Upon arrival at the scene, the decedent, who was later identi?ed as Neil Godleski, was found lying in the grass inside Sherman i Circle, unconscious, not breathing, and suffering from apparent gunshot wounds. Members of DC Fire and Emergency Medical Services were summoned to the scene and the decedent was transported to Medstar by Medic 24. At 0108 hr, the decedent was pronounced by Dr. Street of Medstar. {g The remains of the decedent were transported to the DC Of?ce of the Chief Medical Examiner where a post? mortem examination and autopsy was performed by Doctor Goslinoski of staff. The cause of death was determined to be a gunshot wound to the chest and the manner of death was ruled to be a homicide. Police recovered from the scene a total of six .380 caliber shell casings. Five of the shell casings were recovered in a group, south of the intersection of Kansas Avenue and Sherman Circle, NW. A single shell caSing was recovered farther north from the group, closer to the intersection. Later forensic testing revealed that all six of the shell casings were ?red from the same weapon. Over the course of the investigation, witnesses were interviewed. Witness One stated that IT was in the area of Sherman Circle NW when IT heard multiple gunshots. IT looked and saw the defendant ?ring at the decedent who was on a bicycle. IT stated that the decedent then fell off the bicycle at the corner of Kansas Ave and Sherman Circle; NW. The decedent had begun to stand at which time the defendant approached and ?red two shots at the decedent at close range. Witness One then observed the defendant ?ee southbound in the 4600 block of Kansas Avenue NW. Another witness, hereinafter Witness 2 was interviewed, who stated that IT too was in the area of Sherman Circle at the time of the offense. Witness 2 stated that it observed the decedent riding a bicycle northbound in the 4600 block of ansas Avenue NW. IT then observed the defendant walk in the direction of the decedent. The defendant thenli?lred approximately 4-5 shots at the decedent. After the shots, the decedent fell off the bicycle at the corner of nsas Avenue and Sherman Circle NW. IT stated that as the decedent attempted to get back up and on the bicyble, the defendant jogged up to the decedent, closing the distance between the two, and ?red once . 650/0 OQWMB307 more at the decedent at close range. Witness 2 then observed the defendant ?ee on foot southbound in the 4600 :block of Kansas Avenue NW. Witness 2 has known the defendant for a signi?cant period of time. was shown a con?rmatory photograph depicting Eric Foreman, DOB: 9/18/1993 and PDID: 617-414. Upon viewing the photograph, Witness 2 positively identi?ed him as the person IT saw shoot the man on the bike. Witness 3 was located and interviewed regarding the shooting death of the decedent. Witness 3 stated that IT heard the defendant state that he wanted to go pull a move. Subsequently, Witness 3 observed the decedent riding a bicycle near the corner of Kansas and Buchanan Avenues, NW. AS the decedent neared the circle, the defendant approached him and tried to rob him. The defendant was observed pointing a gun at the decedent and ?ring shots causing the decedent to fall to the ground. Subsequently, Witness 3 heard the defendant say that IT took $60.00 from the decedent. Witness 3 stated that prior to observing the shooting of the decedent, IT had smoked marijuana. Witness 3 has known the defendant for a signi?cant period of time. Witness 3 was shown a con?rmatory photograph depicting Eric Foreman, DOB: 9/ 1 8/ 1993 and PDID: 617-414. Upon viewing the photograph, Witness 3 positively identi?ed him as the person IT saw shoot the man on the bike. Forensic testing conducted by the Metropolitan Police Department Firearms and Toolmark Examination Section revealed that the six .3 80 caliber shell casings were ejected from a single gun. Moreover, it was discovered that the same weapon that ejected the six .380 caliber shell casings was used in an earlier shooting that occurred on August 21, 2010, at approximately 7:30 pm, in the area of the 4900 and 5000 blocks of Illinois Avenue, NW, where three .3 80 shell casings were recovered. A person other than the defendant has been arrested and charged with the August 21, 2010 shooting. Moreover, investigation revealed that the defendant and the person charged in the earlier shooting are friends and both belong to the same street gang. Furthermore, your Af?ant knows from training and experience that individuals that belong to the same street gang Share and use the same ?rearms. Finally, several witnesses stated that IT had observed the defendant drinking alcohol earlier in the evemng.
