Upon arrival the victim, Emmett Reid, was located and found to have suffered a single gunshot wound to his lower abdomen. Reid's vehicle was found to be parked nearby. Reid was transported by Leon County EMS to the Tallahassee Memorial Hospital's trauma unit. I arrived there at 9:35 PM and made contact with Officer J. Rodgers. Officer Rodgers advised that he was the first to arrive on scene. He stated that he found Reid lying on the steps of apartment 706. Officer Rodgers told me that he briefly spoke with the residents of that apartment. They advised that they did not know Reid. He had knocked on their door and asked them to take him to the hospital. When the residents told Reid that they were calling 911, he attempted to walk away, but collapsed. Officer Rodgers also stated Reid had identified his own vehicle in the parking lot, provided the suspect's description, and the suspect's last known direction of travel. Officer Rodgers said that Reid's initial account of the incident, as well as his reasons for being at that location, were inconsistent. Officer C. Fallis was also present in the trauma unit as well. He had collected and packaged Reid's clothing and cellular telephone after these items had been removed by the emergency personnel providing treatment. Officer Fallis advised that Reid was not wearing a shirt when he arrived in the trauma unit. Officer Fallis would maintain custody of these items until Forensic Technician (F/T) C. Wilder arrived to collect them. I entered the trauma unit as Reid was being prepared for surgery. I observed that Reid had suffered an obvious gunshot entry wound to his lower left abdomen. I observed a dark colored abrasion ring around the entry wound, as well as what appeared to be black colored soot surrounding the wound site and extending upwards. This indicated the possibility that the firearm had been in contact range to the his body when fired. I was advised by medical personnel that there was also an apparent bullet exit wound on Reid's left flank. I would later contact the operating room and learn that no projectile or projectile fragments had been recovered during surgery. Based on what I had been advised, I suspected that the shooting had occurred during a narcotics transaction. Because of that, I believed that Reid may have known the identity of the subject that had shot him. I also believed that it was likely that he had communicated with that subject via cellular telephone prior to the transaction. I was able to briefly speak with Reid as he was being treated. Reid advised that he did not know who had shot him. He told me that he had been seated in the driver seat of his vehicle. The suspect had been seated in the front passenger seat when at the time of the shooting. He denied those requests. I attempted to explain to Reid that I was concerned with identifying the suspect that shot him, not with investigating his narcotics dealings. It was apparent that Reid was apprehensive about providing information that may implicate him in narcotics activity. It became obvious that Reid was in severe pain and the interview was terminated. While at TMH I spoke with Reid's sister, Helena A. Reid, and his mother, Mara Shows. They told me that Reid did not live at the apartment complex where he had been shot (his actual address being 512 McKeithen Street, apartment 4). At approximately 11:00 PM, I arrived at the scene of the shooting and was briefed by Investigator S. Bennett and F/T Wilder. Investigator Bennett advised that patrol officers had established a perimeter around the crime scene and began searching for witnesses. She stated that no witnesses were located. Investigator Bennett advised that a police canine had attempted a scent track in a northern direction from the scene, but that the area had been too contaminated by vehicle and pedestrian traffic. I was also made aware that the same police canine had been utilized to conduct an examination of the exterior of Reid's vehicle. The canine's handler, Officer B. Givens advised that the canine alerted to the odor of narcotics emanating from the vehicle (As noted below, the narcotics that were believed to have been in that vehicle where located elsewhere on scene. As a result, no attempt was made to search the vehicle based on the canine alert. Due to the seriousness of the offense, a Search Warrant would have been obtained if needed). F/T Wilder had been advised that Reid had not given consent for the vehicle's interior to be processed. She advised that she had processed the exterior of the vehicle due to the likelihood of evidence degradation during transport to secure storage. I observed Reid's vehicle, a 2006 burgundy colored Ford four door sedan bearing Florida registration 593TWF. The vehicle was backed into a parking space between apartments 2102 and 