United States Drug Administration Special Agent larrell Pen-y, while conducting oil-going drug interdiction investigations in Albuquerque, New Mexico, reviewed an Amtrak in Passenger Name Record (PNR) in the names orRiehard GRUNDY and The record one-way travel from Flagstaff. Arizona to Chicago, lilinois, which was reserved on December 2, 2010 and paid for with $426.00 in cash on 3, 2010, the date of departure of the Amtrak Train from Flagstaff, Arizona. On December 3, 2010' SM Pony and TH) clayhorne were at the Amtrak Train Station In Albuquerque, New Mexico to meet the eastbound Anrtrak 'I'raln traveling rrom Los Angeles, California to Chicago, Illinois. Pcny approached a male. later identified as wire was seated in the window seat, approximately three-fourths of the way from the from of the coach car, on the left hand sidc ofihe itch car. Perry stood to the from of-'s scat, out of the aisle, In order to avoid blocking _s egress from his seat or movement on the Amlrak Train. Pcny removed his DEA badge and credentials from his leil rear pocket, displayed them to-, himself as a police officer I0 asked for and received permission from to speak with hinr Pcny asked - iflic had an Amtrak Train ucket with him that Perry could see and _handed Perry an Amtrak Tram ticket in the name of -- Perry reviewed the Amtrak Train ticket folder and immediately returned it to - Perry asked if he had identification with him and _said yes. Perry asked - ii Perry could see his and 81A Perry said yes. Perry asked _where he was traveling to and _said Chicago. Pci'ry asked -where he was traveling from and _sard Arizona. Perry asked _if he lived in Arizona and _said yes, Perry asked -how long he was going to be in Chicago and _said ror his birthday which was on Sunday and that he was going to be returning to Arizona on Monday. handed Perry an Admin: identification card in the name tri-- perry reviewed the identification and immediately returned it to -. Peny asked if he had traveled via 5 the Amtrak Train in the past and - said that this was his first trip traveling on the Atntrak Train. Perry asked ifhe was traveling alone or with someone and -said that he was traveling alone but, that he was with his ti-iend who was a guide, Perry asked - if he had any luggage with him and _pointed towards that overhead luggage compartment direetly alsove his head and said that he had one hag loeated there. Pt, observed a duffel type bag lying in the overhead luggage compartment direetly above _s seat Perry asked-ifhe had any other luggage on the Anrtr-ak Train and--said no. 8% Perry explained his duties as they penaill to interdiction on the Amtrak 'l'rain, specifically that there was a problem with passengers utili7ing the Train to transport contraband. Perry asked for consent to seareh his duffel bag for eontrahand and_ said yes. Perry searched _s duffel bag with negative results for contraband, During the time that Perry was speaking with - 'l'l'O Claybumc was conducting a consensual encounter with a difTei'cnt male later identified as Richard Bernard GRUNDY who was seated one seat back from where - was seated, across the aisle way, in the window seat, TFO Claybume asked for and received eonsent from GRUNDY to search GRUNDY's cornputer- hog which was located directly above his seat for contraband, which produced negative results. the ohserved that GRUNDY did not have any form ofetothing with hint. Perry walked downstairs to the conrnron luggage area of ctlacll car number and observed two ditTerent hogs that did not have narue tags attaehed. Olle bag was a rolling type duffel bag. colored red/black and the other- was a black suitcase that was lying directly beside the red/black duffel bag. Perry lifted up bags and observed that they were overly heavy for their size, A witness ohsetved GRUNDY and _board the Anrtt-ak Train in Flagstaff, Arizona transporting the red/black rolling type duffel hag. Perry approaehed and asked Perry could speak with downstairs in the luggage area--said yes and walked downstairs to the eorrunon luggage area. Perry pointed to the red/hiaek eolnred duffel bag and black suitcase and asked if either 6 bag belonged to him. - said no. Perry asked _if he knew who either bag belonged to ahd_ said no. Perry asked -ifhe had anything inside or either bag and-said ho. Perry asked _if he cared what happened to either bag and _said no, Perry asked _fhc had any interest in either bag and _said no. TFO Clayborne approached GRUNDY, who was seated upstairs in his respective seat, and asked GRUNDY if he could speak Willi Perry>> who was downstairs in the common luggage area, GRUNDY agreed and walked downstairs to the common luggage area where Perry was located, Perry displayed his DEA badge and credentials to GRUNDY, identified himself as a police officer and parlner of TFO Clayborne. Perry asked GRUNDY if Perry could ask GRUNDY a few questions and GRUNDY said yes. Pen'y pointed to the red/black duffel type bag and the black suitcase and asked