This was never constructed as other agencies were going to require mitigation that cost far in excess of passing the legislated - benefit! cost test. . . . 3. ITID's litigation regarding the West C-51 project and ITID's exclusion that resulted in the settlement via ou_r "Memorandum of Agreement" (MOA) C- - 8973 with . 4. The lingering North Palm Beach Plan. Please recall we initiated this action back in 1995 and believed a constructed solution was possible by 2001. 5. ITID has developed a system to conditionally discharge waters through - The \/illage of Royal Palm Beach such that minimal water level rises occur at 40"' Street North, no water level increases occur at Okeechobee Boulevard, and minimal water level decreases occur at Southem Boulevard when ITID discharges south to the C-51 Canal. - 16. ITID has monitored groundwater levels in adjacent wetlands with no negative impacts being cited based on lower control elevations in the wet . season. 17. ITID has operated its surface water management system to benefit the - - water resources of the area. `Specilically in times of excessive water to L-8 we have cooperated with to route water south directly to C-51 where it is indirectly routed anyway. ln times of drought we are 7 1 . ITID's defined Level of Service for its southeastem 3 square miles. - This is because it is the lowest area bein pumped for -further distance. The discharge from this area would not change from existing operations junless a 10` year 3 day storm or larger occurred. When ITID operators find the system - is in duress then these southeast 3 square miles (plus Rustic Lakes) would . be hydraulically separated from the rest- of the M-1 basin and be allowed to discharge south through the Wlla of Royal Palm Beach (bypass flow) at the - rate of 100 CFS. Please note the design flow of one Amil gate at C-51 is 720 CFS and there are two gates, one of which is not used but operable risers are in place. The M-1 Canal and these risers at the Amil gate can easily handle this 100 CFS. . Also please note ITID already has sluice gates at Mango Boulevard and the Canal and at 122"" Drive N. and the Canal. ITID also has discharge capability at its Street - Structure so no physical improvements are needed, only operational changes. ITID is not . requesting a change in its permitted water surface control elevations. ITID is requesting a discharge of 100 CFS through to C-51. S-155 A has a capacity of 1500 CFS and STA 1-E can be operated for the design stonn and larger. ITID is not currently requesting more discharge through to the L-8 Basin as The Palm Beach Aggregates pumping out facility is minimal. i It is my tinn belief that the current allowable discharge rate of 274 CFS (about W/day) is a failure to sewe the public. Our operations people ITID) have been successful in reducing flooding impacts and our future MOA discharges andlor The North Palm Beach County Plan will at least bring ITID `up to a tolerable LOS. This request is consistent with the . North Palm Beach County Plan as the study results demonstrate it is impracticable to pump water from the lowest area of the M-1 Basin without excessive and unjustifiable expenditures. As discussed in our meeting we are not proposing any increases to our . discharges to the L-8 Basin. Please provide_ evidence of acceptance from Royal Palm Beach and possibly the City of West Palm Beach, dependent on the use of M-canal and catchment area, for the proposed improvements. - Again we are within the confines of our existing permit. Royal Palm Beach was fully aware of and participated inthe review of the existing . permit. .lTlD has operable ates at our M-1 canal into the C-51 canal adjacent to the automatic Amil Gate. The Village of Royal Palm Beach . will not see a difference in their canal levels as ITID balances the flow - into the upper end of our M-1 canal through the Village with the outfall from our operable gates at C-51 and our M-1 canal. I Since we are not discharging into the L-8 or the Canal, West Palm Beach is not affected. 5. Rule 4E-41 F.A.C. indicates a 0 discharge to the C-51 basin. Whatauthority exists which would allow the proposed discharge. . lt appears that a 100 pumping unit on_CanaI A, _and a subdivision ofthe . -- .lower basin, would be a `much better solution to achieving the LOS in the lowers parts ofthe Lower M-1 basin that the one requested. We disagree. Please read our existing pennit and MOA you will see we - - could already make a valid argument that "normal" operations allows - much more than is currently requested. Please note if we did pump we . - - would probably use a larger -pump station as this is the lowest area of . . the District (ITID). We also disagree that pumping uphill is a "better" . solution. The only justification -for the current system is to benefit the water resources of the area as proposed in the North Palm Beach County Plan - CERP. The current system fails to serve the remenent Everglades, all lands in the L-8 Basin, and especially ITID. Tony asked during our meeting of August 27, 2007 to include the current justification in the North Palm Beach County Plan -- CERP for in this response. Again please note we are not proposing to increase discharges to L-8 so the attached are for infonnational purposes and is very limited in content. Please refer to: . 1.
