WHEREAS, the Commissioners Court of Fort Bend County, Texas, has been presented a
petition (heremafter referred to as the "Petition") requesting creation of a levee lffiprovement district
to be known as Fort Bend County Levee Improvement District No 15, under the authonty of
Article XVI, Section 59, Texas Constitution and Chapter 57, Texas Water Code, as amended, which
Petition ISattached hereto as Exhibit" A", and
WHEREAS, Chapter 57 of the Texas Water Code confers JunsdlctlOn on the County Judge
and Commissioners Court of Fort Bend County, Texas to create such levee Improvement dlstnct,
and
WHEREAS, it appears to the Commissioners Court that such PetitIOn ISm proper form and
has been properly executed by the owners of at least a maJonty of the acreage wlthm the proposed
district and is accompamed by a depoSit of Fifty Dollars ($50 00) as reqUired by Chapter 57, Texas
Water Code and has been properly presented to the Court, and it further appears that the
Commissioners Court ISauthonzed and required pursuant to Chapter 57, Texas Water Code to adopt
an order at this time scheduling a hearmg on such Petition, and
WHEREAS, It IShereby found, determined and declared by the Commissioners Court that
this meeting of the Court ISopen to the pubhc as required by law and that notice has been given of
the hour, date, place and purpose of thiS meeting as requlfed by law,
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the County Judge and
Commissioners Court of Fort Bend County, Texas

meetmg of the Commissioners Court to be held on such date m the Commissioners Court Room at

cause the same to be posted at five (5) public places m Fort Bend County at least ten (10) days
before the date of the heanng, one (1) copy of such notice being posted at the Fort Bend County
Courthouse door and the remaming four (4) copies of such notice being posted Within the
boundaries of the proposed levee improvement district Such notice shall state that the Petition has

fully accomphsh a reclamatIOn plan for drammg land, constructmg levees on land, and reciaImmg
land from overflow or damage by waters from streams mSlde or adjacent to the DistrIct and, where
necessary, the straIghtemng of streams which may mJure the land mSlde the Dlstnct

There ISa necessity for the organizatIOn of the Dlstnct and the proposed Improvements for
the reason that the temtory to be mcluded m the Dlstnct ISbemg or Will be developed for resldenlial,
commercial, and/or mdustnal purposes, and the health and welfare ofthe present and future reSidents
of the Dlstnct and the protectIOn of lands, property, reSidences, and commercial and mdustnal
estabhshments wlthm the Dlstnct reqUires the constructIOn of such proposed Improvements

The proposed Improvements are feasible m that the necessary levees, bndges, drams, and
other reclamatIOn Improvements can be acqUired or constructed at reasonable costs, and taxes at
reasonable rates can be leVied wlthm the Dlstnct which Will be suffiCient to amortize all debt
mcurred by the Dlstnct for the purpose of acqumng or constructmg the needed Improvements and
to provide for the payment of all costs of proper mamtenance, upkeep, and repair, and addllions to
the levees and other Improvements m the Dlstnct, and other costs or Improvements authonzed by
Chapters 49 and 57, Texas Water Code, as amended

I. INTRODUCTION

A.

PURPOSE

The purpose of tills report is to present engineering data in support of the creation of a Levee
Improvement District which will remove certam properties in Fort Bend County, Texas from the
lOO-yearflood plain of the Brazos River. The proposed Fort Bend County Levee Improvement
Dlstnct No. 15, (District) will be created to provide flood protection for the areas wlthm the
proposed levee from flooding by the Brazos River during high flood stages along the nver and
from localIZedevents less than or equal to the lOO-yearrainfall event over the properties within
the leveed area

SCOPE

This report presents the results of the mvestigatlons performed to determine the feasibility of
providing a flood protectIOnlevee and dramage unprovements to reclaun 2790 acres of land from
the Brazos River flood plain

This Engineer's Report for the Creation of the Distnct was

deVeloped m accordance With the Texas Water Code Chapter 57

The engmeenng and

construction costs associated With the proposed levee and dramage unprovements are also
presented to provide adequate mformation for economic analySISm support of the creation of the
proposed dlstnct

GENERAL INFORMATION
1.

