ORDER

While this Court has seen overall progress in resolving the Border Fence cases in the
Brownsville Division, it has not seen Similar movement in the Border Fence cases pending in the
McAllen Division. This Court has taken a ?hands-off? approach to allow the Government and the
Landowners to reach an accord where possible, but it iS concerned that many cases are almost four
years old with no resolution in sight. The Parties are hereby noti?ed that the Court in 2013 will start
setting these cases, including this case, for trial unless it perceives that justice is better served to
delay such action.

Further, this Court hereby orders the Government to ?le a joint (signed by counsel for the
Government and counsel for landowner or, if pro se, the landowner himself or herself) informing
the Court of the status of this case, the impediments, if any, to an ultimate resolution, and the

prospects for a resolution in the near future. These status reports are due by October 15, 2012.
