On Saturday, September 23, 2017, at approximately 11:21pm, members of the Metropolitan Police Department?s (MPD) Fifth District and DC. Fire and EMS were dispatched to 1727 North Capitol Street, Northeast, Washington, DC. for the report of a man down. Upon arriving on the scene, members located the decedent, Andrew Cook lying in an unconscious, unresponsive state in the street. He was suffering from an apparent stab wound to the chest and was taken to MEDSTAR. Whiie receiving treatment at the hospital, the decedent was transferred from one gurney to another. Upon transfer, an open bladed knife was seen lying on the gumey amongst the clothing of the decedent. 2. On Monday, September 25, 2017, the decedent succumbed to his injuries and was pronounced dead. 01 September 28, 2 17, DC OCME Dr. Kristinza Giese performed an autopsy. There was a stab wound to the left side of the decedent?s chest, and a1 ceration to his aorta. Doctor Giese determined the cause of death was the stab wound and the manner homicide. 3. During the course of an investigation, members interviewed witnesses. One such witness, hereafter referred to as itness reports that while in the vicinity of the homicide, IT observed the decedent collapse in the street behind a parked burgun minivan. Upon observing this, Witness #1 went to the decedent?s location to render aid. Upon arrival, Witness #1 noticed a female driver and another passenger sitting inside the Burgundy mini-van. Witness #1 then directed attention to the decedent and noticed at his shirt was saturated with blood. Witness #1 called 9-1-1 and requested for the presence of emergency medical services. Witness #1 did not observe the offense nor see anyone next to the decedent at the time he collapsed. Witness #1 did not describe seeing a knife in the decedent?s hand (but what not speci?cally asked). 4. A second witness, herea?er referred to as Witness reports that while in the 1700 block of North Capitol Street, Northeast, IT observed the decedent stumbling, bent over, and holding his stomach. As a result, Witriess #2 and the relative exited the van. At this time, Witness #2 observed Witness #1 on the phone behind the van with the decedent. Witiiess #2 did not observe the offense nor see anyone next to the decedent at the time he collapsed 5. A third witness, hereafter referred to as Witness reports that prior to the stabbing, IT observed the decedent engaged in an altercation with a male known as ?Black? while' 1n the 1600 block of North Capitol Street, Northeast. Speci?cally, Witness #3 stated it was hanging out in the 1600 block of North Capitol Street, Northeast. IT stated the decedent was present. IT stated that at Some point in the night IT saw ?Black? walk up from near 0 Street. After this, IT observed the decedent and ?Black? arguing over the eatment of a male who was lying unconscious on the sidewalk. Following the verbal exchange, Witness #3 observed the decedent an defendant argue. The decedent punched ?Black? and knocked him out. Witness #3 then observed the decedent as 1ist ?Black? to hi feet, after which they walked away together, around the comer, out of Witness sight Witness #3 then observed the decedent ?Black? return to where the ?ght occurred. At this time, Witness #3 observed ?Black? screaming and cursing that someone had stole his bottle of liquor during the ?ght. Witness #3 then observed ?Black? get on a bicycle and ride away in the direction of Street. itness #3 stated that after this, it took a nap in the area. When it woke, the decedent was gone and it left the area. Witness #3 repo knowing ?Black? from the neighborhood and has previously seen him standing in front of either 46 Street, Northwest, or 5 Street, Northwest. Witness #3 stated it had been drinking alcohol that night. 6. Witness #3 described ?Black? as being a black male, in his late 30?s to early 40?s, 5?9 in height, medium build, medium brown skin, with a long dreadlock 7. The detectives showed Witness #3 this array on Octc ber 5, 2017. Updn viewing, Witness #3 identi?ed the photograph of Gregory Williams (photograph as the ?Black? IT obserlved in the altercation with the decedent prior to the homicide. Witness #3 stated the guy that had a ?ght with Cook that?s tile guy who came back with a revolver and stabbed up Cook. That?s Black.? Witness #3 reports knowing ?Black? for two years and Seeing him several times a week. 8. In determining the identi?cation of ?Black,? your af?ant