Project Description

The proposed District IS located in Fort Bend County, Texas within the extraterntonal
junsdictlOns of the Cities of Sugar Land and Missouri City. The site is generally bounded
by the First Colony Levee Improvement Dlstnct (FCLID), the First Colony Levee

Improvement District No.2 (FCUD 2) and the Fort Bend County Municipal Utility
District No 46 (MUD 46) on the north, Steepbank Creek on the east, Hagerson Road on
the south, and the Brazos River on the west. Exhibit 1 depicts the general location of the
proposed project area

The eXistingland uses Withinthe proposed District boundaries are mainly ranch land With
the western portion of the subject tract being heaVilywooded and the eastern portion being
open pasture with numerous oil well and other equipment sites

Several tracts are planned to be located Withinthe leveed area but Willnot be part of the
District

These tracts contain reSidential strllcrores located Within Pecan Manor Estates

subdiVISion,Maranatha Farms subdiviSIOn,the Howard tracts and the Byler tract. These
strllcrores will be protected by the levee and outfall drainage facilities but will not be
subject to taxatIOnby the District.

Several tracts within the proposed leveed area contain petroleum production wells and
equipment and Will be set aSide as fumre dnlling access sites. These tracts will be
excluded from the Distnct, therefore not subject to taxation, but will be protected by the
levee and outfall drainage facilities

The proposed development Willconsist of moderate to high density reSidential subdiviSIOns
and light commercial developments The existing developed areas within the proposed
leveed area are not expected to develop beyond the levels currently expenenced.

The

development of currently undeveloped tracts or the redevelopment of existing developed
areas may occur In the furore

Should such tracts develop, any additional detention

required to maintain Internal ponding elevations within the District at non-flood levels will
be the responsibility of those fumre developments. Such furore developments will be
reqUired to convey runoff Into the detention/drainage systems proposed for the Distnct
which Include a combinatIOnof open ditches and detention/ameruty lakes.

A.

PROPOSED PROJECT SITE

Included wlthm the proposed leveed area (see Exhibit 3) are numerous small
properties wlthm the eXlstmgPecan Manor Estates subdivIsion, Maranatha Farms
subdivIsIOn,the Byler tract and the Howard tracts These properties are included
mto the leveed area while not being mcluded mto the DistrIct boundarIes for the
followmg reasons

Maranatha Farms and Howard Tracts

Maranatha Farms IS an eXlstmg 182-acre residential subdivIsIOnlocated
along the northern boundary of the proposed District The Howard tract IS
an undeveloped tract Just east of thiSsubdivision bisected by Oil Field Road
(see Exhibit 3) These areas are mcluded mto the leveed area due to the
allgmnent of the eXlstmgFCUD 2 levee and the eXlstmgdramage patterns
wlthm the subdivIsion and tract

facility to accommodate thiS drainage, at District expense, is avoided.

The Howard tracts are currently undeveloped with the excepllon of one
reSidence, the City of Sugar Land Regional Wastewater Trealinent Plant
and a Mldcon Texas Pipeline Company facility (see Exhibits 3 and 4)
Should the undeveloped tracts develop in the future and requITeaddilional
storm sewer outfall capaCity, these developments would be reqUired to
prOVidestormwater detentIOn of developed conditIOn runoff

The tract

within which the wastewater trealinent plant is located IS assumed to be
fully developed. Any fume expansIOnsof the plant withm thiStract would
not be requITedto provide stormwater detention.

