EMPLOYMENT AGREEMENT BETWEEN PETER REICHARD AND THE CITY OF NEW LONDON The City of New London hereby appoints and employs PETER REICHARD as the Chief of Police for the City of New London, Connecticut (hereinafter ?Chief? or ?Police Chief") retroactive as of January 12, 2017, to perform the functions and duties Specified in the City Charter, in the Job Description, and to perform other legally permissible and prOper duties and functions appropriate to the Of?ce of the Chief of Police as the Mayor shall from time to time reasonably assign, subject to this Agreement. I. Duties and Responsibilities The Police Chief shall be the Chief Executive Of?cer of the City of New London Police Department. The Chief shall be responsible to the Mayor for the proper administration of the New London Police Department (hereinafter ?Police Department?) and general supervision of the enforcement of laws and ordinances within the City. His duties and responsibilities shall include but not necessarily be limited to the following: A. Recommend for appointment and, when necessary in his judgment for the good of the City, suspend or recommend for discharge all of?cers and employees of the Police Department, except as otherwise provided by the City Charter or state law. B. Prepare the Police Department budget annually and submit the budget to the Mayor together with a message describing the important features, and be responsible for administration of the budget after adoption. C. Prepare and submit to the Mayor, as of the end of the ?scal year, a complete report on the finances and administrative activities of the Police Department for the preceding year. D. Advise the Mayor of the ?nancial condition and future needs of the Police Department, and make such recommendations as the Chief shall deem advisable. E. Recommend to the Mayor the adoption of such measures as the Chief may deem necessary or expedient for the health, safety or welfare of the City, or for the improvement of the administration of the Police Department. F. Supervise the purchase of all materials, supplies and equipment for which funds are provided in the Police Department budget. G. Responsible for the oversight of the investigation of all complaints concerning the administration of the Police Department. H. Perform other such duties as may be required by the Mayor, not inconsistent with the City Charter, law or ordinance. I. See that all laws and ordinances are duly enforced. 11. Outside Employment The Police Chief shall devote his full time and best efforts to the performance of his duties for the City. He shall not engage in any outside employment, with the exception of occasional teaching, writing, Speaking or consulting performed on his time off provided that the Mayor is noti?ed in advance and that there is no con?ict of interest with the City. Certi?cation The Chiefs employment under this Agreement shall at all times be conditioned on his maintaining certi?cation and meeting such other requirements for sworn police of?cers as may be set forth in State law or the regulations of the Connecticut Police Officer Standards and Training Council or any successor thereto. IV. Administrative Personnel The City will provide the Chief with the administrative personnel deemed necessary to perform his duties. V. Salary The City agrees to pay the Chief an annual base salary of One Hundred Twenty?Four Thousand Five Hundred and No/ 100 Dollars beginning retroactively to July 1, 2017. This base salary shall be paid in biweekly installments. The annual base salary for the following years shall be determined by the City in accordance with the City?s compensation plan for management employees. The Chief shall be eligible for cost of living increases consistent with the criteria used for other City department heads. VI. Term This Agreement shall commence retroactively to January 12, 2017, and terminate on June 30, 2021, unless the parties mutually agree in writing to extend the period of employment. VII. Bene?ts The following bene?ts shall be provided to the Chief and paid for by the City during the Term of this Agreement: A. Life Insurance: The City shall provide term life insurance to the Chief in the amount of two (2) times his base salary with an option to purchase up to three (3) times his base salary at his expense. B. Medical and Dental Insurance: As provided in the Summary of Bene?ts for Unaf?liated Employees, a copy of which is attached and made a part herein, as amended from time to time. C. Vacations and Holidays: The Chief shall receive twenty-?ve (25) vacation days per year. Holidays received shall be as provided in the Summary of Bene?ts for Unaf?liated Employees, a copy of which is attached and made a part herein, as amended from time to time. D. Sick Leave: As provided in the