2103, and was facing south. The doors were closed and the front windows were partially down. I observed a spilled Circle K Styrofoam fountain drink cup on the asphalt near the front passenger door. This cup was later collected by F/T Wilder. Investigator Bennett directed me to the location where a plastic Ziploc bag containing cannabis had been located. That bag had been found lying on the eastern side of the drive across from apartment 906. The cannabis was collected and impounded by Officer J. Rudd. The Ziploc bag was collected by F/T Wilder. Investigator Bennett next directed me to the front porch of apartment 706. Reid had been found at that location by the first responding officer. His shirt, which he had used as a compress, had been found near the eastern edge of the steps leading up to that apartment. I spoke with the resident of apartment 706, Keanua Duhart. Duhart told me that she answered her door to find Reid standing on her porch shirtless. He was holding a bloody shirt against his abdomen. When she told Reid that she would call 911 for him, he attempted to walk away but collapsed. Duhart stood by with Reid as her aunt called 911. Duhart told me that she had never seen the victim or his vehicle before. She also advised that she had not heard the sound of gunfire prior to Reid knocking on her door. On the morning of April 4 Reid, still at the Tallahassee Memorial Hospital, contacted me by telephone. He stated that he had not been completely forthcoming out of fear of implicating himself in narcotics activity. Reid admitted to me that he had been engaged in a narcotics transaction, and that he had been selling cannabis to a subject that he knew only by the nickname "Real". He confirmed that he had been seated in his car when he was shot by this subject. At 3:00 PM that same date, I interviewed Reid at the Tallahassee Memorial Hospital. Reid advised that he met the subject he knew as "Real" approximately one week prior at the Zewditu Mart, 3101 West Tennessee Street. Reid stated that he had been at that location in the early A.M. hours. Reid and the subject struck up a conversation, and at one point the subject asked him for cannabis. Reid told me that he allowed the subject to follow him back to his McKeithen Street residence where he sold him one gram of cannabis. Reid and the subject exchanged cellular telephone numbers during that transaction. Reid said that the subject had several females in the vehicle with him when he arrived at the McKeithen Street residence. Reid also advised that his roommate, Jeremiah Johnson, had been present when the subject arrived. He believed that Johnson may have obtained a cellular telephone number from one of these females. Reid told me that the subject had been driving a charcoal gray colored Nissan Altima at the time. Reid stated that on or about Wednesday April 1, he and the subject conducted a second narcotics transaction. The subject had contacted him by cellular telephone and requested to purchase a larger amount of cannabis. Reid agreed to sell him one ounce of cannabis for approximately $250. They agreed to meet in the area of Westminster Gardens Retirement Home, 301 East Carolina Street. That location was near Reid's place of employment. Reid said that the subject arrived in the same charcoal gray colored Nissan Altima. An unknown black male was with the subject. The subject told Reid that the male was his cousin. Reid told me that on the afternoon of April 3, the subject again contacted him by cellular telephone and requested to purchase a considerably larger amount of cannabis. Reid said that the subject asked for a quarter pound of cannabis. Reid did not have access to such an amount, but agreed to sell the subject two ounces of cannabis in exchange for $440. Reid said that at approximately 4:00 PM, the subject arrived at his residence unannounced. While in the living room of the residence, the subject asked Reid if he had the two ounces of cannabis. Reid asked the subject if he had the payment with him. The subject stated that he did not. As this conversation was occurring, Reid's friend, Edwin Carrillos entered the living room. The subject then departed. Throughout the rest of the afternoon Reid and the subject communicated via cellular telephone regarding the pending cannabis transaction. Reid explained that he had to report for work at 9:00 PM that night, so it was his intent that he and the subject should meet before that time. Reid said that once the subject had informed him that he had payment for the cannabis, they agreed to meet. He advised that the subject directed him to Savannah Crossing Apartments, 2738 West Tharpe Street, and told him to "turn left by the mail box and park". Reid stated that he arrived at the meet location and backed his vehicle into a parking space. He then