Ieamed of a Black with short hair. This individual did not meet the description of the ?Black? assaulted by the decedent as indicated by Witness 9. Witness #3 also spoke to your af?ant about an incident that occurred numerous days prior to September 23, 2017. our af?ant asked about it due to a bandage on Witness #3?s left hand. Witness #3 stated that was IT outside was near a food establi hment. IT went around the comer to go to the bathroom. When IT returned, two guys had ITs bag. IT said they threw the bag down (1 walked away. When IT looked through ITs bag, ITS money was gone. IT followed the two men and asked for Us money back. A argument ensued. One of the men pulled out a knife. Witness #3 said IT grabbed the knife, causing injury to ITs right and le? hands. . 10. A fourth witness, hereafter referred to as Witness reported that while in the vicinity of the homicide, on the of the homicide, IT heard gunshots and later observed police lights outside of building. Witness #4 did not see any parts of offense. Witness #4 drafted a report of the gunshots. 11. Law enforcement located several surveillance cameras in the vicinity of the homicide. One set of cameras are af?xed to tile external wall of 1713 North Capitol Street, Northeast. The cameras are located approximately 138-165 feet (46-55 yards) south of he murder scene. No individuals walk 1n between the two. i I Approximately 1 minute and 22 seconds following this, Defendant Williams 13 observed walking and then runnin past 1713 North Capitol Street, Northeast away ?om the murder scene. The time of this occurrence is approximately 39 seco ds prior to the 9-1- 1 call. I As Defendant Gregory Williams is observed running away, Witness #1 (9-1- 1 caller)? 18 observed walking toward :rthe murder scene on the opposite side of North Capitol Street. 1 I Witness is headed toward the murder scene, which makes IT approximately 55 yards away from the scene on opposite side of the street ?'orn Defendant Williams who is running away from the murder scene. Witness #1 while wa king north passes 1718 North Capital Street, Northwest, observes the decedent and continues to walk, stops momentarily ile looking toward the decedent who 15 now lying 1n the street, Witness then continues to walk toward the decedent and the calls 9-1- 1 prior to reaching the decedent. 1 12. A different surveillance camera that was located at 1648 North Capitol Street, Northwest, is positioned in a manner thaLcaptures a portion of the 1600- 1700 block of North Capitol Street (both sides of the street), and a portion of Street (both sides of the eet) and a portion of the front of 1727 North Capitol Street, Northeast (murder scene) On this footage, your af?ant observed the follow mg: I The decedent lS seen walking and passing the business at 1633 North Capital Street, Northeast, then crossing Street I Once the decedent crosses Street, Defendant Williams is now at the same crosswalk, adjacent to 1633 North Capitol which is approximately 12 yards away from the decedent headed toward the murder scene. I This camera angle allows the viewer to see the decedent and Defendant Williams on the murder ene at the same tiine, but the viewer cannot see the murder. While the decedent and Defendant Williams are on the murder scene, this same footage shows a small group of peiyple on the comer adjacent to the murder scene. This same group leaves the corner and walks south passing the cameras at 713 North Capitol Street, and shortly after this group passes the cameras at 1713 North Capital Street, you see Defendarit Williams walking away from the murder scene in the same direction as the group, then Defendant Williams passes the came as at 1713 North Capitol Street. The group continues walking south on North Capital Street, then the group crosses StreetI Northeast, out of this camera?s View Defendant Williams IS seen running south on North Capitol Street then crosses Streeti Northeast, out of camera?s view. 13. Your af?ant then viewed the cameras at 1713 North Capitol Street looking for the group described above and noted that a group passes the cameras at 11:17:34. 43 seconds after the group passes the camera, Defendant Williams is observed walking ti'ien running past the same cameras. Therefore, based on these two camera angles, Defendant Williams IS seen on the murder scene decedent and leaving the murder scene walking, then running away from the murder scene. 