CRISCIONE, the Plaintiff in this matter, having been duly sworn, hereby declares that: 1. I am over 18 years of age, and I believe in the obligations of an oath. 2. This Affidavit is made from my own personal knowledge. 3. In March 2016, I saw a 2006 Ford F-250 pick-up truck (the “Vehicle”) for sale on Atlantic Motors’ website for an advertised price of $18,999. 4. I was interested in the Vehicle, and I visited Atlantic Motors to see and test drive the Vehicle. 5. I met with an Atlantic Motors’ salesman who identified himself as Bob, and I showed Bob the advertisement of the Vehicle on his mobile device. 6. I returned to Atlantic Motors the next day with my father, and he negotiated the sale price of the vehicle for $18,000 and an allowance of $4,000 for my trade-in, a 2001 Chevrolet 2500 HD. 7. Bob told me that my monthly payment would be between $430 and $450. At no time did I enter into any retail installment contract for the Vehicle, and Atlantic never provided me with a retail installment sales contract. 10. The retail installment contract attached to the Sobolewski Declaration was never provided to me by Atlantic Motors, and I never executed that document. 11. In late May 2016, I learned from Credit Acceptance that it possessed a document that I had purportedly signed that provided for monthly payments that were greater than the payments that I had agreed to pay when I purchased the Vehicle. 12. I requested that Credit Acceptance send me a copy of that document, and Credit Acceptance sent me a copy of the retail instalment sales contract attached to the Sobolewski Declaration. 13. This was the first time that I ever saw this document. 14.