observed the subject approach on foot from behind the vehicle (based on the positioning of the vehicle, the suspect would have approached from around the western corner of the 2100 building). Reid stated that the subject entered the front passenger seat of the vehicle and immediately produced a handgun. Reid described that handgun as a small framed semi-automatic, bronze in color, with engraving of an unknown type on the slide assembly. Reid stated that the subject pointed this handgun at him and said "Sorry bro, this is how it's got to be. I'm going to need that." Realizing that the subject was referring to the cannabis, Reid told him that it was in the black colored backpack lying against the center console. Reid advised that he had placed a single Ziploc bag containing two ounces of cannabis in a pocket of the backpack. The subject took possession of that backpack and then began attempting to remove Reid's wallet from the right side of his shorts. Reid advised that the subject appeared to be having difficulty removing the wallet, so he assisted in removing it. Reid stated that the subject then used his left arm to reach behind, and around his shoulders. Wrapping his forearm around the back of Reid's neck, the subject pulled him close. Reid said that the subject then pressed the barrel of the handgun into his lower abdomen and fired it once. Reid exited the vehicle and ran to cover. He took shelter behind a trailered boat that was parked to the east of his vehicle. Realizing that he had been shot in his lower abdomen, he used his shirt as a compress to stop the flow of blood. He searched his person in an attempt to locate his cellular telephone so that he could call for help. He did not locate it and remained in place, hiding behind the boat. Moments later, Reid looked from behind the boat and saw that both the driver door and the front passenger door of his vehicle were open and the subject was no longer present. He approached his vehicle and located his cellular telephone. He observed that the backpack containing the cannabis was no longer in the vehicle. Reid told me that he then began frantically searching the vehicle for his car/house keys and wallet. He did not locate those items. Reid stated that as he walked away from his vehicle, he observed a gray colored Nissan Altima travelling north at a high rate of speed on the western most drive. That drive leads to the complex's rear exit onto Pecan Road. Reid stated that he panicked and did not call 911 because he feared being arrested for involvement in cannabis sales. He attempted to call friends to come and pick him up, but soon realized that he needed immediate care. He went to apartment 706 for help, at which point the occupants called 911. Reid's mother had cancelled the accounts and no unauthorized activity or usage attempts were detected. When asked about the subject's movements inside the car, Reid told me that he witnessed the subject touch the outside door handle upon entering the car and the center console. As noted the subject touched Reid's shirt and shorts during the encounter. When asked about the soda cup that had been found on the asphalt beside the car, Reid stated that the cup had belonged to him, and that he had discarded it as he was searching for his car/house keys. In regards to the Ziploc bag of cannabis found in the parking lot; Reid stated that he had placed that bag of cannabis in an outside pocket on the backpack. He said that he had left that pocket unzipped. It was suspected that the cannabis may have fallen from the backpack as the subject fled from the scene. It was not known if the subject had manipulated the bag of cannabis prior to that occurring. Reid gave written consent for his vehicle to be processed by the forensics unit. Reid also gave written consent for the forensic analysis of his cellular telephone (850-320-1510). He stated that the subject's cellular telephone number would be saved in his contact logs under the nickname "Real". The forensic analysis of Reid's cellular telephone was completed on the evening April 4 by Investigator M. Dilmore of the Technical Operations Unit. The call logs on that cellular telephone demonstrated that a contact for the name "Real" had been created on April 1, 2015. The telephone number linked to that contact was 850-322-8256. That cellular telephone number, 850-322-8256, shall be referred to as the "target cellular telephone" throughout the remainder of this report. Call logs and text messaging content were examined. These call logs and text messaging content corroborated Reid's account of his relationship with the subject, and the fact that they were planning to meet for a cannabis transaction on April 3. On the evening of April 4, a Court Order was obtained directing cellular service provider Sprint PCS to provide