Summary of Bene?ts for Unaf?liated Employees, a copy of which is attached and made a part herein, as amended from time to time. E. Injury Leave: If the Chief is injured in the line of duty and within the scope of his employment, he shall be entitled to injury leave with full pay on the same basis as and subject to the same terms, conditions and limitations applicable to other sworn of?cers. F. Uniforms and Cleaning Allowance: The City shall provide the Chief with the same clothing and cleaning allowance under the same terms of the sworn police of?cers? collective bargaining agreement. G. Retirement Bene?ts: The Police Chief shall continue to participate in the 401a Contributory pension plan (ICMA-RC 401a) established for department heads which affords the employee 9.5% of wages contributed by the employer with a 7% required employee contribution. H. Vehicle: The Chief shall have 24 hour use of the city vehicle assigned to his of?ce and unlimited travel statewide and in area states. If using the vehicle outside of New England, the Chief will provide the Mayor with advance notice of such travel. The Chief shall be responsible for maintaining any required records of vehicle use and for payment of any federal or state income tax which may be attributed to personal use of the vehicle. Said vehicle used by the Chief shall be unmarked and equipped with an authorized emergency siren, emergency lighting and a police radio. I. Professional and Business Expenses: The City shall pay or reimburse the Chief for all reasonable business expenses, as well as all training and professional development expenses, with prior approval of the City Mayor, which shall not unreasonably be withheld. The City does hereby approve and agree to pay for the Chiefs membership in the Connecticut Police Chief? 3 Association and IACP. The City does hereby approve and agree to pay for the Chiefs attendance at an annual IACP Conference during each contract year and any Connecticut Police Chief?s Association meetings as budgetary conditions allow. The City agrees to pay for attendance at the Annual Conference for FBI graduates as budgetary conditions allow. Additionally, the City shall pay or reimburse for the Chief? FBTNAA and PERF Memberships. J. Other Bene?ts: The Chief shall be eligible for all other bene?ts not specifically stated herein as provided in the Summary of Bene?ts for Unaf?liated Employees, a copy of which is attached and made a part herein, as amended from time to time unless otherwise modified by this Agreement. Residence Requirement The Police Chief agrees to maintain residency in the City of New London during his term of employment with the City of New London. IX. Performance Evaluation The Mayor shall review and evaluate the performance of the Chief no later than June 30th of each fiscal year. Said review shall be in accordance with goals, objectives and criteria developed by the Mayor in consultation with the Chief. The Mayor shall provide the Chief with a written summary of the evaluation and provide adequate opportunity for the Chief to discuss the evaluation with the Mayor. X. Con?ict of Interest The Police Chief shall not, during the term of this Agreement, individually, as a partner, joint venture, of?cer or shareholder, invest or participate in any business venture conducting business in the corporate limits of the City of New London, except for stock ownership in any company whose capital stock is publicly held and regularly traded, without prior approval of the Mayor. For and during the term of this Agreement, the Police Chief agrees not to invest in any real estate or property improvements, except for use as a personal residence, within the corporate limits of the City of New London without the prior consent of the Mayor. In addition to the above, the Police Chief shall conduct his affairs in compliance with the terms of the City of New London Code of Ethics. XI. Termination of Agreement A. Death: In the event of the Chiefs death, this Agreement shall terminate immediately on the date of death, without notice; provided, however, that the City shall pay the Chiefs estate his base salary to the date of death and the accrued bene?ts described in this Agreement. B. Disability: At the option of the City, upon thirty (30) days advance written notice received by the Chief, if the Chief, with or without reasonable accommodation, has been unable to perform the essential duties hereunder as a result of illness or permanent disability for a period of six (6) consecutive months, this Agreement shall terminate. Termination under this Section shall not affect or impair the Chief?s rights under the Connecticut Workers? Compensation Act, the Heart and Hypertension Act and/or the Americans with Disabilities Act. In the event of a dispute concerning