DCIS Form 1 MAY 2015 200900551P-40KC- 2 REPORT OF INVESTIGATION: Narrative: I. This investigation was initiated based upon information received from the US. General Services Administration (GSA) and US. Department of Labor (DOL) regarding possible contract fraud committed by Caddell Construction Company, Incorporated (Caddell Construction) and their subcontractor Mountain Chief Management Services (Mountain Chief) while working on the Edward Zorinsky Federal Building renovation project in Omaha, Nebraska. The Zorinsky renovation project was issued under GSA contract number GSO6P02GZC0546 on May 27, 2004 and concluded in June 2007 for a total value of $43,000,000. The US. Army Corps of Engineers (USACE) provided on-site project management during the renovation project and maintains of?ce space in the Zorinsk Federal Buildin . GSA rela ed information re arding on ongoing con/Don investigation now Caddell Construction on the Zorinsk ro'ect. The total contracted amount between Caddell Construction and a so stat that Caddell Construction management to] themselves Mountain Chief. Subsequent interviews 0 while Mountain Chief appeared to be connected to the Zorinsky project, Mountain Chief did not perform any work during the renovation period. 2. A search for records regarding Caddell Construction and Mountain Chief determined that Caddell Construction utilized Department of Defense small business programs; speci?cally the Mentor-Protege Program and the Indian Incentive Program through Mountain Chief. Mountain Chief is a self-certi?ed Small Disadvantaged Business and Native American- owned business. The Mentor-Prote'ge? Program paid Caddell Construction approximately $467,000 through a 2003-2004 agreement to mentor Mountain Chief. Caddell Construction also received approximately $734,874 from the Indian Incentive Program citing Mountain Chief as a subcontractor on various US. Army Corps of Engineers projects from 2003-2005. 3. Investigative activity, which included extensive witness interviews and records requests, revealed that Caddell Construction employee Mark Hill (Hill) managed the only Mountain Chief employee who worked at the Caddell Construction of?ce. Daniel Chattin (Chattin), President, Mountain Chief, introduced the Mentor-Protege Program and Indian Incentive Program to Caddell Construction. Chattin also held various positions within Mountain Chief to include Project Manager and Consultant. Record reviews revealed that Caddell Construction submitted timecards for various Caddell Construction employees who reported mentoring hours to Mountain Chief employees on contracts at Fort Bragg, NC. The timecards allowed Caddell Construction to receive direct reimbursement of costs expended for time spent mentoring Mountain Chief employees. DCIS Form 1 MAY 2016 200900551P-40KC- 3 individuals associated with Mountain Chief, nor did the individuals provide mentoring to Mountain Chief employees as purported on the timesheets submitted to the 4. Investigative activity also determined that Caddell Construction submitted payment requests to the for Indian Incentive Program payments in connection with the two Fort Bragg contracts, as well as with a third contract awarded to Caddell Construction at Fort Campbell, KY. Payment requests and other oral representations, revealed that Chattin and Hill knew Caddell Construction represented to the that Mountain Chief performed on its subcontracts, and provided the with evidence of that performance in the form of purported invoices from Mountain Chief ?for services rendered? over a speci?ed time period. As Chattin and Hill knew, however, those invoices were fabricated solely for the purpose of justifying Caddell?s payment requests, and Mountain Chief was nothing more than a pass-through entity, receiving and appearing on paperwork for the purpose of obtaining payments under the Indian Incentive Program. 5. Chattin was interviewed by Agents and again under a proffer letter at a later date. Chattin provided information regarding his contracting relationship with Caddell Construction and Mountain Chief?s participation in the Indian Incentive Program and Mentor-Protege Program. Chattin also provided information about the timecards submitted by Caddell Construction and stated that Caddell Construction billed the program for mentoring hours and received money under the Mentor-Prote?g? Program when Mountain Chief employees never received mentoring. Additionally, Chattin stated that Caddell Construction negotiated all of the projects and used all of the subcontractors that they typically used on their projects. Caddell Construction only subcontracted through Mountain Chief as if Mountain Chief was used as a pass-through. 6. Hill was interviewed by Agents. During the interview, Hill stated that he knew that Caddell Construction did not mentor Mountain Chief for all of the hours reported on the timecards. Hill also stated that he realized it was a submission of false time to the Government, but he did not think about the consequences. Chattin approached Caddell Construction and informed the company that it was how things worked and that Caddell Construciton received payment for doing basically nothing. The investigative team later requested a proffer interview of Hill; however, Hill?s attorney informed the investigative team that Hill did not want to proceed with the proffer interview. 7. On January 19, 2012, Hill and Chattin were indicted in US. District Court, Montgomery, AL. Hill was charged with three counts of major fraud against the government in violation of 18 U.S.C. 1031 and one count of false statements in violation of18 U.S.C. 1001. Chattin was charged with three counts of major fraud against the government in violation of 18 U.S.C. 1031. Based on the indictment, an arrest warrant was issued for Hill and Chattin. DCIS Form 1 MAY 2015 200900551P-40KC- 4 8. On January 24, 2012, Chattin was arrested in Granite Bay, CA, by agents of the General Services Administration-Of?ce of the Inspector General. 9. On January 25, 2012, Hill voluntarily surrendered in the Middle District of Alabama. 10. On December 27, 2012, Caddell Construction entered into a Non-Prosecution Agreement with the Department of Justice to resolve criminal fraud violations arising from Caddell Construction?s intentional overstating of developmental assistance provided to Mountain Chief as part of the Mentor-Protege Program and Indian Incentive Program. As part of the agreement, Caddell Construction agreed to pay a $2 million criminal penalty and to cooperate with the Department of Justice for the two-year term of the agreement. 11. On March 25, 2013, Caddell Construction entered into a settlement agreement with the Department of Justice to resolve civil claims against Caddell Construction?s submission of false claims for payment under the Mentor-Protege Program and Indian Incentive Program. As part of the agreement, Caddell Construction agreed to pay a $1,150,000 settlement agreement. 12. On July 30, 2013, after ajury trial in U.S. District Court, Montgomery, AL, Hill was found guilty on one count of false statements in violation of 18 USC 1001. Prior to jury deliberation, the case against Chattin was dismissed under a Rule 29 motion. 13. On November 12, 2013, Hill was sentenced in U.S. District Court, Montgomery, AL. Hill was sentenced to one year of probation. Hill also received a $100 mandatory special assessment. 14. On September 2, 2014, the Of?ce of Counsel, U.S. Army Corps of Engineers, Savannah, GA, submitted a referral for a fact-based debarment to the U. S. Army Procurement Fraud Division The referral recommended debarment for Hill, Chattin, Caddell Construction, and Mountain Chief. 15. On September 3, 2015, Hill was noti?ed of the decision to debar him until July 1, 2018. The U.S. Army Procurement Fraud Division informed the investigative team that Caddell Construction previously received a show cause letter. The company responded and the Suspension and Debarment Of?cial closed the case without ?thher action. It was also determined that no further action should be taken against Chattin since the Government charges were dismissed at Chattin?s July 2010 trial in U.S. District Court, Montgomery, AL. 16. With the imposition of sentence, criminal penalty payment, civil settlement, and administrative actions, all investigative effort is completed. This investigation is now closed. All documents obtained during the course of this investigation have either been returned or disposed of properly. There were no fraud vulnerabilities identi?ed during the course of this investigation.