subscriber information, call detail records spanning March 4, 2015 to April 4, 2015, as well as other data for the target cellular telephone. At approximately 10:00 PM that evening, information made available via that Court Order made it possible to determine that the target cellular telephone was no longer being utilized in the Tallahassee region. That information indicated that the target cellular telephone was being utilized in south Florida. On April 5 the target cellular telephone was being utilized in the immediate area of 2913 Zora Neale Drive in Fort Pierce, Florida. That address was found to be the home of Letitia Yvette Moore (BF, 06/30/65). The target cellular telephone would remain at, and/or frequent that location over the next several days. Law enforcement data bases indicated that in 1986 Letitia Moore had been associated with an address on North Lipona Road in Tallahassee. Law enforcement databases also indicated that two subjects, Ricardo Miguel Toussaint and Marlon Geranious Moore, were also associated with the Zora Neale Drive residence in Fort Pierce. Birth certificates for both Ricardo Toussaint and Marlon Moore were located within the Florida Department of Motor Vehicles database. Those birth certificates demonstrated that Letitia Moore was the mother of both Ricardo Toussaint and Marlon Moore. Law enforcement databases indicated that Ricardo Toussaint had residency at two separate Tallahassee addresses since 2011. Marlon Moore was found to have had residency at six separate Tallahassee addresses since 2002. His Florida driver license listed his current address as 1223 Athens Court in Leon County. Tallahassee Police Department records indicated that in June of 2014 Moore was a suspect in a shooting incident and the theft of a firearm that occurred at 475 Appleyard Drive (case number 14-015909). Moore was also found to have an active arrest warrant stemming from a failure to appear for a possession of cannabis arrest that occurred in Tallahassee in January of 2014. Subscriber records for the target cellular telephone indicated that the pre-paid account was established on September 22, 2014 by Chaunsay Edge (BF, 02/22/95) of 2144 Castor Court apartment 1 in Tallahassee. Department records and other law enforcement databases indicated that Edge was a resident at 475 Appleyard Drive at the time of the previously mentioned 2014 investigation into a shooting incident and the grand theft of a firearm. In addition, call detail records demonstrated that Edge's cellular telephone number (240-606-3822) had numerous contacts with the target cellular telephone. An analysis of the call detail records from the target cellular telephone demonstrated that it communicated frequently with telephone numbers belonging to Letitia Moore (772-577-1122) and Ricardo Toussaint (209-276-8110). The target cellular telephone communicated most frequently with cellular telephone number 209-276-8110. Department records linked that telephone number to Chantal Tolbert (BF, 06/26/89) of 202 Columbia Drive apartment 4 in Tallahassee. Tolbert was identified as being Moore's girlfriend during the previously mentioned 2014 investigation into a shooting incident and the grand theft of a firearm. Based on the totality of the above information, it was suspected that the subject known to Reid as Reporting Officer Investigator NICK ROBERTS 791 (93980) Department Tallahassee Police Department Secondary Officer Name Verifying Officer Sergeant VINCENT BOCCIO 275 Report Status: Approved Date/Time (93319) Department Tallahassee Police Department Date / Time 04/27/2015 07:41 8 of 14 Tallahassee Police Department Date of Report 04/22/2015 21:41 Case # 00-15-009978 Incident Report "Real" was Marlon Moore, and that he was utilizing the target cellular telephone. In addition, Sergeant C. Corbitt of the Technical Operations Unit analyzed historical cellular tower site data that had been obtained pursuant to the Court Order. This information demonstrated that on April 3, the target cellular telephone was utilizing cellular towers consistent with the location where the shooting occurred. On April 7th, Investigator C. Hale and I met with Reid at the Tallahassee memorial Hospital for the purpose of showing him a photographic line up display. The display contained one black and white photograph of Marlon Moore, taken at the time of booking for an arrest that occurred on January 8th, 2014. The display also contained black and white booking photographs of five other subjects. Those subject's photographs were automatically selected by Leon County JIS software. The selection was based on similar demographics and physical characteristics to those of Moore. Reid was told that the subject's photograph may not be in the display, and was given no indication of which photograph or individual to