Declaration of Jacquelyn Carter I live in Converse County, Wyoming, on my ranch headquartered at 976 Boxelder Road, Glenrock, Wyoming 82637. On Wednesday, March 17, 2009, about 6:30 PM, a Mr. Lin Alder came to see me. He introduced himself as working for Wasatch Wind, who he said is a Utah company seeking to develop a wind farm in the area in which my ranch is located. I told Mr. Alder that I was not interested in participating in a wind farm development, but I invited Mr. Alder to come in to visit for a few minutes and describe the project in more detail. During his visit he described more about what he said Wasatch Wind offered to landholders participating in its proposed wind farm development. Among other things, he said Wasatch Wind offered a small annual fee, in the neighborhood of five dollars per acre per year, during the time in which it conducted testing to determine where to put wind turbines. He said this period would last about two years. He also told me that I could expect thereafter, when turbines had been installed, to earn $550,000 to a maximum of $770,000 per year if Wasatch Wind included my land in its project. I asked what would be the minimum amount. He did not respond. As he left my house, Mr. Alder told me that I would be sorry not to be participating in Wasatch Wind's development. He said that all of my neighbors had signed up. He said that I would look around to see turbines on their land and know they were making money while I was not. Thereafter, I checked with several neighbors. To the best of my knowledge, information and belief they have not signed up with Wasatch Wind or any other wind developer. The conversation with Mr. Alder lasted approximately 90 minutes. I declare under penalty of perjury that the foregoing is true and correct. Declaration of Diemer True I am a principal of our family company, Diamond Ranches, LLC, which owns ranch property in Converse County, Wyoming. The office address for the ranch is 350 Big Horn Road, Building B, Casper, Wyoming 82601 On February 20, 2009, Mr. Tracy Livingston, CEO of Wasatch Wind, Wasatch attorney and land man, Allen Stockbridge, and another Wasatch representative, Nate, met with me to discuss Wasatch's interest in leasing our ranch for wind energy development. Wasatch assured us that it had at least one neighbor committed to lease its ranch to Wasatch, although Wasatch did not identify the neighbor. Wasatch told us that the terms and the lease form were not negotiable because Wasatch had other landowners lined up. Wasatch stated that it could install 1 megawatt per 20 acres, and wanted to lease approximately 8,000 acres from Diamond Ranches. Regarding the financial consideration Wasatch would pay to Diamond Ranches, Wasatch confirmed the information in their letter of December 19, 2008 including the handwritten insertion, "actual rent closer to $26,000 per year, per turbine". That letter and accompanying enclosures are attached to this declaration. I told Mr. Livingston, et al, that Diamond Ranches was not interested in leasing our land for wind development. They assured me that because they had, or would have, our neighbors land leased that I would experience the associated impacts. As a result, I might as well enjoy the income which would come with leasing to them. Thereafter, I checked with a number of our neighbors including Art Nicholas at the Wagonhound Ranch, John Sullivan of the Sullivan Ranch, Bob Hageman of the Mountain View (Simms) Ranch, Mrs. Elsie Dininger of the Dininger Ranch and Roger Wesnitzer of the Meadow Creek Ranch all of whom constitute the vast majority of my neighbors, and none of whom have leased their land to Wasatch.