There are currently several large tracts along the southern boundary of
Maranatha Farms and several smaller lots wlthm the northern portion of the
subdiVISion. Several of the northern lots currently do not have reSidences
constructed The southern tracts have smgle reSidences constructed or are
undeveloped at present. Should the existing empty lots be built upon under
the current lot configuratIOns, no stormwater detentIOnwould be required
The eXlstmg drainage patterns and capacities from the subdivision to the
District's outfall faCilities Will be mamtamed m the proposed deSigns,
however any lffiprovements to the eXlstmg drainage system withm the
sUbdivIsionwill be the responSibility of those tracts

Should these tracts

develop in the future at a higher density than currently eXists, then

Pecan Manor Estates and Byler Tract

Pecan Manor IS an eXlstmg unrecorded subdiVision encompassing
approxmIately 130 acres of large lot reSidential tracts. The Byler tract IS

a large tract adjacent to the southern boundary

of Pecan Manor and

Hagerson Road (see Exhibit 3) presently used for ranching/residential
purposes.

These areas are mcluded mto the leveed area due to eXIstmg

dramage dItches wIthm these areas which will be intercepted by the
proposed development wIthm the DIstrict to the north of the subdIvISIon.
These eXIstmg dItches would otherwIse have been cut off from their outfall,
and other offsite drainage facilitIes, at District expense, would have been
reqUITed to accommodate dramage of these properties.

By mcludmg these

tracts mto the leveed area, less offsite dramage trnprovements are needed
to mamtam eXIstmg external dramage patterns

Several of the eXIstmg lots wIthm Pecan Manor Estates currently do not
have resIdences bUIlt. Should these eXIstmg lots be built upon under the
current lot configuratIons no stormwater detention would be reqUITed The
eXlstmg dramage patterns and capacitIes from the subdiviSIon to the
DIStrICt'S outfall faCIlItIes WIll be mamtamed m the proposed deSIgns,
however any additIOnal dramage capaCIty or outfall trnprovements from the
SUbdIVISIonto the DIStrICt'S outfall faCIlItIes Will be the responsibilIty of
these offsite tracts

The Byler tract IS currently a partIally developed ranch property WIth a

NEED FOR IMPROVEMENTS

The eXistIngproperties under consideration to be Included mto the proposed District and wlthm
the proposed leveed area lie within the Brazos River flood plain as delmeated on FIRM Panel
48157C0265 J, dated January 3, 1997 for Fort Bend County, Texas and Incorporated Areas The
eXlstmg flood plam elevations as depicted on the FIRM m the ViclIDtyof the project area range
from 67 5 to 70 0 feet MSL

elevation 64 to 69 feet MSL Under these conditions, considerable floodmg Willoccur wlthm the
project area If no flood protection improvements are prOVided In order to protect the eXlstmg
properties and the proposed development of the subject tracts from floodmg by the Brazos River,
a levee system or fill wlthm the proposed development areas would be required Two alternatives
were Investigated for removing the subject areas from the Brazos River flood plam, flood plain
fill and a flood protection levee system. The followmg paragraphs proVide a brief descnptlon of
each alternative Investigated

C.

PROPOSED FLOOD PROTECTION ALTERNATIVES

1.

Flood Plain Fill

Flood plam fill for a proposed project of thiS sIZe would reqUire that all areas proposed to
be developed would be raised a mmImum of 1- foot above the IDO-year flood elevation of
the Brazos River.

Those areas required to provide dramage of offsite tracts adjacent to

the proposed development would be set aSide to provide outfall through the proposed
developments

and also provide outfall dramage for the proposed development

The

approxImate depth of fill reqUired to raise the subject tract above the IDO-year flood
elevatIOn ranges from 3 to 4 feet above eXlstmg natural ground elevations

ThiS depth of

fill would reqUire that all vegetation, mcludmg all trees, would be removed m order to
place the compacted fill m accordance With the reqUirements of the various regulatory
agencies which currently have junsdlction

Stormwater detention would be reqUired wlthm

the developed areas m order to mitigate the developed condition runoff rates to predevelopment rates, thereby preventmg potential floodmg impacts to the off site tracts

The placement of flood plam fill wlthm the proposed development areas, those tracts
proposed to be withm the Dlstnct,

would preclude the ability of the flood protection

Improvements from provldmg any benefits to the adjacent tracts descnbed above

These

tracts would remam wlthm the IDO-year flood plam of the Brazos River

Based on thiS prelllIDnary mvestIgatIon, It was determIned that flood plain fill would not
be a feasible alternative for removing the subject tracts from the Brazos River flood plam
due to the potential costs of locatmg and proViding adequate quantities of fill material, and
the inability of thiS alternative to provide flood protection to the adjacent areas as descnbed
m the followmg paragraphs

2.