GRUNDY if either bag belonged to him. GRUNDY said no. Perry asked GRUNDY if he knew who either bag belonged to and GRUNDY said no. Perry asked GRUNDY if he had anything inside of either bag that belonged to him and GRUNDY said no. Perry asked GRUNDY if he had any interest in either bag, and GRUNDY said no. Ferry asked GRUNDY if he cared what happened to either bag, and GRUNDY said no. Perry and TFO Clayborne carried both bags to the upper seating area of coach car number 412, the car in which both GRUNDY and _wei-e seated. Perry and TFO Clayborne walked both bags from the front of the coach car to the rear, in an attempt to determine nvlmership. No one claimed ownership of the either bag. Perry and TFO Clayborne determined that both bags were abandoned Perry and TFO carried both bags downstairs to an empty room and opened both bags. Both bags contained numerous gray duet-taped bundles concealed inside of various men's clothing. Perry knew from his training and experience that the bundles/ packaging were consistent with illegal narcotics, specifically marijuana Perry observed that the men's clothing was very large in size and consistent with the clothing that GRUNDY was wearing. GRUNDY had earlier informed TFO Clayborne that he did not have any form of clothing with him on the Amtrak Train. e/A Perry and TF0 Claybornc handcuffed GRUNDY and placing both under arrest. and _were removed from the Amtrak Train. along with their personal belongings. Ferry and TFO claybome transported the two bags containing the suspected bundles ofillegal narcotics to the DEA office, along with GRUNDY and - At the DEA ADO, GRUNDY and _Verc placed into temporary holding cells. Ferry and TF0 Clayborne conducted thorough searches of the two bags containing the suspected bundles of illegal narcotics. Various photographs were taken or the process or removing the bundles, Exhibit 1, from the two bags. Perry and TF0 Clayborne weighed Exhibit 1, which weighed approximately 21.30 gross kilograms, Ferry and TFO claybonre cut into the bundles, which revealed a green leafy substance which field>>lested positive {or the presence of marijuana. Fery and TF0 obtained 10 representative sanrples, Exhibits lA-ll, from Exhibit 1. Exhibit 1 was processed and subsequently transferred to the ADD Drug Evidence Custodian for storage and safekeeping. Exhibits lAelJ were processed and subsequently mailed to the DEA South Central Laboratory for analysis and safekeeping, registered mail, return receipt requested by Perry and TFO Claybome. Ferry and TFO Clayborne processed GRUNDY and which included taking fingerprints and photographs and completing personal history forms. At approximately 3:00 p.ni., Ferry and Clayborne interviewed GRUNDY concerning his involvement in the transportation olmnrijuana from Phoenix, Arizona to Chicago, illinois. Ferry, witnessed by TF0 Clayborne, read GRUNDY his Miranda rights. GRUNDY said that he understood each and all of his Miranda rights. GRUNDY said that he made a stupid mistake and that he cannot blame anyone but hiniselfthat he is sitting here, GRUNDY then said that he wanted an attorney with him during questioning and the interview was terminated at approximately 3:03 p.mr At 3:22 pm, Ferry, witnessed by TF0 clayborne, interviewed concerning his involvement in the transportation of marijuana from Phoenix, Arizona to Chicago, Illinois. Ferry, witnessed by TFO Clayberne, read _his Miranda rights. _said that he understood each and all ot'his Miranda rights and was willing to answer questions. - said that he has known the 8 person he was lravcling with. Ricky>> referring to GRUNDY, for approximately three months and met Ricky through his uncle in Indianapolis. said that Ricky traveled to Phoenix for a birthday party and that kieky was in Phoenix again over Thanksgiving visiting. - said a mutual friend or_s and Ricky's, -- was having a birthday party in Indianapolis on Decemher x, 2010 and that he was guing to attend the party to celebrate-- birthday as well, tvlnelr is 5, 2010. _said that --told -that he was going to pay for- airline ticket to tly to indiananolis hot, that GRUNDY was coming to lecnix and that -eould travel back on the Amtrak Train to lttdianapolis with GRUNDY. - said that-sent motley for the Amtrak Train to - via Western Union. _said that he met GRUNDY at the Amtrak Train Station in l-'lagstarr and that _oblained a tide from his auntie, to lite Amlmk Train Station in Flagstaff, Arizona said that GRUNDY had the two bags, the black suitcase and the red/black rolling duffel type bag with him at the Amtrak Train Station, _said that GRUNDY had _roll the black suitcase to the Amtrak Train when it arrived, said that GRUNDY placed the black suitcase and red/black duffel bag onto the Amtrak Train when it arrived in Flagstaff, Arizona -said that he did not know there was anything illegal inside of the two bags but, he did not want In tell on URUNDY for anything. --has not come up in any subsequent investigations relating Io GRUNDY.