the Chiefs ability to perform the essential functions of the position, the City and the Chief shall mutually agree on a medical expert to perform an examination and evaluation. Any expense for such examination and evaluation not covered by the City?s health insurance shall be paid for by the City. . Mutual Agreement: At any time when the parties mutually agree, in writing, to terminate the Chiefs employment. . Election: At the election of the Chief, with or without reason, and at the Chiefs sole discretion, the Chief may submit a resignation upon six (6) months advance written notice to the City. The Chief may rescind this notice during the ?rst sixty (60) days. . Just Cause: Upon a showing of just cause and in compliance with General Statute 278. Just cause for termination shall include, but not necessarily be limited to, the following: . The Chief?s inability to perform the essential functions of his position, as consistent with state and/or federal law; Expiration of the term of this Employment Agreement, if the parties have not agreed in writing to extend such term; Conviction of a misdemeanor or felony, including a plea of 11010 contendere to a misdemeanor or felony charge; Two consecutive, written unsatisfactory performance evaluations prepared by the Mayor and/or his designee, where the Chief, after the first evaluation, fails to demonstrate satisfactory improvement in the discretion of the Mayor; Theft, willful neglect or misuse of any City or Department fund, property, equipment, material or supplies; Absence without leave or failure to return to duty following authorized leave; 7. Intoxication or use of illegal drugs or illegal use of legal drugs while on duty or in uniform, andfor serious violation of the City policies regarding Drug and Alcohol Use; 8. Failure to comply with lawful written directives of the Mayor; 9. Serious violation of City policies regarding Work Rules and/or Employee Conduct; 10. Serious violation of any rules or policies of the Police Department General Duty Manual. F. Retirement: This Agreement shall terminate upon the Chiefs retirement from City service except for those provisions relating to pension. XII. Indemni?cation The City shall defend, save harmless, and indemnify the Police Chief against any claim arising out of an alleged act or omission occurring in the performance of his duties as the Police Chief, to the extent provided by law. Dispute Resolution In the event of a claim of breach of this Agreement, the Chief may submit the controversy, claim, or breach issue to mediation. Notice of his intent to mediate shall be sent by the Chief in writing, to the Mayor. The notice shall set forth the facts and the contract provision, which the Chief claims has been breached. If the parties are unable to resolve the controversy within thirty (3 0) days of the Mayor?s receipt of the notice, the matter will be submitted to a mutually agreed upon mediator. In the event a resolution cannot be reached through mediation, the parties do agree to be contractually bound to submit themselves to the personal jurisdiction of the state courts of Connecticut. The venue for any court proceeding shall be in the Superior Court for the Judicial District for New London at New London, Connecticut and each party waives any venue, convenient forum, removal, jurisdiction, or other rights to the contrary. XIV. Return of Employer?s Pronertv On termination of this Agreement, regardless of how termination is effected, or whenever requested by the Mayor, the Chief shall immediately return to the City, all of the City?s property used by the Chief in rendering services under or pursuant to this Agreement, or otherwise, that is, in the Chiefs possession or under the Chief?s control. XV. General Provisions This Agreement constitutes the sole, only, and entire agreement between the parties with respect to the Chiefs employment. This Agreement may be modi?ed only by a written instrument duly executed by each of the parties. No person has any authority to make any representation or promise on behalf of any of the parties not set forth herein, and this Agreement has not been executed in reliance upon any representation or promise except those contained herein. N0 waiver by any party of any breach of this Agreement shall be deemed to be a waiver of any preceding or succeeding breach. This Agreement shall be construed and governed by the internal laws of the State of Connecticut. This Agreement shall be binding upon and inure to the bene?t of the heirs at law and executors of the Chief. If any provisions, or any portion thereof, contained in this Agreement is held unconstitutional, invalid or unenforceable, the remainder of this Agreement, or portion thereof, shall not be affected and shall remain in full force and effect.