choose. Reid, without hesitation, positively identified the photograph of Marlon Moore as the subject that shot him on April 3. Moore stated that just looking at Moore's photograph "got my heart rate up". Reid was presented with an Affidavit of Image Identification, which he signed under oath. That Affidavit and the photographic line up display were impounded as evidence. On April 8, Reid's vehicle, which had been secured at Lake Jackson Towing, was processed by F/T C. Wilder. During the processing, a spent .25 caliber cartridge casing was found on the floor between the driver seat and the door. The head stamp printed on that casing read ".25 auto R P" (Remington Peters Mfg.). A plastic bag containing approximately 0.7 grams of cannabis was located in the pocket on the rear of the driver seat. Reid's backpack, wallet, and car/house keys were not located. On April 9, 2015 I interviewed Reid's roommate, Jeremiah Johnson (BM, 09/22/92). As previously noted, Johnson had been present at the McKeithen Street residence during the first meeting between Reid and Moore. Johnson told me that he remembered the night that Reid had allowed Moore to follow him home to conduct a cannabis sale. He stated that it was his only meeting with Moore. Johnson said that he remembered the incident because he had felt that it had been dangerous for Reid to bring an unknown subject back to the residence to conduct a cannabis sale. He recalled that Moore had arrived driving a vehicle with several female passengers. He initiated a conversation with one of the females that identified herself only as "Kiwi". He advised that "Kiwi's" cellular telephone number was 678-749-8660. That cellular telephone number was later linked to Alvinecia D. Dyson (BF, 09/23/92), of 806 Springsax Road in Tallahassee. On April 10, 2015 she reported that cellular telephone as being damaged by a male subject during an altercation (case number 15-010775). Call detail records demonstrated that the target cellular telephone had numerous contacts with Dyson's cellular telephone. Johnson was presented with a photographic line up display. The display contained one black and white photograph of Marlon Moore, taken at the time of booking for an arrest that occurred on January 8th, 2014. The display also contained black and white booking photographs of five other subjects. Those subject's photographs were automatically selected by Leon County JIS software. The selection was based on similar demographics and physical characteristics to those of Moore. I informed Johnson that the subject's photograph may not be in the display, and gave no indication of which photograph or individual to choose. Johnson quickly pointed to the photograph of Marlon Moore and stated "that's him right there". Johnson was asked to specify who the subject was, and where he recognized him from. Johnson stated that the photograph was the subject known as "Real" that had met with Reid at the residence. Johnson was presented with an Affidavit of Image Identification, which he signed under oath. That Affidavit and the photographic line up display were impounded as evidence. On April 10 Assistant State Attorney L. Bueno approved a probable cause affidavit for the offenses of Attempted Homicide and Robbery with a Firearm. On that same date, Leon County Judge R. Wheeler authorized warrants for the arrest of Marlon Moore for those same offenses. Also on April 10, Investigators became aware that Moore had likely returned to the Tallahassee area. See Supplemental Narrative For Further Information End of Narrative: 1 N A R R A T I V E Topic 2 SUPPLEMENTAL REPORT =========================== VICTIM: Reid, Emmett =========================== On April 14, at approximately 7:51 AM, members of the United States Marshal's Service Florida Regional Fugitive Task Force searched for Marlon Moore at Planter's Crossing Apartments, 1447 Stone Road. He was located in apartment E-39. That apartment is the home of Candice Smart (BF, 12/10/88). The previously mentioned call detail records had demonstrated that Smart's cellular telephone (850-524-4334) had frequent contacts with the target cellular telephone. Heath initially made contact with Smart at the front door of the apartment. She advised that Moore was inside her bedroom. Verbal commands were given, and Moore was observed to exit from that bedroom. He was taken into custody without incident. Investigator Heath then obtained Smart's verbal and written consent to search that bedroom. During that search the target cellular telephone was located in the pockets of a pair of men's athletic shorts. Cannabis, suspected synthetic MDMA, and unknown pills were also located in those same shorts. Investigator Heath also located a handgun beneath the bed mattress. That handgun was a bronze/silver colored .25 caliber Taurus