BIBAUD. BIBAUD is charged with the following offenses on Massachusets Uniform Citations and R8437788: Operating Under the In?uence ofNarcotics Operating Under the influence of Liquor 90/24-1, Negligent Operation ofa Motor Vehicle Marked Lanes Violation 89/4vA, and Failure to InSpect Inspected 05/21/2016.
