Case Filing Date 11/30/2017 COUNT 3 That the above named defendants TIMOTHY STEPHEN SIKORSKI AND TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 459, a felony, in that on or about August 25, 2017, in the County of Riverside, State of California, the defendants did willfully and unlawfully enter a certain building located at Haig Bedrossian, 73929 Larrea Street, Palm Desert, with intent to commit theft and a felony. COUNT 4 That the above named defendant TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 487, subdivision a felony, in that on or about August 27, 2017, in the County of Riverside, State of California, the defendant did willfully and unlawfully steal and take and defraud money, labor, real and personal property of Walter Fromme, 68805 Perez Road, Cathedral City, of a value exceeding Nine Hundred Fifty Dollars ($950.00) to wit: circuit breakers. COUNT 5 That the above named defendants TIMOTHY STEPHEN SIKORSKI AND TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 487, subdivision a felony, in that on or about August 27, 2017, in the County of Riverside, State of California, the defendants did willfully and unlawfully steal and take and defraud money, labor, real and personal property of Sherman?s Deli, 73161 Country Club Road Palm Desert, of a value exceeding Nine Hundred Fifty Dollars ($950.00) to wit: circuit breakers. It is further alleged that the said defendant, TIMOTHY STEPHEN SIKORSKI, committed two or more related felonies, a material element of which was fraud or embezzlement, which involved a pattern of related felony conduct, and this pattern of related felony conduct involved the taking of more than one hundred thousand dollars within the meaning of Penal Code section 186.11, subdivision subsection (1). COUNT 6 That the above named defendant TROY CHRIS CHRISTIANSEN attempted to commit a violation of Penal Code section 459, a felony, in that on or about September 9, 2017, in the County of Riverside, State of California, the defendant did willfully and unlawfully enter a certain building located at Goody?s Cafe, 72246 Vamer Road, Thousand Palms, with intent to commit theft and a felony. COUNT 7 That the above named defendant TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 530.5, subdivision a felony, in that on or about September 9, 2017, in the County of Riverside, State of California, the defendant did willfully and unlawfully obtain personal identifying information of another person, to wit: Achiles L., and use that information for an unlawful purpose, including to obtain, or attempt to obtain credit, goods, services, real property and medical information in the name of the other person without the consent of that person. Case Filing Date 11/30/2017 COUNT 8 That the above named defendant TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 496, subdivision a felony, in that on or about September 9, 2017, in the County of Riverside, State of California, the defendant did willfully and unlawfully receive certain property, to wit, Silver HP Laptop (Serial CNU4059CWZ), which said property had been obtained by theft, knowing said property had been so obtained, and did conceal and withhold and aid in concealing and withholding said property from the owner, and the value of the property exceeded Nine Hundred Fifty Dollars COUNT 9 That the above named defendant TROY CHRIS CHRISTIANSEN committed a violation of Penal Code section 466, a misdemeanor, in that on or about September 9, 2017, in the County of Riverside, State of California, the defendant did willfully and unlawfully have upon his and in his possession instruments and tools with intent to break and enter into a building, aircraft, railroad car, trailer coach, vessel, and vehicle. PRIOR OFFENSE NO.1 It is further alleged that said defendant, TIMOTHY STEPHEN SIKORSKI was on or about February 10, 2014, in the Superior Court of the State of California for the County of Riverside (RIF1304508), convicted of the crime of second degree burglary, a felony, in violation of section 459 2nd of the Penal Code, and that the defendant then served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of ?ve years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5, subdivision PRIOR OFFENSE NO.2 It is further alleged that said defendant, TIMOTHY STEPHEN SIKORSKI was on or about November 6, 2013, in the Superior Court of the State of California for the County of San Bernardino convicted of the crime of import/sell/transport a controlled substance, a felony, in violation of section 11379, subdivision of the Health and Safety Code, and that the defendant then served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of ?ve years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5, subdivision PRIOR OFFENSE NO.3 It is further alleged that said defendant, TIMOTHY STEPHEN SIKORSKI was on or about March 10, 2011, in the Superior Court of the State of California for the County of Los Angeles (MA04926201), convicted of the crime of grand theft, a felony, in violation of section 487, subdivision of the Penal Code, and that the defendant then served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of ?ve years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5, subdivision served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of ?ve years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5, subdivision PRIOR OFFENSE 0.2 It is further alleged that said defendant, TROY CHRIS CHRISTIANSEN was on or about November 14, 2012, in the Superior Court of the State of California for the County of Riverside (SWF1207159), convicted of the crime of possess a ?rearm with prior felony, a felony, in violation of section 29800, subdivision subsection (1) of the Penal Code, and that the defendant then served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of five years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5, subdivision PRIOR OFFENSE NO.3 It is further alleged that said defendant, TROY CHRIS CHRISTIANSEN was on or about April 8, 2009, in the Superior Court of the State of California for the County of San Bernardino (FVA900096), convicted of the crime of receiving stolen property, a felony, in violation of section 496, subdivision of the Penal Code, and that the defendant then served a separate term in state prison for said offense, and did not remain free of prison custody for, and did commit an offense resulting in a felony conviction during, a period of ?ve years subsequent to the conclusion of said term, within the meaning of Penal Code section 667.5 subdivision It is further alleged that, except in an unusual case where the interest of justice would best be served within the meaning of California Rule of Court 4.413 subdivision probation shall not be granted because the defendant, TIMOTHY STEPHEN SIKORSKI, was previously convicted of the following felonies, within the meaning of