model PT25 semi-automatic pistol, serial number DYC42730. The handgun was found with a cartridge chambered, and additional cartridges in the magazine. The firearm was listed in NCIC as having been reported stolen to the Leon County Sheriff's Office in 2007 (LCSO case number 07-265158). Smart provided a sworn written statement, denying ownership of the handgun. The firearm was later transferred to the custody of F/T C. Wilder for forensic processing. Moore was transported to the Criminal Investigations Division. I initiated an interview with him at approximately 9:07 AM. That interview was audio/video recorded. Moore was advised of his Fifth Amendment rights, which he waived. He was presented with, and signed a Statement of Rights form. Moore confirmed that he had just recently returned from south Florida. He stated that while there he was shot by an unknown subject. He showed me a bandaged wound in the area the left side of his groin, and indicated that there was an exit wound on his left buttocks. Moore stated that the incident occurred in Brevard County. He told me that he had been in the hospital for three days, and then had been arrested and transported to the Brevard County jail for an outstanding Leon County warrant. Moore told me that the warrant stemmed from an arrest for a small amount of cannabis that occurred at 475 Appleyard Drive in Tallahassee. Moore confirmed that his mother lived on Zora Neale Drive in Fort Pierce. He stated that he had been living in Tallahassee for the past several years, but was currently between residences. He explained that he was staying with various friends and associates. He stated that he had spent the previous few nights at Candice Smart's apartment. Moore was asked for his cellular telephone number. He initially claimed that he did not own a cellular telephone and provided me with Smart's telephone number (850-524-4334) with which to contact him. Moore was confronted with the fact that a cellular telephone had been recovered with his belongings at the time of his arrest. He then admitted to ownership of that cellular telephone, but could not provide the telephone number when asked. He claimed that he had just purchased the telephone several days prior. Moore was confronted with the robbery charge. He admitted that he used cannabis and purchased it regularly. He denied being involved in any such incident during a narcotics transaction. He told me that he did purchase cannabis from an associate prior to departing for south Florida, but stated that subject was a black male. He told me that he departed on either Thursday April 4 or Friday April 6. He stated that he travelled to his mother's residence to celebrate Easter, and then travelled to Orlando on April 7 to attend a baby shower for a female that was pregnant with his child. He would later state that he returned to Tallahassee on either April 10 or 11. I explained to Moore that a firearm had been discharged during the robbery, and that he had been identified as the suspect. He denied any involvement with the incident. I confronted Moore with the fact that a firearm of the same caliber had been recovered from the apartment where he was arrested. I asked him if he had any knowledge of that firearm. Moore replied "No, I don't know nothing about it. Like I said, I had got shot and then I got that when I got back." To clarify, I asked Moore "Got what when you got back?" to which he replied "That gun". Seeking further clarification I asked "You got that gun when you got back?" He answered "Yeah". I then made the statement "So, you were aware of the gun." At that point it seemed as if Moore had just become aware of his admission. He then recanted his previous statements regarding his possession of the firearm. I discussed the fact that the target cellular telephone had been recovered at the time of his arrest. I confronted him with the fact that he had been untruthful regarding that device's telephone number. He was confronted with call detail records that demonstrated that he was in contact with Reid. Moore denied this and maintained that he had purchased the target cellular telephone after returning to Tallahassee from south Florida. When asked, he stated that he purchased the telephone from a female that lived on Tower Road. He claimed that he did not know her name. Moore continued to deny any knowledge of the shooting incident and denied being in an apartment complex on West Tharpe Street on April 3. The interview was terminated and Moore was transported to the Leon County Jail by the Prisoner Transport Unit. Investigator J. Megna made contact with the Palm Bay Police Department and learned that on April 6 Moore had been admitted to the Palm Bay Community Hospital as the result of a gunshot wound (PBPD case number 1-15-003175). Moore told officers that