14. Your af?ant viewed video from the liquor store on the southeast corner of North Capitol and Streets, Northeast. At or minutes after 10:00 pm, just before the store closes, defendant Williams is seen leaving the store with a bag in his hand and walking in the direction of where Witness #3 described the defendant having a ?ght with the decedent. Witness #3 did not described defendant Williams as going to the liquor store after IT saw defendant Willams come to the area from Street, but was not speci?cally asked. Detectives made contact with Defendant Gregory Williams at an apartment in Southeast, Washington, DC During contact, investigators expressed their interest in speaking with him about his ?ght with the decedent. Upon hearing this, Defend Williams exited the apartment and stood in the hallway. As the conversation progressed, Defendant Williams confessed to ?ghting the decedent. Defendant Williams advised that no additional acts of violence occurred after the ?ght Following this dialogue, Defend Williams agreed to provide a statement of facts at the MPD Homicide Branch. The investigators provided Defendant Williams with he address and left the building. Later that evening, Defendant Williams arrived at the Homicide Branch. 16. During a non- -custodial interview, Defendant Williams advised that his nickname IS not ?Black, but :Ie has answered tl) the name ?Black?. Defendant Williams was shown a reward ?yer that displayed a photograph of the decedent. During this time, lDefendant Williams identi?ed the decedent as ?Cook?. . 17. When asked to specify particulars about the ?ght, Defendant Williams reports that while drinking alcohol in front (or y) a liquor store located at 1633 North Capitol Street, Northeast, he noticed that the decedent was ?high? from smoking Defend Williams reports that he sat the decedent on the ground so that he wouldn?t fall. Sometime thereafter, Defendant Williams advised th he saw an unconscious male on the sidewalk 1n front or near the liquor store. As a result, he walked over to the male to wake him up. ile doing so, he turned around and noticed the decedent directly In his face Defendant Williams reports that the decedent ?rushed? and ?swung? at him with no warning. Defendant Williams advised that this action caused him to trip over the unconscious male andl fall to the sidewalk. Defendant Williams advised that he got off the ground and stated, ?Damn dog for real?? According to Defend Williams, the decedent apologized for his actions and they both walked around the comer and quashed the animosity. Sometime thereafter, Defendant Williams returned to the area of the ?ght and observed the decedent walking nort on North Capitol Street, Northeast toward Randolph Place, Northeast (murder scene). Defendant Williams reports following the cedent and repeatedly shouting ?Where are you going?? Defendant Williams reports that the decedent continually ignored him. Defendant Williams advised that he stopped following the dec dent while in front of the grocery store located at 1727 North Capitol Street, Northeast. It should be noted that this; location is the scene of the murder. Defendant Williams was shown a still photograph of the decedent as he walked toward the murder scene minutes drior to the stabbing. Upon viewing, Defendant Williams identi?ed the decedent as ?Cook?. Furthermore, Defendant Williams acknowledged that the decedent appeared to be uninjured. Defendant Williams was then shown a still photograph of the male who appeared to be following the decedent toward the murder scene minutes prior to the stabbing. Upon viewing, Defendant Williams identi?ed himself ad the person following the decedent. It should be noted that by making this identi?cation, Defendant Williams identi?ed himself asithe person running away from the murder scene 39 seconds prior to the 9-1-1 call. 20. At the time of the interview, Defendant Williams had a short haircut. In the aforementioned still pho::ograph, Defend lt Williams had long dreadlocks. When asked about this, Defendant Williams advised that he has grown his hair for 1 years and recenty cut it for his 42nd birthday. Defendant Williams was confronted with the fact that the decedent received his injury in front of the store where hei reportedly stopped following the decedent. At this point, Defendant Williams altered his previous version of events and advised that ihe stopped following the decedent prior to crossing Randolph Place, Northeast to the store.
