Westchester SOUTHERN DISTRICT OF NEW YORK, 88.: SEAN P. FOGARTY, being duly sworn, deposes and says that he is a Task Force Officer with the Drug Enforcement Administration (the and. a Detective with. the City' of Yonkers Police Department (the and charges as follows: COUNT ONE 1. On or about December 7, 2017, in the Southern District of New York, ANSLEY R. ESTRELLA, RONALD E. LEON, and LUIS OSCAR REYES, a/k/a ?Carlos Reyes?Sanchez,? the defendants, and others known and unknown, intentionally and knowingly did cembine, conspire, confederate, and agree together and with each other to Violate the narcotics laws of the United States. 2. _It__was part and an object of the conspiracy that ANSLEY R. ESTRELLA, RONALD LEON, and LUIS OSCAR REYES, a/k/a ?Carlos J. Reyes~Sanchez,? the defendants, would and did distribute and. possess with the intent to distribute a controlled substance, ill violation (n3 Title 21? ?United States Code, Section 84l(a)(l). 3. The controlled substances that ANSLEY R. ESTRELLA, RONAHD E. LEON, and LUIS OSCAR REYES, a/k/a ?Carlos J. Reyes? Sanchez?' the defendants, conspired 1x) distribute emmi possess with intent to distribute were: (1) five kilograms and more of mixtures and substances containing a detectable amount of cocaine; and (2) one kilogram and more of mixtures and substances containing 'a detectable amount of heroin, in violation of Title 21, United States Code, Section (Title 21, United States Code, Section 846). COUNT TWO 4. On or about December 7, 2017, in the Southern District Of New York, ANSLEY R. ESTRELLA, RONALD E. LEON, and LUIS OSCAR REYES, a/k/a ?Carlos J. Reyes?Sanchez,? the defendants, intentionally and knowingly did distribute and did possess with intent to distribute a controlled substance, in violation of 21 U.S.C. 84l(a)(l), and aid and abet the same. 5. The controlled substances involved in the offense were (1) five kilograms and. more of mixtures and substances containing a detectable amount of cocaine; and (2) one kilogram. and. more of mixtures and substances containing a detectable amount of heroin. (Title 21, United States Code, Sections 84l(a)(1) and Title 18, United States Code, Section 2). The bases for my knowledge and the foregoing charges are, in part, as follows: 6. it an a Task Force Officer with the Drug Enforcement Administration and. a Detective with the YPD and I have been personally involved in the investigation of this matter. This affidavit is based in part upon my conversations with other law? enforcement agents and.1ny eaxaminatitml of reports and. records. Because this affidavit is being submitted for the limited purpose of establishing probable cause, it does not include all the facts that I have learned during the course of my investigation. Where the contents of documents and the actions, statements and conversations of others are reported herein, they are reported in substance and ill part, except where otherwise indicated. 7. I have reviewed a summary of a radio run generated by the YPD at approximately 7:36 pm on December 7, 2017. According to that summary,-YPD officers were told that a call had come in indicating that the caller saw three men?one with an object in his hand?push another man into a house at 105 Sweetfield Circle in Yonkers, New York. 8. I have spoken with a YPD police officer (the ?Officer?), who told me the following: a. On the evening of December 7, 2017, the Officer was on patrol in Yonkers when he received a radio run indicating that three males?one with an object in his hand?appeared to drag a fourth male into a house at 105 Sweetfield Circle (the ?House?). The Officer?and other police officers?drove tx> the House. b. When the Officer arrived, he saw nothing outside of the House. As he and other officers approached the front of the House, a man?later identified as ANSLEY R. ESTRELLA, the defendant?came out of the front door of the House, leaving the door open behind him. One of the police officers asked ESTRELLA if he lived there and ESTRELLA responded that he had lived in ,the House with his girlfriend for about a month. ESTRELLA told the officers that nobody'else was inside the House. c. Although the shades were drawn on the House, the lights were on, and the Officer was able to see silhouettes of people moving inside of the House. The officers asked ESTRELLA again. if there was anybody inside the House; ESTRELLA. again denied that there was anybody inside the House. d. The Officer? and. one or Inore of Ihis colleagues approached. the front. door. As the Officer' did. so, In: heard another police officer ask ESTRELLA if ESTRELLA had any weapons. ESTRELLA responded that he had a screwdriver. The other