he was shot during a narcotics transaction, but would not provide any information regarding the suspect or the location where the incident occurred. He was released from the hospital on April 7, at which time he was arrested for an outstanding misdemeanor narcotics warrant issued in Leon County. He was transported to the Broward County Jail where it was determined that the warrant was non-extraditable. As a result, he was released from custody. On April 15, Leon County Judge N. Richardson-Ashenafi authorized a Search Warrant for the target cellular telephone. A forensic analysis of that device was conducted by Technical Operations Unit Investigator M. Dilmore. The results of that analysis are pending and will be documented in a supplemental report. That interview was audio recorded. As previously noted, Carrillos had been identified as being present in Reid's McKeithen Street residence on the afternoon of April 3 when Moore had arrived unannounced. Carrillos confirmed that he was present when Moore arrived. He told me that he had never met Moore before that date. He recalled that Moore had arrived to discuss a cannabis transaction with Reid. Carrillos said that Reid removed the cannabis from a backpack and showed it Moore. Moore displayed an amount of currency, but told Reid that he did not have the full purchase price. Carrillos recalled that Reid then told Moore to contact him when he had the full amount so that the transaction could be made. Moore then left the residence. Carrillos told me that the encounter made him feel "uneasy". He explained that he felt it was suspicious that Moore would arrive to conduct the transaction without having the agreed upon amount of currency with him. Carrillos was presented with a photographic line up display. The display contained one black and white photograph of Marlon Moore, taken at the time of booking for his January 8, 2014 arrest. That Affidavit and the photographic line up display were impounded as evidence. Also on April 16 I interviewed Chaunsay Edge (BF, 02/02/95) at her residence. As previously noted, Edge was the subscriber of record for the target cellular telephone. When presented with the subscriber information for the target cellular telephone, Edge confirmed that she had opened the account in 2014. She told me that she use the target cellular telephone until January or February of 2015 when she received a new cellular telephone for her birthday. Edge stated that she then gave the target cellular telephone to Moore. Edge stated that she last saw Moore on the morning of April 4. She advised that he came to her residence and told her that he was going to his family's residence in south Florida. She stated that she had no knowledge of the shooting. On April 17 Candice Smart contacted me by telephone. Attempts had been made to interview her, however due to her work schedule we had been unable to meet. She told me that she had not been aware that the handgun was in her bedroom, but stated that it belonged to Moore. Smart said that she had seen the handgun in his possession on a previous occasion. An in-person interview was scheduled for a later date. On April 24 Candice Smart was interviewed at the Tallahassee Police Department. That interview was audio/video recorded. Smart confirmed that she resided at 1447 Stone Road apartment E-39, and that she was present on the morning of April 14 when Moore was arrested. Smart said that when Investigators arrived, she and Moore had been in bed asleep. She heard the knock and her door and left the bedroom to answer it. Smart said that Moore had remained in the bed. She told me that after Moore had been taken into custody, she gave her consent for Investigators to search her bedroom. She had become aware that they had located a firearm beneath her mattress. Smart stated that she had seen Moore with a handgun approximately one year prior and described that weapon. I showed her a color photograph of the firearm recovered beneath her mattress. Smart stated that it was the same handgun. Smart also told me that Moore often went by the nickname "Real". She confirmed that his cellular telephone number was that of the target cellular telephone. She advised that she had been using that telephone number to contact Moore for several months, and that it was the only telephone number that he utilized. Smart stated that she has dated Moore several times over the past three years. Prior to Easter, they began dating again. On April 4 he arrived at her house and informed her that he was going to south Florida for Easter. She had been unaware that he had planned to leave town. Smart said that Moore returned to Tallahassee on either April 8 or April 9. He had been staying at her apartment and sleeping in her room since that time. Additional supplemental reports will follow.
