IT IS HEREBY ORDERED AND ADJUDGED:
JUDGMENT is entered in favor of Plaintiff and against Defendants as follows:
1. The court declares that Defendants, as members of the Oregon Board of Examiners
for Engineering and Land Surveying, unconstitutionally applied Oregon’s
engineering title and practice act, ORS 672.002 et seq., and its associated
administrative rules, to Plaintiff’s speech about traffic lights and to his description of
himself as an engineer.
2. Defendants, as members of the Oregon Board of Examiners for Engineering and Land
Surveying, are enjoined from enforcing Oregon’s engineering title and practice act,
ORS 672.002 et seq., and its associated administrative rules, against Plaintiff for his
speech about traffic lights and his description of himself as an engineer except in the
context of professional or commercial speech.
3. No further relief is awarded. All other relief requested is denied.