Flood Protection Levee

A flood protectIOn levee will prevent the Brazos River from floodmg the mternal areas,
while also creatmg an ImpedIment to the eXlstmg natural dramage patterns. To compensate

for the changes m dramage patterns, an mternal dramage system IS proposed which will
provide outfall dramage for the off site tracts, the developed area's storm sewer systems
and conveyance of that runoff through the proposed levee and ultimately into the nver
Under flood conditions on the river, the mternal system will provide storm water storage
of the runoff which Will be supplemented With pump stations to remove adequate runoff
volumes to mamtain water surface elevatIOns below flood levels withm the leveed area,

Mlssoun City Wastewater Treatment Plant, then follow the property line north to
Oil Field Road

The proposed levee will termmate at the eXlstmg MUD 46 levee

Just north of Oil Field Road

The safety of property and human lIfe is of prime importance m a project of thiS
type

In order to ensure that property IS adequately protected from Significant

mcreases m flood damages, hydraulic modelIng of the proposed Improvements IS
necessary

Detailed hydraulIc modelIng of the levee system and internal drainage

systems will be performed and presented in the Plan of ReclamatIon under separate
cover.

Levee Height and Freeboard

The height of the proposed levee is reqUIred to be a mmImum of three (3) feet
above the eXlstmg IOO-year flood plam elevation With an additional allowance for
wave actIOn The Federal Emergency Management Agency (FEMA), requires a
mmImum of 0.5 feet of additIOnal height for potentIal wave action

these two critena yields a minimum height above the regulatory

The eXIstmg levees to the north of the project are constructed to elevations
compatible With the elevations plamIed for thiS project

It IS proposed that the

levees match the existmg levee heights. Access and constructIOnpermits from the
four existmg districts operatmg levees will be necessary to accomplish the work.

3.

Internal Drainage Systems and Pump Stations

The constructIOnof the proposed levee will create unpedunents to the eXlstmg dramage
patterns for the areas InSide of the levee. In order to accommodate the dramage of the
property within the levee, constructIOn of mternal drainage unprovements IS required
These Improvements are proposed to mclude dramage chamIels, detention ponds/amemty
lakes, control structures, brIdges and pump stations.

These mternal dramage

unprovements will assume full development of the property wlthm the District and eXlstmg
land uses and development levels of the properties outside of the District boundaries
Should the out-tracts develop m the future, any dramage and detention reqUirements
necessary to accommodate that development Willbe the responsibility of those tracts. The
design crIteria for these facilities were obtamed from the Fort Bend County Dramage
District DeSign CrIterIa Manual (DCM) These crIteria cover two deSign conditions for
leveed areas, a free outfall condItIOnand a comcldental ramfall event which are discussed
m the followmg paragraphs

a.

Free Outfall Conditions

Under these deSign conditions, the gravity outfall conditions of the mternal
dramage facilities are not unpeded by downstream tailwater conditions on the
Brazos River. The rainfall event used to analyze the proposed unprovements ISthe
localIZed lOO-year24-hour ramfall of 125 mches as required by the DCM ThiS
return frequency ISconsistent With30 TAC §301.34.6 reqUirements. In accordance
Withthe DCM, the mternal unprovements are designed to mamtam the lOO-year
water surface elevations below natural ground elevations and to provide adequate

Rainfall Event

The second design conditIOn to be analyzed for a leveed area ISthe conditIon where
the Brazos RIver IS at or near flood stages and any graVIty storm water discharges
from Within the levee are Impeded