police officer instructed to put the screwdriver on the ground. e. When. the Officer approached. the front door, he saw a manwlater identified as LUIS OSCAR REYES, a/k/a ?Carlos J. ReyesMSanchez,? the defendant~wearing a surgical mask inside the House. As he stepped closer, but while still outside the door, the Officer saw a second man?later identified as RONALD E. LEON, the defendant?wearing a surgical mask inside the House.1 mask did not cover his entire face, and the Officer saw blood on face. The Officer entered the House and asked LEON if he was hurt; LEON denied being hurt, despite the blood on his face. The Officer and other police officers asked LEON and REYES ifv they lived in the house; both men said they did not live in the' my' training' and. experience, I knOW' that individuals who package controlled substances?such as cocaine and heroinmoften use surgical or respiratory masks in order to avoid inhaling the residue of the controlled substances. House. The Officer and other police?officers asked LEON and REYES to come to them inside the front door; LEON and REYES complied. f: The Officer and others began to walk around the house in order to determine if there were additional individuals committing EH1 ongoing' crime if there were 'victims in the house. The Officer entered a room on the second floor where he saw white powder in various places, including on the floor, and respiratory masks on a glass table. In that room, there was a closet with an open door; through the open door, the Officer saw a large number of glassine envelopes and scales. g. The Officer then went tx: the basement level of the House, where he went through a door into the garage. He turned on the light in the garage and saw a black Honda Accord. As the Officer walked past the Honda Accord, he saw through the car window three bags in the rear seat: two duffel bags and an open Victoria?s Secret shopping bag. Inside the shopping bag, the Officer could see what appeared to be bundles of decks of heroin. 7 h. Having cleared the House, the Officer and the other police officers left the House,_taking LEON and REYES with them. The Officer and the other police, officers placed ESTRELLA, LEON, and REYES under arrest. At that time, ESTRELLA identified himself as ?Ansley Estrella," LEON identified himself as ?Ronald Leon?Lopez,? and REYES identified himself as ?Carlos J. Reyes?Sanchez.? As part of the arrest, and during the safety pat~down, the Officer and other police officers took car keys from each of ESTRELLA, LEON, and REYES. Those key fobs had electronic alarm buttons. The Officer pressed the electronic alarm buttons; the keys taken from pocket set off the alarm on the Honda Accord. i. The Officer and other police officers sought and obtained a search warrant to search the House, the Honda Accord, and two other cars. 9. I have reviewed documents prepared by the YPD relating to the results of the court?authorized search of the House and the Honda Accord, and saw some of the items found during those search, and learned the following: I a. Among other things, YPD found 13 bricks of what appears to be cocaine. The YPD fieldwtested one of the packages, which tested positime for cocaine. I looked at: the bricks; in my training and experience, they are one?kilogram bricks of cocaine. b. Among other things, YPD found 18,598 glassine envelopes containing what appears to be heroin. As a matter of policy, YPD does not field?test what appears to be heroin. However, I looked at some of those glassine envelopes and, in my training enui experience, they appear ix) conta?n heroin. YPD also found three large boxes of empty glassine envelopes. c. Among other things, YPD found 813 tan pills stamped d. Among other things, YPD found a number of plastic bags and clear knotted twists containing white chunky substances. e. Among other things, YPD found a scale, five small grinders, assorted stamp pads and stamps, and a metal kilogram press. In my training and experience, I know these devices are used as tools in packaging controlled substances such as cocaine and heroin for both wholesale and resale. f. Among other things, YPD found a ?neney?counting machine. 10. While he was being processed today, REYES admitted to me that the name he had given to YPDM?Carlos J. Reyes?Sanchez?? was a false name. He said that his true name is ?Luis Oscar Reyes? he was previously deported, and he re?entered the United States from the Dominican Republic last week. WHEREFORE, deponent respectfully requests that R. ESTRELLA, RONALD E. LEON, and LUIS OSCAR REYES, a/k/a ?Carlos Reyes?Sanchez,? the defendants, be imprisoned, or bailed, as the. case may be.v SEAN P.