Under these conditIons, Internal water surface

elevatIons are maIntaIned below flood levels through the use of Internal storm water
storage and pumpIng

The depth and return frequency of the raInfall used In thiS

analySIS, as defined In the DCM, are based on the return frequency of the Brazos
RIver flood stage WhICh Impedes the gravity dIscharges combined with the
correspondIng
event

local raInfall frequency which yields a lOO-year "coIncidental"

The water surface elevatIOn chosen to determIne the rIver flood level return

frequency IStypically taken from the free outfall conditIOn in order to maxumze the
use of the Internal system for storm water storage volumes. Any amount of runoff
In excess of the Internal storage capacity IS pumped over the levee In order to
maIntaIn establIshed internal maxImum water surface elevatIOns

The Internal

pump StatIOnsoperate to remove the stored runoff until the rIver recedes to a level
whIch allows graVIty outfall to be restored

ThIS method was developed and adopted by the Fort Bend County DraInage DIStriCt
to analyze and deSIgn levee systems along the Brazos River SInce this river reaches
near flood stages for perIods of several days to weeks dUrIng wet perIods of the
year

4.

External Drainage Systems

In order to maIntaIn adequate draInage capacIty for areas Immediately adjacent to the
proposed levee and to proVIde outfall from the proposed leveed area to the Brazos River,

certam external dramage facilities will be necessary.

These facilities are proposed to

mclude an outfall channel to be constructed from the Hagerson Road crossing of Snake
Slough southward to the rIver

This channel will provide gravity outfall for the central

portIOn of the proposed leveed area.

A second outfall charmel is proposed which Will

incorporate improvements to Alcorn Bayou between the proposed levee and the river. A
thud gravity outfall structure will be located wlthm Steep Bank Creek to rnamtam flows
on that eXlstmg channel and to prevent Brazos rIver flood waters from entermg the District
from that channel.

The locations of these rmprovements are shown on Exhibit 3.

Other miscellaneous drainage faclhtles Will be constructed along the levee ahgnment m
order to maintam localIZed dramage patterns

These rmprovements will typically be swales

near the levee toe to intercept sheet flow runoff from adjacent property and duect It away
from the levee

Fmal locations of these types of facihtles will be mcorporated mto the

final deSign of the levee improvements

D.

PLAN OF RECLAMATION

AND LETTER OF MAP REVISION

Subsequent to the approval of creation of the District, a Plan of ReclamatIOn IS required to be
subnutted to the Texas Natural Resources Conservation Commission (TNRCC).

That report Will

prOVide detailed engmeermg analyses of all of the major dramage and flood protection systems
proposed m order to remove the subject tracts from the flood plam of the Brazos River.

Upon approval of the Plan of ReclamatIOn by the TNRCC, a Conditional Letter of Map ReVISion

of the proposed changes to the lOO-year flood plain lrmlts

Upon completion of the actual

rmprovements a Letter of Map ReVision (LOMR) will be submitted to FEMA to make effective
the reVised flood plain limits for the properties Within the leveed area, thus removing those areas
from the IOO-year flood plam of the Brazos River

The constructIon of the proposed unprovements will remove the mternal area from the
l00-year flood plam of the Brazos River and thereby allow development of the mtemal
tracts m accordance with Fort Bend County, CIty of Sugar Land and City of Mlssoun CIty
flood plam management regulations. Without the proposed improvements the subject
property would not meet development requirements of the governing agencies WIthout
substantial fill bemg placed, therefore the construction of this levee is feasible m terms of
reclal1TIlngthe property from the flood plam.

Economic Feasibility

The feasIbIlity of reclaunmg the subject property from the flood plain was exammed based
on the potential for the reclauned property to generate a tax base suffiCIentto support the
debt servIce and operatIOn and maintenance costs of the DIstrict. The total ultimate
taxable value, annual debt serVIce,annual operating budget and projected total tax rate of
$046 per $100 of valuation as descnbed above make thiS project econormcally feasible
